<p>1</p><p>1 Degrees of Robbery and Attempted Robbery 2 3SECTION 1. Robbery in the first degree. 4 5(A) A person is guilty of robbery in the first degree if the person commits or attempts to 6commit a robbery and, when, in the course of the commission of the robbery or attempted 7robbery, or during immediate flight there from, he: 8 9 (1) Causes serious bodily injury to any person who is not a participant in the 10 robbery; or 11 12 (2) Is armed with or displays a deadly weapon. 13 14(B) Robbery in the first degree is a felony and, upon conviction, a person must be 15imprisoned for a mandatory minimum term of not less than ten years or more than thirty 16years, no part of which may be suspended or probation granted. A person convicted 17under this subsection is not eligible for parole until the person has served at least seven 18years of the sentence. 19 20SECTION 2. Robbery in the second degree. 21 22(A) A person is guilty of robbery in the second degree if the person commits or attempts 23to commit a robbery and when, in the course of the commission of the robbery or 24attempted robbery, or during immediate flight there from, he: 25 26 (1) Cause physical injury to any person who is not a participant in the crime; 27 or 28 29 (2) Is armed with, displays, or uses a representation of a deadly weapon or 30 any object which a person present during the commission of the robbery or 31 attempted robbery reasonably believes to be a deadly weapon. 32 33(B) Robbery in the second degree is a felony and, upon conviction, a person must be 34imprisoned not more than fifteen years. 35 36SECTION 3. Robbery in the third degree. 37</p><p>2 Page 1 of 2 3</p><p>38(A) A person is guilty of robbery in the third degree if the person commits or attempts to 39commit a felonious or unlawful taking of money, goods, or other personal property of any 40value from the person of another or in their presence by the use or threatened use of 41violence, intimidation, or fear. 42 43(B) Robbery in the third degree is a felony and, upon conviction, a person must be 44imprisoned not more than five years. 45 46 47</p><p>4 Page 2 of 2</p>
