Austin Chairman, Committee on the Budget and Government Operations From: Rosemary Krimbel Commissioner Department of Business Affairs and Consumer Protection CC: Maria Guerra Mayor’s Office of Legislative Counsel and Government Affairs Date: Thursday, November 15, 2012 Re: Request for Information from Annual Appropriation Committee Hearing The attached information is in response to questions posed at our department’s hearing on Thursday, October 25th 2012 to discuss the 2013 budget. Alderman Reilly requested data comparing Cease and Desist orders issued for the 17 months when BACP physically participated in CPD’s night missions vs. the following 17 months when BACP’s collaboration with CPD did not include BACP staff being physically present. By providing CPD with access to licensing data and following up on police reports during normal daytime work hours, BACP has increased the number of Cease and Desist orders issued while eliminating the use of overtime and stopping the practice of inserting BACP investigators into dangerous situations for which they are not trained or equipped in the same manner that Police Officers are trained and equipped. Alderman Reilly asked for the number of citations issued, fines assessed and collected in relation to the Vacation Rental ordinance. The Department of Business Affairs and Consumer Protection has issued 137 citations YTD 2012 related to the vacation rental ordinance. A total of $55,350 in fines have been assessed. 31 of those citations were issued in the 42nd Ward. As always, please let me know if you have any further questions. The Department of Business Affairs and Consumer Protection conducted 271 inspections of valet parking operators between January 1, 2012 and September 30, 2012, resulting in the issuance of 341 citations. Alderman Reilly requested data on the number of citations issued, licenses revoked, fines assessed, and the number of repeat offenders by holders of the street performer license. In 2012, to date, BACP has not issued any enforcement against street performers, nor has it revoked any street performer’s license. BACP also is not aware of any citations written by other departments that would alert BACP to withhold issuance or revoke any current street performer’s license. To the extent that any street performer has received multiple citations, BACP would take appropriate action regarding such street performer’s license.
