<p> OPINION</p><p>(OLEC 95-5)</p><p>March 7, 1995</p><p>QUESTION PRESENTED:</p><p>May a member of the General Assembly who owns or controls an interest of more than 5% in a business sell products to the Commonwealth under the Small Purchase Procedures adopted by the Finance and Administration Cabinet requiring three or more informal quotes?</p><p>DISCUSSION:</p><p>KRS 6.737 provides "A legislator or candidate by himself, or through others, shall not intentionally undertake, execute, hold, or enjoy, in whole or in part, any contract, agreement, sale, or purchase of the value of one hundred dollars ($100) or more per transaction, made, entered into, awarded, or granted by any state agency, except: (1) Contracts, agreements, sales, or purchases between a state agency and a business in which the legislator and his spouse, collectively, own or control an interest of five percent (5%) or less; (2) Contracts, agreements, sales, or purchases made or let after public notice and competitive bidding; (3) Contracts, agreements, sales, or purchases which are available on similar terms to members of the legislator's business, occupation, or profession; or (4) Contracts or agreements entered into prior to the time the legislator became a candidate." OLEC 95-5 PAGE TWO March 7, 1995</p><p>Under the Small Purchase Procedures issued by the Finance and Administration Cabinet, Commonwealth Agencies may make certain small purchases that require three or more telephone or written quotes. Such sales would come within the exclusion provided in KRS 6.737(3) for sales "which are available on similar terms to members of the legislator's business, occupation, or profession." Therefore, a member of the General Assembly may participate in this purchasing program so long as there is no indication that a potential sale is being offered to his business as a result of his official position.</p><p>OPINION:</p><p>A member of the General Assembly who owns or controls an interest of more than 5% in a business may sell products to the Commonwealth under the Small Purchase Procedures adopted by the Finance and Administration Cabinet requiring three or more informal quotes. Such sales would come within the exclusion provided in KRS 6.737(3) for sales "which are available on similar terms to members of the legislator's business, occupation, or profession."</p>
