<p> COUNCIL AGENDA REPORT</p><p>City of Anaheim POLICE DEPARTMENT </p><p>DATE: SEPTEMBER 16, 2008 FROM: JOHN WELTER, CHIEF OF POLICE SUBJECT: APPROVAL OF AGREEMENT WITH LEADSONLINE, LLC</p><p>ATTACHMENT (Y/N): Yes ITEM # 15</p><p>RECOMMENDATION:</p><p>That City Council, by Motion: </p><p>(1) Waive Council Policy 4.0 and authorize the Chief of Police to enter into an agreement with LeadsOnline, LLC, to provide a nationwide database for pawn/secondhand dealer and metal recycling/junk dealer businesses within the City of Anaheim to record their daily transactions; and. (2) Authorize Chief of Police to execute and administer agreement, including authority to terminate the agreement.</p><p>DISCUSSION:</p><p>The Anaheim Police Department investigates residential/commercial burglaries, grand/petty thefts, and thefts of metal. The properties stolen in these crimes are often sold by the suspect(s) to pawn/secondhand dealer businesses and metal recycling/junk dealer businesses. </p><p>California State laws currently regulate these businesses. Pursuant to California Penal Code Section 21628, pawn/secondhand dealer businesses must report on a daily basis to the Chief of Police all transactions on a California Department of Justice (DOJ) approved form. The recorded transactions on the DOJ forms must contain the seller’s name, current address, driver’s license number, and a description of the serialized or non-serialized property sold. Pursuant to California Penal Code Section 21606, every metal recycling/junk dealer business must record on a document the place/date of each transaction, name/driver’s license number of seller, license plate number of seller’s vehicle, description of serialized or non-serialized property sold, and a statement by seller indicating they are the owner of sold property or the name of the person the seller obtained property from. Pursuant to California Penal code section 21607, every metal recycling/junk dealer business shall preserve the document for a period of two years. LeadsOnline is a nationwide database that allows the above-listed businesses to record their daily transactions using a computer instead of the current antiquated paper system. P.O. Anaheim Police officers will be able to access and utilize this database to search for suspect(s) and stolen property. </p><p>There is no cost to the business. The Anaheim Police Department would incur the cost of this database. As of this date, all pawn/secondhand dealer businesses in the City of Anaheim have already voluntarily registered and participated in the LeadsOnline database. The metal recycling/junk dealer businesses have been contacted by the Anaheim Police Department. Most of these businesses are in the process of voluntarily registering with LeadsOnline.</p><p>IMPACT ON BUDGET:</p><p>The yearly cost for the LeadsOnline database is $20,722 beginning in the proposed service for FY 08/09 and would have minimal impact on the Police Department’s budget in account #101-309-2270-7820.</p><p>Respectfully submitted,</p><p>JOHN WELTER CHIEF OF POLICE</p><p>Attachments: 1.
