<p>Soil and Water Conservation District Administrative Policies and Procedures</p><p>Chapter 4 Employment Responding to a Subpoena Policy Effective date Revised</p><p>Number: 4.04 January 1, 2009</p><p>Any employee who receives a subpoena related to their work at the district, must immediately contact the board of supervisors to determine the proper course of action.</p><p>REFERENCES</p><p>Subpoenas, issuance – form – how served – how enforced RSMo 536.077 http://www.moga.mo.gov/STATUTES/STATUTES.HTM</p><p>Other District policies Conduct and Ethics Leave with Pay Expense Accounts </p><p>DEFINITIONS</p><p>Subpoena: a written legal order summoning a witness or requiring evidence to be submitted to a court or similar deliberative body. </p><p>Professional witness: a specialist in a subject who presents an opinion without having been a part to any occurrence relating to the lawsuit or criminal action. </p><p>GENERAL PROVISIONS</p><p>Staff receiving a subpoena related to their work for the district, must immediately contact the board.</p><p>The subpoena must include monetary compensation according to state and federal law for daily attendance and mileage if applicable. Mileage only has to be paid if the employee has to travel more than 40 miles, one way, as a witness. These fees may not cover the entire cost of testifying. Any fees received with a subpoena to testify are deposited into the district’s fund account. The subpoenaed employee then requests reimbursement for expenses associated with testifying, such as mileage, meals or lodging, through the normal Expense Account procedures .When an employee receives such a work related subpoena and compensation, the minimum 12-hour travel status rule for meal reimbursement does not apply.</p><p>1 Soil and Water Conservation District Administrative Policies and Procedures</p><p>Chapter 4 Employment Responding to a Subpoena Policy Effective date Revised</p><p>Number: 4.04 January 1, 2009</p><p>Time spent responding to a subpoena related to work at the district is coded as work time. If an employee is subpoenaed concerning events not related to work at the district, approved annual leave or compensatory time must be taken.</p><p>If an employee of the district is asked to testify as a professional witness, it is considered outside employment. Procedures outlined in Conduct and Ethics for permission for outside employment must be followed before accepting.</p><p>2</p>
