This MND has been prepared in accordance with CEQA, Public Resources Code Sections 21000 et seq., and the CEQA Guidelines found in Chap- ter 14 of the California Code of Regulations. An Initial Study is conducted by a lead agency to determine if a project may have a significant effect on the environment. In accordance with the CEQA Guidelines, Section 15064(a)(1), an envi- ronmental impact report (EIR) must be prepared if there is substantial evidence in light of the whole record that the proposed project under review may have a significant effect on the envi- ronment. A mitigated negative declaration may be prepared if the lead agency determines there is substantial evidence in the record that the project may have a significant effect on the envi- ronment but the lead agency determines that revisions in the project plans or proposals made by, or agreed to by, the applicant would avoid the effects or mitigate the effects to a point where clearly no significant effect on the environment would occur and there is no substantial evidence in light of the whole record before the public agency that the project, as revised, may have a sig- nificant effect on the environment (CEQA Guidelines, Section 15064(f)(2)). According to CEQA Guidelines Section 15070, a public agency shall prepare or have prepared a proposed negative declaration or mitigated negative declaration for a project subject to CEQA when: a) The Initial Study shows there is no substantial evidence, in light of the whole record before the agency, that the proposed project may have a significant effect on the environment, or b) The Initial Study identified potentially significant effects, but: (1) Revisions in the project plans or proposals
