SOLID WASTE, RECYCLING AND GREEN WASTE </p><p>DISPOSAL REGULATIONS.</p><p>…..</p><p>(g) Any responsible party who violates this section 9-405 </p><p> is subject to the following enforcement provisions, without limitation </p><p> upon rights and remedies otherwise available to the city:</p><p>(1) A notice of violation shall be issued and served</p><p> for the first and second violation of this section 9-405 </p><p> occurring at a service location. </p><p>(2) For the third and subsequent violation of this </p><p> section 9-405 occurring at a service location, public nuisance</p><p> proceedings under Section 800 et seq. of Chapter 9 of this </p><p>Code and/or code enforcement proceedings under Section </p><p>401 et seq. of Chapter 1 of this code shall apply, including </p><p> penalties approved by resolution of the city council, as </p><p> modified from time to time, provided that in no event shall </p><p> administrative penalties assessed under this subsection (g) </p><p> exceed $1,500 during any period July 1 through June 30.</p><p>SECTION 9-405.1. MANDATORY SERVICE</p><p>(a) Every person owning or occupying a residence or </p><p> commercial establishment, and each person generating </p><p> construction and demolition debris/material under a city issued </p><p> building, relocation or demolition permit shall subscribe to solid </p><p> waste collection service and recycling collection service from an </p><p> authorized collection agency. </p>
