Even official statistics indicate the removal of 400 houses from this quarter; they were leveled to the ground with many of their inhabitants buried under the debris. The wounded [individuals] from this quarter, who were [being treated] at Halabja Hospital, were executed for no reason. Their only guilt was [that] in 1987, they noticed that the overthrown regime had deported the villages surrounding the district of Halabja, and they were preoccupied by a legitimate fear that the city of Halabja would be the next target for deportation.” 1 – Excerpted from the pre-hearing presentation of the Halabja trial 0F Kani Ashqan is the name of a neighborhood in the Halabja district, which was systematically destroyed with explosives and construction equipment in the year preceding the main Halabja chemical attack, as part of the al-Anfal Campaign in the 1980s. The destruction of the Kani Ashqan quarter was in retaliation for the demonstrations protesting the deportation of neighboring villages. Included in this section are military documents, such as memos and lists of the wounded and killed civilians that were the victims of this deadly campaign. Court documents from the pre-hearing presentation of the Halabja trial are also included in this section, as well as one of the most important documents issued by Saddam Hussein himself— the notorious Decree Number 160 in which Hussein gives his cousin, Ali Hassan al-Majid, otherwise known as “Chemical Ali,” full authority in the northern Iraq region. 1 Item 12 In the Name of God, the Most Gracious, and Most Merciful In the Name of the People Revolution Command Council Decree no./160 Decree date: 3/29/1987 Decree In compliance with the provisions of Item (6) of Article Forty-Two, and Item (6) of Article Forty-Three of the Constitution, and in execution of what has been decided in the joint meeting of the Revolution Command Council and the Regional Command of the Arab Socialist Ba’ath Party held on 3/18/1987, the Revolution Command Council has decided in its session held on 3/29/1987 the following: First - The comrade Ali Hassan al-Majid, member of the Regional Command of the Arab Socialist Ba’ath Party, [has been chosen] to represent the Regional Command of the Arab Socialist Ba’ath Party and the Revolution Command Council in the execution of their policies in the entire northern region, including the autonomous region of Kurdistan, in order to protect law and order and ensure its stability, and apply the Autonomy Law in the region. Second - In order to achieve the objectives of the decree, the member of the Regional Command assumes the authority of binding orders to all state, civilian, military, and security services, and particularly the powers entrusted to the National Security Council and [the] Northern Affairs Committee. Third - The following entities of the entire northern region are under the authority of the comrade member of the Regional Command, and are committed to the decisions and directives issued by him, which are enforceable according to this decree. 1 - The Executive Council for the Autonomous Region of Kurdistan. 2 - The governors of the governorates and the heads of the administrative units that belong to the Ministry of Local Government. 2 3- The Intelligence, Internal Security Forces, and the Military Intelligence Services. 4- The Leadership of the People's Army. Fourth - The military leadership in the region is subject to the orders issued by the comrade member of the Regional Command, with all that is included in the (first [item]) of this decree. Fifth - The implementation [of] this decree shall take effect from the date of issuance until further notice, and legal provisions that contradict the provisions of this decree are invalid. Any crowd should be handled by police, security, and army agencies, and [a] curfew [should] be applied from now until further notice. Destroy any house from which shooting could originate by using tanks and bulldozers. To be kindly informed … with respect.
