STATE BOARD FOR EDUCATOR CERTIFICATION (SBEC) Terms for Official Record of Texas Educator Certificate Tx. Education Code, Sec. 21.053. PRESENTATION AND RECORDING OF CERTIFICATES. (a) A person who desires to teach in a public school shall present the person's certificate for filing with the employing district before the person's contract with the board of trustees of the district is binding. (b) An educator who does not hold a valid certificate may not be paid for teaching or work done before the effective date of issuance of a valid certificate. Tx Education Code, Sec. 21.003. CERTIFICATION REQUIRED. (a) A person may not be employed as a teacher, teacher intern or teacher trainee, librarian, educational aide, administrator, educational diagnostician, or school counselor by a school district unless the person holds an appropriate certificate or permit issued as provided by Subchapter B. Affect the Validity of Educator’s Cert.? EDUCATOR DISCIPLINARY ACTIONS Y/N A denied credential was not issued because the requestor was determined to be ineligible for certification, based on non-completion of requirements, or else was DENIED administratively denied pursuant to 19 Texas Administrative Code §249.12. Y A non-inscribed reprimand is a formal, unpublished censure that does not appear on NON INSCRIBED the face of the educator’s certificate. A reprimand does not affect the validity of an REPRIMAND educator’s certificate. N PERMANENTLY A revoked certificate has been rendered permanently invalid without the opportunity to REVOKED reapply for a new certificate. Y A probated suspension is a suspension that is not enforced as long as the conditions of probation are met. If a certificate holder violates any of the terms of probation, SBEC may revoke the probation and the suspension may become immediately effective. As PROBATED long as the probation is not revoked, a certificate is valid during the term of the SUSPENSION probation. N An inscribed reprimand is the Board’s formal, published censure appearing on the face of an educator's certificate. A reprimand does not affect the validity of an educator’s REPRIMAND certificate. N RESTRICTED A restricted certificate has limitations on its use that have been imposed by SBEC order. Y A revoked certificate has been rendered invalid as a result of disciplinary action by the REVOKED SBEC. Y A suspended certificate, as a result of disciplinary action by the SBEC, has been SUSPENDED rendered invalid for a specific period of time or until reinstated by the board. Y A voluntary surrender of a certificate occurs as a result of an educator’s voluntary VOLUNTARY relinquishment of a certificate, in lieu of disciplinary proceedings, and renders that SURRENDER certificate invalid/permanently invalid. Y OTHER CERTIFICATE TERMS A certificate was issued in error, and has been invalidated by a determination of the Texas Education CANCELED Agency staff or the board. The whole or part of any educator credential, license, or permit issued under the TEC, Ch. 21. Subchapter B. CERTIFICATE/VIRTUAL The official certificate is the record of the certificate as maintained on the Texas Education Agency’s website CERTIFICATE (virtual certificate). A cleared suspension is no longer an active suspension, and means that a certificate has been reinstated CLEAR and is once again valid. The date the decision or action taken by the SBEC or the Texas Education Agency staff becomes final under EFFECTIVE DATE the appropriate legal authority. An expired credential is no longer valid because it was issued for a specific term and the expiration date has passed. An expired certificate is not subject to renewal or revalidation and a new certificate must be EXPIRED issued. An inactive certificate does not currently entitle the certificate holder to work as a professional educator in Texas public schools. A certificate is placed on inactive status when one of the following conditions exist: 1) the holder’s standard certificate has not been renewed; 2) the certificate holder has not completed fingerprinting as required by the Texas Education Code §22.0831; or 3) the certificate holder has fees pending. Once an educator satisfies the condition or conditions that caused the certificate to be placed in INACTIVE inactive status, the certificate is returned to valid status. An invalid certificate is rendered void. It may not be used for employment as an educator in Texas public INVALID schools until it has been revalidated by successful completion of a required examination. NOTE: This individual is currently under review by the TEA Educator Investigations Division. This notation on an educator’s certificate means that an allegation of misconduct is currently being investigated by TEA NOTE: staff. A certificate with this notation remains valid because no formal determination has been made. A pending suspension is a suspension whose term has run; but which is still in effect because the educator PENDING has not taken the necessary steps to clear the suspension and reinstate the validity of a certificate. REINSTATEMENT The restoration of a suspended certificate to valid status by SBEC. A disciplinary action by the SBEC, including a restriction, reprimand, suspension, revocation of a certificate, SANCTION or surrender in lieu of disciplinary action. A valid certificate qualifies the holder for employment as an educator in Texas public schools, is not expired VALID or inactive, and is not subject to an active suspension, surrender, cancellation or revocation. .
