This permit is for the storage and dispatching of mini buses which carry 24-36 passengers in the I-1 Zone. CB-87-2015 defined Private Limousine Service Dispatching Station and amended the Industrial Use Tables to only permit the use in the I-3 Zone under certain circumstances. The use is currently prohibited in the I-1 and I-2 Zones, therefore this application cannot be approved. I called and discussed the issues with the applicant, David Glazier, and feels that he should be considered a bus service/bus terminal and not a limousine service per the Maryland Transportation Code. I met with our legal office yesterday to discuss the applicant’s proposal and it was determined that the use would still fall under the category of Private Limousine Service Dispatching Station due the definition adopted by CB-87-2015, the fact that this definition ties the use to the definition of “Limousine” in Subtitle 20, and that per Section 27-103(a) of the Zoning Ordinance whenever any provision of the Zoning Ordinance imposes a greater requirement or a higher standard than is required in any State or Federal statute or other County ordinance or regulation, the provisions of the Zoning Ordinance shall govern unless preempted by State or Federal law. Our legal office has indicated that the Industrial Use Tables in Subtitle 27 needs to be amended to allow the use in the I-1 and I-2 Zones. I emailed the comments to David Glazier at [email protected] 7/27/17 – OK per CB-72-2017 which amended the Industrial Use Tables to permit a Private Limousine Service Dispatching Station in the I-1 and I-2 Zones.</p>
