<p>Ms Fanny Malinen</p><p>By Email Your ref: [email protected] My ref: 101002006420 Date: 21st May 2015</p><p>Dear Ms Malinen</p><p>Your request for an Internal Review under the Freedom of Information Act 2000</p><p>Thank you for your email dated 6th May 2015 relating to your recent request for information and your request for an internal review into the Council’s handling of this case. </p><p>My understanding is that you felt the answers given to questions 2, 4 and 7 of your Freedom of Information request were inadequate.</p><p>How I reached my view</p><p>In reviewing this case, the information that I have reviewed and considered includes </p><p> The original request for information The original response Any exemptions applied The Public Interest Test and decision The procedures used in your original response</p><p>My final view</p><p>I have reviewed the case as an independent reviewer and my conclusion is that:</p><p>I believe question 2 has in part been answered from the data provided as it provides a start date for the loan which gives a reasonable proxy as to when the loan agreements would have been signed. I can add that they would have been signed by an authorised office in line with the Councils constitution and Treasury Management policies and practices.</p><p>Question 4, in my opinion, has been answered in that it was the Councils own treasury team at the time who would have analysed the market at the time, the loan options available at that time and advised the Chief Finance Officer that LOBOs were the best fit for the Councils debt position. The review then asks about who we have consulted, Cornwall Council, County Hall Truro, TR1 3AY Tel: 0300 1234 100 www.cornwall.gov.uk which is a slightly different ask to the original question around advice. The Councils Treasury consultants would have been consulted on these deals and provided their opinion which would have been taken in to account when the team gave their advice.
