VICTOEIA. ANNO TERTIO EDWAEDI SEPTIMI REGIS. No. 1896. An Act for determining the Boundaries and Divisions of the Legislative Council Electoral Provinces and for other purposes. [2ith December, 1903.]' Xl/HEREAS by The Constitution Act; 1903 it is provided that Preamble. " * Victoria shall be divided into seventeen electoral provinces, the boundaries and divisions and name of each of which shall be such as may be determined by an Act of Parliament : Be it therefore enacted by the King's Most Excellent Majesty by and with the advice and consent of the Legislative Council and the Legislative Assembly of Victoria in this present Parliament assembled and by the authority of the same as follows (that is to say) :— 1. (1) This Act may be cited as the Electoral Prozinces Bonn- short title. daries Act 1903. (2) This Act and The Constitution Act Amendment Act 1890 and citation. any Acts amending the same may be cited together as The Constitution No-107B- Act Amendment Acts. 2. The boundaries and divisions and the names of the seventeen Boundaries and electoral provinces of Victoria shall be those set forth iu the etecSprovSces* Schedule to this Act. Such provinces and divisions of provinces are Schedule. hereinafter referred to as " new provinces " and "new divisions " re­ spectively. 3. (1) For [Is. 3d.] 635 12924. 3 EDVV. (1) For the purposes of preparing the first electoral rolls for registrars to each new electoral province, the electoral registrar for each division prepare lists. thereof shall on the passing of this Act make up a general list and also a list of ratepaying electors for such division, herein called u new lists." (2) The new lists shall respectively he made up from the general lists and the lists of ratepaying electors prepared or in course of pre­ paration at the passing of the Electoral Rolls Act 1903, herein called the " prepared lists." and shall include the names of all persons quali­ fied to become voters for the Legislative Council by virtue of the provisions of The Constitution Act liiOo. (#) The new list for each new division shall include the names of all persons upon the piepared list for any existing division which corresponds with or is included in any division of any new electoral province. (4) Where by the operation of this Act any existing division is apportioned into or amongst two or more new divisions there shall be included in the new list for each new division the names of all persons on the prepared lists whose qualifications are within the area of the new division. (5) The new lists prepared pursuant to this section shall be subject to the provisions of The Constitution Act Amendment Acts in like manner as if the same had been prepared under such provisions before the passing of the Electoral Rolls Act 1903 and shall also be subject to the operation of the various suspended provisions of the said first- mentioned Acts when resumed pursuant to the said last-mentioned Act. (6) Every holder of an elector's right whose name is in accord­ ance with this Act placed upon a list for a new division shall for all purposes be deemed to be the holder of an elector's right for such new division. In order to insure the early completion of all electoral rolls for and times by Onier ^iie 1]ew provinces and divisions the Governor in Council may by Order in Council tor fust i , J •> roils only. published in the Government Gazette make such alterations and exten­ sions of the dates and times prescribed in The Constitution Act Amendment Acts as may be specified in such Order ; but such altera­ tions and extensions shall take effect only with regard to the electoral rolls required for the purpose of the first elections for the said new electoral provinces, and not for any other purpose or on any other occasion. In elections for the Legislative Council, at every polling BameAbooUi'tx> ho Dootn where on any day a poll at a Legislative Assembly election is taken at same time, also being taken, the polling for the Council on such day shall (not­ withstanding anything to the contrary in section two hundred and thirty-nine of The Constitution Act Amendment Act 1890) commence and close at the same times respectively as the polling for the Assembly at such booth. In the following descriptions wherever tho boundary described runs along a river, creok, road, or street, tho centre of snch river, creek, road, or street shall he taken to bo tho boundary line; and whenever tho boundary is described as by a mountain range or watershed the line following the highest part of such rango or watershed shall bo taken to bo tho boundary. In cases where the boundaries described are those of a municipal district or portion of a municipal district, they shall bo taken to bo the boundaries in force at tho time of the passing of this Act. METROPOLITAN. EAST YARRA PROVINCE.} Commencing on the Koonung Koonung Creek where Middleborough-road abuts thereon; thence south by that road to the north boundary of allotment 21c, parish of Nunawading; thence west by the north boundaries of allotments 21c and 20A and Riversdale-road to Boun­ dary-road ; thence south by that road and Warrigal-road to Waverley-road ; thence east by Waverley-road to Box Hill-road; thence south by that road and the east boundaries of allot­ ments 5 and 10, section 1, parish of Mordialloc, to Centre-road; thence west by that road to Warrigal-road; thence north by that road to North-road; thence west by North-road to Bambra-road ; thence north by that road to the Rosstown llailway ; thence westerly by that railway to Kooyong-road; thence north by that road to Dandenong-road ; thence north­ westerly and west by Dandenong-road to Hornby-street; thence north by that street to High- street ; thence east by High-street to Bendigo-street; thence north by that street and Surrey- road to the Eastern Railway ; thence westerly by that railway to a point in line with the centre of Clara-street; thence north by a line and Clara-street to Toorak-road; thence east by Toorak-road to the east boundary of portion 9, parish of Prahran ; thence north by that boun­ dary to the Yarra River ; and thence easterly, northerly, and easterly by that river and the Koonung Koonung Creek to the commencing point. MELBOURNE PROVINCE. Commencing at the intersection of Elizabeth-street and Victoria-street; thence westerly by Victoria-street and the boundary of the city of Melbourne to the Saltwater River ; thence southerly by that river and the Yarra River to the Coode Canal; thence easterly by that canal and the Yarra River to Punt-road ; thence north by Punt-road and Hoddle-street to Victoria- parade ; thence west by Victoria-parade to Nicholson-street; thence north by that street to Park-street east; thence west by that street and Park-street west to the Moonee Ponds; thence southerly by the Moonee Ponds to Flemington-road ; and thence south-easterly by that road and Elizabeth-street to the commencing point. MELBOURNE EAST PROVINCE. Commencing on the Yarra River where Punt-road abuts thereon ; thence north by Punt- road and Hoddle-street to Victoria-parade ; thence west by Victoria-parade to Nicholson- street ; thence north by that street to Freeman-street; thence east by Freeman-street and a line in continuation thereof to Groom-street; thence southerly by that street to Queen's- parade ; thence north-easterly by Queen's-parade to Smith-street; thence south by Smith- street to Reilly-street; thence east by that street to the Merri Creek; and thence southerly and westerly by that creek and the Yarra River to the commencing point.
