<p> UNEMPLOYMENT INSURANCE APPEAL BOARD NOVEMBER 10, 2010 WILMINGTON MINUTES</p><p>The meeting was held at 4425 N. Market Street Wilmington, DE. A quorum of the Board was present for the meeting. Present: Elmer L. Newlin, Chairman of the Board, Vance G. Daniels, Sr., Beverly Bell, and Donald Dryden, Board Members. Also present were Katisha D. Fortune, Deputy Attorney General and Counsel to the Board, and Tanishia Stewart, Board Secretary.</p><p>THE FOLLOWING CASES WERE HEARD BY THE BOARD:</p><p>Michael Chapman v. Genesis Eldercare – AD # 20155195</p><p>Present: Cynthia DePue, claimant’s attorney; Michael Chapman, claimant. Although duly notified, the employer, Genesis Eldercare, failed to appear. A motion was made by Mr. Dryden, and seconded by Mrs. Bell. The Board moved to dismiss. Mr. Newlin and Mr. Daniels approved. Mrs. Carpenter was not present for the hearing.</p><p>Sharon Benner v. Bank of America – AD # 20150065</p><p>Present: Sharon Benner, claimant. Although duly notified, the employer, Bank of America, failed to appear. A motion was made by Mr. Daniels, and seconded by Mr. Dryden. The Board moved to reverse the referee, and award benefits. Mrs. Bell and Mr. Newlin agreed. Mrs. Carpenter was not present for the hearing.</p><p>Steve Elder v. Careers USA – AD # 10155405</p><p>Present: Nicole Marvian, employer representative. Although duly notified, the claimant, Steve Elder, failed to appear. A motion was made by Mr. Dryden, and seconded by Mrs. Bell. The Board moved to dismiss. Mr. Newlin and Mr. Daniels agreed. Mrs. Carpenter was not present for the hearing.</p><p>Kelly Cummings-Macmillan v, Nicholas Donato Salon and Spa – AD # 20544779</p><p>Present: Laura Toner, employer representative; Peter Toner, employer representative. Although duly notified, the claimant, Kelly Cummings-Macmillan, failed to appear. A motion was made by Mr. Dryden, and seconded by Mrs. Bell. The Board moved to dismiss. Mr. Daniels and Mr. Newlin agreed. Mrs. Carpenter was not present for the hearing. Mildred Cassidy v. Liberty Staffing – AD # 20545875</p><p>Present: Mildred Cassidy, claimant; Richard Carter, claimant’s witness; Steve Mills, owner Liberty Staffing; Ashlee Pilla, employer witness; Mary Williams, employer witness. A motion was made by Mr. Dryden, and seconded by Mr. Daniels. The Board moved to affirm the referee and deny benefits. Mr. Newlin agreed. Mrs. Bell opposed. Mrs. Carpenter was not present for the hearing.</p><p>Raymond Grant v. Diamond Materials – AD # 10546265</p><p>Present: Raymond Grant, claimant; David Jones, employer representative. A motion was made by Mr. Daniels, and seconded by Mrs. Bell. The Board moved to affirm the referee and award benefits. Mr. Dryden and Mr. Newlin agreed. Mrs. Carpenter was not present for the hearing.</p><p>John Crisden v. Residence Inn – AD # 10154098</p><p>Present: John Crisden, claimant; Joseph Lewis, employer representative; Joe Diener, employer witness. A motion was made by Mrs. Bell, and seconded by Mr. Dryden. The Board moved to affirm the referee and deny benefits. Mr. Newlin and Mr. Daniels agreed. Mrs. Carpenter was not present for the hearing.</p><p>Linda Kruemmer v. Advance Sales – AD # 20544707</p><p>Although duly notified, the claimant, Linda Kruemmer, failed to appear. Although duly notified, the employer, Advance Sales, also failed to appear. A motion was made by Mr. Dryden, and seconded by Mrs. Bell. The Board moved to dismiss. Mr. Newlin and Mr. Daniels agreed. Mrs. Carpenter was not present for the hearing.</p><p>Matthew Bollinger v. Amazon.com – AD # 20542262</p><p>Present: Matther Bollinger, claimant; Kate Ferry, employer representative. A motion was made by Mr. Daniels, and seconded by Mr. Dryden. The Board moved to affirm the referee and deny benefits. Mrs. Bell and Mr. Newlin agreed. Mrs. Carpenter was not present for the hearing.</p><p>Rufus Settles Jr. v. Tire Kingdom – AD # 10545029</p><p>Present: Rufus Settles Jr. Although duly notified, the employer, Tire Kingdom, failed to appear. The Board moved to remand back to the referee, due to the claimant failed to appear for the referee hearing. G J Pour v. Life Force Care – AD # M0147147</p><p>POSTPONED</p><p>Adetayo Adeseye v. Keystone Auto – AD # 20548629</p><p>POSTPONED</p><p>Peter Osborne v. None Involved – AD # 20548210</p><p>Present: Peter Osborne. A motion was made by Mr. Daniels, and seconded by Mr. Dryden. The Board moved to affirm the referee and deny benefits. Mr. Newlin and Mrs. Bell agreed. Mrs. Carpenter was not present for the hearing.</p><p>Clinton Lawhorn v. Watkins Trucks – AD # 20547202</p><p>Present: Dan Lemanski, employer representative; George Watkins, employer representative. Although duly notified, the claimant, Clinton Lawhorn, failed to appear. A motion was made by Mr. Dryden, and seconded by Mrs. Bell. The Board moved to dismiss. Mr. Newlin and Mr. Daniels agreed.
