Orthman Assistant General Counsel Dated: January 28, 2021 [1] Section 1 – Introduction Pursuant to Section IX of the Consent Decree lodged in federal court on August 23, 2012, the Boston Water and Sewer Commission (BWSC) hereby submits this Compliance Report. As agreed by the Parties, the Compliance Reporting Period was modified to run from July 1 to December 31 with a report due on February 1, with the next period running from January 1 to June 30 and the subsequent report due on August 1. Pursuant to the agreed modification, this Compliance Report covers all activities between July 1, 2020 and December 31, 2020. In accordance with approval of the BMP Recommendations Report on October 24, 2018, BWSC added a new BMP & GI/LID Summary Section 10 providing a narrative summary; as well as, Tables 18 and 19 summarizing BMP GI/LID actions taken by both public and private parties during the Compliance Reporting Period. During this Reporting Period, certain non-emergency operations of the Commission and non- Commission related activities within the City of Boston and Commonwealth of Massachusetts impacting the NPDES permit and Consent Decree were disrupted by the ongoing COVID-19 pandemic. These disruptions have forced some shutdowns of construction site activities, certain inspection activities, reduced staffing to staggered shifts and remote work by Commission employees, and temporarily impacted other contractor and consultant driven activities such as IDDE investigation/removal, CMOM activities, ongoing BMP studies and inspections, industrial facility inspections and other core functions. While the Commission has adhered to safety protocols and workplace guidance provided by the City of Boston, Commonwealth of Massachusetts, OSHA and CDC, certain functions are still interrupted as of the drafting of this report and reflected herein. As such, in accordance with the ongoing Phased Reopening in the Commonwealth and City of Boston, the Commission has resumed construction site inspections , IDDE investigations and removals, industrial facilities
