<p> ORDER NO: 15-1112-5 </p><p>STATE OF CALIFORNIA</p><p>STATE ENERGY RESOURCES CONSERVATION AND DEVELOPMENT COMMISSION</p><p>DECISION AND ORDER APPROVING SETTLEMENT RE: iROBOT CORPORATION</p><p>WHEREAS, iRobot Corporation (iRobot) manufactures several models of robotic cleaning devices, including the Roomba, the Braava, the Create, the Looj, and the Scooba.</p><p>WHEREAS, the Energy Commission has alleged that these products are subject to the appliance efficiency standards, test procedures, marking, and reporting requirements for small battery charger systems, described in California Code of Regulations, Title 20, sections 1604(w), 1605.3(w)(2), 1606, and 1607.</p><p>WHEREAS, iRobot’s products, with the exception of the Looj, did not meet the energy efficiency standards for small battery charger systems.</p><p>WHEREAS, from February 1, 2013 to March 31, 2015, iRobot sold, attempted to sell, or assisted in selling products in California that did not appear in the Appliance Efficiency Database and were not tested, marked, or certified before they were sold or offered for sale in California.</p><p>WHEREAS, the Energy Commission has estimated that the sale of iRobot’s products resulted in more than $1,000,000.00 in excess electricity use in California.</p><p>WHEREAS, iRobot does not agree that its products are subject to the appliance efficiency standards for small battery charger systems, nor with the estimate of excess electricity use.</p><p>WHEREAS, the State Energy Resources Conservation and Development Commission (Energy Commission) and iRobot have negotiated a settlement to resolve the matter. </p><p>WHEREAS, the Energy Commission’s legal office has considered the application of the California Environmental Quality Act (CEQA) to the approval of this settlement agreement and has opined that it is “not a project” under Title 14, California Code of Regulations, section 15378.</p><p>THEREFORE, IT IS ORDERED, that the Energy Commission approves the settlement agreement with iRobot, to resolve the matter described above.</p><p>IT IS FURTHER ORDERED, that this document authorizes the Executive Director or his/her designee to execute the same on behalf of the Energy Commission.</p><p>CERTIFICATION</p><p>The undersigned Secretariat to the California Energy Commission does hereby certify that the foregoing is a full, true, and correct copy of an ORDER duly and regularly adopted at a meeting of the California Energy Commission held on November 12, 2015:</p><p>AYE: [List Commissioners] NAY: [List Commissioners] ABSENT: [List Commissioners] ABSTAIN: [List Commissioners]</p><p>______Tiffani Winter, Secretariat</p>
