Re: Reservation of Vacant FM Allotment Channel 295, Class C3, DA 03-2990 Attachment A-5, No. 172 Franklin, Louisiana Petition for Rulemaking to Amend the Table of Allotments On September 30,2003, the Federal Communications Commission opened a window to permit noncommercial educational (“NCE) reservation showings for certain vacant FM allotments Public Notice DA 03-2990. Pursuant to that Notice, American Family Association, Inc. (hereinafter “AFA”), hereby petitions that the vacant allotment for a Class C3 station on Channel 295 in Franklin, Louisiana, be reserved for NCE broadcasting. Upon grant of this reserved allotment, AFA will construct and license an NCE station that provides the requisite level of first and second NCE service, The Commission has determined that a vacant FM allotment shall be reserved for NCE broadcasting if the both of the following two conditions are satisfied: 1. Under-Served Pooulation. A significant population (at least 10 percent of the population within the proposed service area) would receive first or second NCE service if an NCE station was built with maximum class facilities at the proposed allotment site. Second Report and Order, 18 FCC 6691, 34, March 4,2003. 2. Technical Preclusion Showne. No reserved band frequency is available that could be used to cover the under-served population identified in Step One (testing from five different sites), Second Report and Order, 18 FCC 6691,TY 35, 36, March 4, 2003. AFA will show that the above referenced Allotment satisfies both of these prescribed conditions and therefore must be reserved for noncommercial broadcasting. A. A simificant population (63.88%) within the proposed service area would receive first or second NCE service from an NCE station built with maximum class facilities at the proposed allotment site. The map attached as Exhibit One was prepared by the AFA engineering staff using Probe software. Exhibit One shows that a station built with maximum class facilities at the proposed allotment site would cover a population of 103,643 within its city grade contour. Exhibit One also shows that 63 88% of that population would receive either first or second NCE service if the allotment were served by an NCE station. This allotment covers a population that is currently under served by NCE-FM broadcasting, however, the vacant allotment need not be reserved for NCE broadcasting unless no frequency is available on the reserved band that can service this population. B Complete Technical Preclusion Showing - Using five specified sites. no reserved band channel is available to provide NCE service to the significant under served population within the Droposed service area of the vacant allotment without causing prohibited interference to authorized FM stations. TV channel 6 stations, or foreign broadcast stations. The Channel Preclusion Studies attached as Exhibit Two show that no rule-compliant facility can he authorized at maximum antenna height above average terrain (“HAAT”) and with maximum effective radiated power (“ERP”) on any reserved band channel at any of four equally-spaced locations starting at zero degrees on a circle, centered in the proposed community of hcense and drawn with a radius one kilometer less than the distance to the predicted 60 dBu contour of a maximum strength same-class facility. The Channel Preclusion Study attached as Exhibit Three shows that no rule-compliant facility can be authorized at minimum antenna HAAT and with minimum ERP on any reserved band channel at the city center coordinates for the community of license. Therefore, having shown complete technical preclusion from providing NCE service on any reserved band to the identified significant under served population, AFA has presumptively established that the allotment should be reserved.
