<p> Republika e Kosovës Republika Kosova-Republic of Kosovo Qeveria –Vlada-Government </p><p>Ministria e Bujqësisë, Pylltarisë dhe Zhvillimit Rural - Ministarstvo Poljoprivrede, Šumarstva i Ruralnog Razvoja - Ministry of Agriculture, Forestry and Rural Development</p><p>Taking into account article 145 paragraph 2 of the Constitution of the Republic of Kosovo, article 1.3 (d) of the UNMIK Regulation no. 2001/19 dated on 13 September 2001 on the Executive Branch of Provisional Institution of Self Government in Kosovo, article 34, and 36.3 on Hunting Law no. 02/L-53 dated on 16.12. 2005, promulgated by UNMIK Regulation no. 2006/41 dated on 11.08.2006, Minister of Ministry of Agriculture, Forestry and Rural Development, Approves the following:</p><p>ADMINISTRATIVE INSTRUCTION NO. 06/2009</p><p>ON GIVEN IN MENAGMENT OF HUNTING JOINT HUNTING AREAS </p><p>Article 1 Purpose </p><p>The purpose of this Administrative Instruction is a designation that must be fulfilled by natural and legal persons for management of joint hunting areas, designation of market price for calculation of initial price and compensation of negative difference of wild life and the eventual damage caused in hunting area. Article 2 Joint Management Hunting Areas 1. Management of joint hunting areas shall be done by given of their management in rental form in the time frame of 10 years; 2. Joint hunting areas may be given to the natural and legal person’s management (Individuals, Associations, Companies or Agencies), local and foreign that meets requirements according to the Law on Hunting and specification stipulated by this Administrative Instruction. Article 3</p><p>Lease Joint Hunting Areas 1. Management of lease joint hunting areas shall be done by Municipality with consent of Ministry of Agriculture, Forestry and Rural Development. 2. Specification of lease joint hunting areas shall be based on Law on Hunting, Law on Public Procurement of this Administrative Instruction. 3. Lease shall be done through public tender that is promulgated after establishment of hunting area. </p><p>Article 4 Content of Tender Material 1. Tender material expects other must content also the following: 1.1. Description for the importance of joint hunting area, its proposal, and vision of management for the future; 1.2. Label of hunting area; 1.3. Map, surface and description of boundaries of hunting areas; 1.4. Surfaces structures ( forests, forests lands, meadows, pastures, fields, gardens etc) 1.5. Types and number of wild life in hunting area; 1.6. Types of traditional wild life for hunting, rare endangers and always protected; 1.7. Technical and accompany facilities in hunting area; 1.8. Initial price of hire for hunting area; Article 5 Designated specification for Bidder 1. Main specification - expect those as predicted with legislation of public procurement that must be fulfilled for taken on hire of joint hunting areas are as follow: 1.1. action registration evidence; 1.2. evidence on working experience in the management of wild life and hunting (this means for actual managers with hunting – hunting associations) by Federation of Kosovo Hunters, as well as description of management results by preliminary years; 1.3. evidence on working experience in management and achieved results in similar current activity (for other legal and natural subject such as: forestry, agriculture, veterinary, eco tourism, ecology); 1.4. evidence for professional service that will be committed in management, including number of the employees - qualified hunters, hunting guard, professionals of flora and fauna; 1.5. program for management goal and development of hunting area - protection and conservation, cultivation and growth of wild life; 1.6. evidence by courts that responsible person is not convicted or prosecuted for a criminal action; 1.7. evidence that is certified that there is no any financial liability over Kosovo Tax Agency; 1.8. evidence for sufficient possession of financial means for acting of this activity; 1.9. the highest tender price for rental. Article 6 1. Relative municipality is obliged that the documentation of all bidders and winner for management of joint hunting area to sent to the MAFRD – Department of Forestry for given of consent; 2. MAFRD – in the time frame of 30 days will do a scrutiny of the bidder documentation and decide for given or refusal of consent. </p><p>Article 7 Lease contract and payment 1. After the selection of beneficiary and taking the consent by MAFRD- the contract between municipality and beneficiary shall be signed. 2. The contract must contain conditions assigned by article 36 of the law on hunting as well as reasons for the premature abruptions of contract from article 37 of this law; 3. The amount of the lease shall be paid by municipality budget in which territory is the hunting area. 4. The way of lease payment, amount and the term are assigned in the contract between municipality and beneficiary. </p><p>Article 8 Compensation of the negative difference 1. The so far manager is obliged to pay the compensation of negative difference of wildlife and eventual bull caused in hunting area, whereas, in cases of premature abruptions of lease contract the current lease holder is obliged to do that. 2. Negative difference of wildlife and eventual bull is ascertained by professional commission established by hunting area establisher, municipality and ministry. 3. Compensation of the bull from paragraph 1 of this article shall be done according to the values of wildlife and objects presents in the list of prices, attached to this Administrative Instruction. Article 9 Managing responsibilities in hunting area Managers of hunting areas are obliged to do the management according to 10 years management plans, which should be compiled within 6 months from the day of signing the contract, as well as fulfill all the conditions and obligations which that come from Article 39 of Law on hunting. Article 10 Determination of lease initial price 1. the initial prize of lessee shall be determined in the value of 50% of wild animals presented in the act of hunting area establishment and the value of technical and existing accompany values; 2. The initial lease prize and eventual compensation of negative difference of wildlife and technical and accompany objects of hunting areas shall be accounted according to the list of market prices which is the component part of this administrative instruction.</p><p>Article 11 This administrative instruction will enter into force upon its signature day.
