Ex-186/2009 - 2 - THE MIZORAM LAND SURVEY AND SETTLEMENT (OPERATION) RULES, 2009 In exercise of the powers conferred by Section 42 of the Mizoram Land Survey and Settlement (Operation) Act, 2003 the Governor ofMizoram is pleased to make the following rules, namely :- CHAPTER-I PRELIMINARY Short title, extent, and I. (I) These rules may be called the Mizoram (Land Survey and Settlement commencement (Operation) Rules, 2009. (2) They shall come into force from the date ofpublication inthe Mizoram Gazette. Definitions 2. In these Rules, unless the context otherwise requires :- (a) "Act" means the Mizoram (Land Survey and Settlement (Operation) Act, 2003 (Act No.4 of 2003); (b) "CadastralSurvey"meansthe determinationofthe locationofboundaries, area, value, ownership and tenancy ofthe land holdings, for entry in the land records for the purpose of land revenue; (c) "Competent authority" shall have the same meaning as assigned to it in the Act; (d) "Form" means any forms in Schedules II and IV or a translation thereofin Mizo language published under the authority ofthe State Government; (e) "Government" means the State Government ofMizoram; (f) "Last Settlement" with reference to any local area means the last general revision ofthe land revenue demand ofthat area carried out in accordance with the provisions ofthe Act or any other law for the time being in force; (g) "Land Records" means survey records, revenue records and the record-of-rights maintained under the provision of, or for the purpose of the Act; (h) "land holding" means a parcel ofland held by a holder; (i) "land holder" means a person lawfu Ily in possesssion oflands; (j) "Schedule" means any ofthe schedules ofthese rules, and (k) "Revenue Officer" means every officer ofany rank appointed fOL carrying on the land revenue administration or who discharges the function relatingto survey,settlement and preparation and maintenance ofland records; (I) "Section" means section ofthe Act. CHAPTER-II SURVEY, BOUNDARIES AND BOUNDARY MARKS Revenue Survey 3. (I) The State Government may, by notification in the Mizoram Gazette, devisions divide the State ofMizoram into one or more Revenue Survey divisions/ districts, and may similarly divide any division/ district into sub-divisions, circles and revenue villages and may alter the limits of, or abolish, any division!district, sub-division, circle or revenue village. - 3 - Ex-186/2009 (2) Alteration of,andaddition tothelimits ofanyrevenue village, amalga­ mation of two or more villages, or circles, may be effected, taking intoconsideration of the following factors,namely:- (a) population ofthevillageorvillages; (b) areaofthe villageor villages; (c) numberofvillages; (d) demand underlandrevenueinthe villageor villages;and (e) administrative convenience. (3) RevenueSurveydivisionsshallbeas prescribedin Schedule-I. Notification and 4. (1) Whenever the State Government decides under section 3 that a proclamation of cadastralsurveybe madeinany localarea or villagesor the revision Cadastral Survey of anyexisting surveyandsettlement or record-of-rights a notification to this effectshall be publishedinForm-I. (2) There-after but beforethe surveystartsinanyvillage, a proclamation inForm 2shall bemade inthatvillage andinthevillages contiguous thereto. Services of notices 5. (1) All noticesandcommunications requiredunderthese Rulesshall be madeinwriting. (2) NoticeinForm 3 shallbeissued inadvanceto the land-holder as well as occupier ofthe land, adjoining land-holders and the concerned Village Councilbythe Officer-in-charge ofthe surveyworksbefore it is started. Specification of 6. Survey marks shallordinarily beofstonesofdurablequality ofthefollowing survey marks descriptions anddimensions :- (1) Fieldstones- stonesof durablequalityof approximate dimension of 50cmx 15cm x 15cm witha cross markof I em deep cut on the top. (2) Traverse stones- stonesofdurablequalityofapproximate dimension of60 emx 18em 18emwitha plummetholeof5emdiameter drilled intostone or rock about 1em deep with triangleengravedaround it cut on the top. (3) Triangulation stone-stones ofdurable quality ofapproximate dimension of 70 cm x 20 cm x 20 em with a plummet hole of5 cm diameter drilled intothe stoneor rockabout 1em deep witha circleengraved around it cut on the top. Survey marks on rocks 7. When stones cannot be erected owing to the position ofa survey mark falling on a rock,the surveymark shall be engravedon the rock. Survey marks to be 8. The surveymarksmaintainable fromtimeto time bythe Department shall maintainable be at the places as follows :- (a) alltriangulation stations; and (b) all traversestations. Inspection ofsurvey 9. (1) Any surveyofficer shall be competentto inspectthe survey marks. marks (2) When a survey mark requires renovation or repair or replacement, the surveyofficershall issuenotice in Form4 to the concerned land­ holderor the party. The surveyOfficer-in-charge of surveyshall maintain a register in Form 5 Stations and Survey of all survey stations/points and survey marks, and ensure that they are marks properlymaintained and preserved. Survey of land on 11. When anyperson orpartyororganisation appliesforsurvey anddemarcation application or pointingout of parcelof landor baoundariesof land, it shall bedoneat theexpenseofthe applicanton an application to befilledfor this purpose in Form 6: Provide thatnosuchwrittenapplication shallbenecessary ifthe State Government directs surveyor re-survey of land under sub-section (I) of section 3. Special survey and 12. (1) When the topographical surveyor any other types of land surveys mapping other than the cadastral surveyor any fair mapping and printing is applied for, itshall be doneattheexpense oftheapplicant or indentor. (2) Estimate of costofsurvey, fair mapping andprintingshall beworked out taking intoconsiderationof the area, natureof terrain,thickness ofjungle to be cleared,scaleof survey, contour interval, timefactor, standard ofaccuracy required, man-power requirements, mode of transportand kindsofequipments and materials to be usedandother alliedfactors. (3) No surveyor work shall be undertaken ifthe applicant fail to make advance payment or tiII certificateof availabi lityoffund is subm itted and a formal agreementsigned by the indentor. Surveys fees 13. (1) 'When survey and demarcation ofany land have to be made under rule 11, surveyfee,(Urgentand normalapplication)as may befixed by the Government fromtime to time shall be deposited in advance bythe applicant. (2) If the applicant fails to deposit the survey fees in advance, the application shallbe summarily rejected. Issue ofnotice on 14. Ifthe amountisdeposited, an intimation ofsurveyin Form7 shallbe issued deposit offees to the applicantand to the contiguousland holders in respectofthe landto be surveyed. Refund of surveys fees 15. The survey fees so deposited may be refunded when the surveycould not be done due to unforseen reason. Stages of work in 16. When a notification has been published under rule 4, cadastral survey cadastral surveys operationshall beconductedinthe following stagesof work, namely :- (1) (a) identification ofvillage or town boundaries and limits of plots and their demarcation; and (b) provision of controlframe-work consistingof reconnaissance, actualtriangulation/ traverse,computations and preparation of controlplot sheet. (2) detail surveyconsistingof- (a) surveyof actualboundaries, plot limitsand otherdetails, (b) recordwritingor Khanapuri, and (c) Computation ofareas of holdings; - 5 - Ex-I 86/2009 (3) preparation offair copiesand reproduction of plans;and (4) settlementof civil cases. Accuracy of surveys 17. Theaccuracyaimedat incadastralsurveysinthat areasof plotsdetermined fromthe dimensions on the mapshould not be morethan 1%(one percent) inerror. Scale ofsurvey 18. (l) A choiceofscale willdependon the followingfactors, namely :­ (a) economicvalueofthe land; (b) sizeandshapeofindividual plots; (c) natureof crops and economic use ofland, and (d) the lowestfraction ofthe rupee to be reckoned in taxation. (2) A site plan/mapof individual shall be preparedon the scaleof 1:100 to 1:4,000. (3) The villagemapshallbe preparedon the scaleof 1:4,000or 1:5,000. Records to be prepared 19. For cadastralsurveyofan area, the followingrecordsshall be prepared by by Survey Officer in the surveyofficer beforecompletion of survey, namely- case ofcadastral survey (a) triangularchartand itscomputation; (b) triangular Field Book; (c) listofTriangulation Station; (d) traverse set-up and chart; (e) traverse FieldBook; (f) listof TraverseStation; (g) Control plot-sheet; (h) Field RegisterorArea Bookshowingthe nameand addressof the land holder, currentnumber, description and sub-division, the tenure and ownershipof the land; (i) recordofmeasurement ofField Measurement Bookplotted to scale showingmeasurement taken for each field or plot and sub-division; G) the originaldetail
