Bianchi-Williamson File No.: S:\GIS-DATA\PRMD_BASE\Index Maps\Proposed City of Cotati Urban Boundaries Index.mxd AV Date: September 20, 2012 SE RO Resolution No. 575 Administration Drive Santa Rosa, CA 95403 March 6, 2013 Resolution of the Local Agency Formation Commission, of the County of Sonoma, State of California, Making Findings and Determinations, Exempting from the California Environmental Quality Act, and Approving a Sphere of Influence Amendment Designated as Amendment No. 1 to the City of Cotati Sphere of Influence RESOLVED, by the Local Agency Formation Commission of the County of Sonoma, State of California, that WHEREAS, Government Code Section 56425(g) requires the Commission to, as necessary, review and update each sphere of influence every five years; and WHEREAS, the Commission caused to be produced a map of the current sphere of influence of the City of Cotati (“the City”) (“sphere of the City”) and compared this map to the City of Cotati Urban Growth Boundary (“UGB”) and Sonoma County General Plan map designating an Urban Service Boundary (“USB”) for the City; and WHEREAS, the Commission wishes the sphere of the City to conform to its Sphere of Influence Policy – Cities by including within the sphere parcels that are within the City and by aligning the sphere with the City’s UGB and County USB, an action which would require amendment to the sphere of the City; and WHEREAS, notice of the public hearing on the Commission’s review of the sphere of the City and consideration of an amendment to the sphere of the City was provided, pursuant to the Cortese-Knox-Hertzberg Local Government Reorganization Act of 2000, Government Code, title 5, division 3, section 56000 et seq.(“the Cortese- Knox-Hertzberg Act”); and WHEREAS, the Executive Officer prepared a written report, including recommendations (“the Executive Officer’s Report”) on the sphere of the City and the proposed amendment and, upon completion, furnished copies to all persons entitled to copies, pursuant to the Cortese-Knox-Hertzberg Act; and WHEREAS, the Commission conducted a duly noticed public hearing on its review and consideration of the proposed amendment to the sphere of the City, on March 6, 2013, to hear and receive all relevant oral and written testimony and evidence presented or filed, and considered the Executive Officer’s Report and the amendment to the sphere of the City, at that time; and WHEREAS, all interested persons were given the opportunity to hear and be heard by the Commission; and WHEREAS, at the conclusion of public testimony, the Commission closed the public hearing, discussed the proposed amendment to the sphere of the City, and voted to approve the amendment to the sphere of influence, as set forth herein; and WHEREAS, section 56425(e) of the Cortese-Knox-Hertzberg Act requires the Commission to make a written statement of determinations with regard to the sphere of influence of a local agency, the Commission makes the following determinations: 1. The present and planned land uses in the area, including agricultural and open- space lands: The sphere of influence is being amended in three areas. Northwest (Helman Lane) The property is General Planned by the County for Rural Residential use. There are no agricultural uses in the territory. Southwest (Madrone Avenue) The property is General Planned by the County for Rural Residential and Residential Agricultural use. There are limited agricultural uses in the territory, such as the one dairy. The traditional greenhouse agricultural uses have been discontinued. In the long term, the territory will continue to be dominated with large lot estates and ranchettes. Southwest (West School Street at West Sierra) The territory is developed to the limits provided in the County General Plan and further development is not expected. 2. The present and probable need for public facilities and services in the area: Northwest (Helman Lane) The territory is served by individual wells and septic systems. There is no need to extend urban services and facilities to the territory. Southwest (Madrone Avenue) The territory is served by individual wells and septic systems. There is no need to extend urban services and facilities to the territory. Southwest (West School Street at West Sierra) The territory is served by individual wells and septic systems. There is no need to extend urban services and facilities to the territory. 3. The present capacity of public facilities and adequacy of public services that the agency provides or is authorized to provide: Item 6.1 Attachment 2 2 March 6, 2013 Northwest (Helman Lane) The County and the Rancho Adobe Fire Protection District will continue to provide services, such as police and fire, to the territory. There are concerns about the Rancho Adobe Fire Protection District’s ability to provide adequate service. There is no need to extend urban services and facilities to the territory. Southwest (Madrone Avenue) The County and the Rancho Adobe Fire Protection District will continue to provide services, such as police and fire, to the territory. There are concerns about the Rancho Adobe Fire Protection District’s ability to provide adequate service. There is no need to extend urban services and facilities to the territory. Southwest (West School Street at West Sierra) The territory is served by individual wells and septic systems. There is no need to extend urban services and facilities to the territory. 4. The existence of any social or economic communities of interest in the area if the commission determines that they are relevant to the agency. No social or economic communities of interest have been identified in the proposed sphere of influence or the amendment areas. The sphere of influence of the City is proposed to include all territory currently within the City’s boundaries, the City’s UGB and Sonoma County General Plan USB for the City, where possible. Pursuant to Commission policy, parcels within the City’s boundaries should be within their spheres of influence. WHEREAS, the amendment to the sphere of influence of the City is exempt from the California Environmental Quality Act (“CEQA”), pursuant to Section 15061(b)(3) of the State CEQA Guidelines, the general rule exemption that CEQA applies only to projects which have the potential for causing a significant effect on the environment.
