On Motion of Mr. Roberts, Seconded by ______, the Following Resolution Was Offered

<p> On motion of Mr. Roberts, seconded by ______, the following resolution was offered: RESOLUTION NO. ______A resolution requesting the Administration to develop and implement a process to return and refund pro rata all remaining escrowed fines collected during the operation of the Parish’s Red Light Camera Safety Program established under contract with Redflex Traffic System, Inc., to the persons who paid fines for red light camera violations under said program. WHEREAS, all fines collected during the operation of the Parish’s Red Light Camera Safety Program established under contract with Redflex Traffic System, Inc., have been held in escrow since the suspension of the enforcement of the program and pending the outcome of civil litigation between the Parish and Redflex; and WHEREAS, the propriety of the red light camera programs operated by the Redflex corporation have been called into question in other jurisdictions, with allegations against the company of public bribery in Chicago and the company’s own investigations into similar allegations in at least two other areas; and WHEREAS, due to the high degree of uncertainty about the legality and ethicality of the operations of the Redlex camera systems here and in other areas of the country, it is this Council’s wishes that, upon conclusion of the litigation between Jefferson Parish and Redflex, all remaining escrowed fines collected during the operation of the Parish’s Red Light Camera Safety Program be returned pro rata to the persons who paid fines under said program; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE JEFFERSON PARISH COUNCIL, acting as governing authority of said Parish, SECTION 1. That this Council hereby requests the Administration to develop and implement a process to return and refund pro rata all remaining escrowed fines collected during the operation of the Parish’s Red Light Camera Safety Program established under contract with Redflex Traffic System, Inc. to the persons who paid fines for red light camera violations under said program. SECTION 2. That the Parish Attorney shall determine when and how to implement the process of returning these fines to the payers upon conclusion of the litigation between Jefferson Parish and Redflex Traffic System, Inc. The foregoing resolution having been submitted to a vote, the vote thereon was as follows: YEAS: NAYS: ABSENT: The resolution was declared to be adopted on this the 13th day of March, 2013.</p>
