At the February 13, 2018 meeting, several options were presented to the Board for consideration. After discussion, the Board accepted the parking ordinance recommended by Sheriff Tony Lippa to address concerns of the Belmont community. The first reading for the proposed amendment is March 13, 2018 with a public hearing scheduled for the March 27, 2018 meeting. Finchum, Director, Planning & Community Development AN ORDINANCE TO AMEND CHAPTER 108 OF THE CODE OF CAROLINE COUNTY BY ADDING ARTICLE VII, PROHIBITING THE PARKING OF COMMERCIAL VEHICLES ON CERTAIN STREETS. 1. That Chapter 108 of the Code of Caroline County shall be amended as follows: Article VII: Parking of Vehicles for Commercial Purposes 108.22. Prohibition of Parking motor vehicle, trailer or semitrailer for Commercial Purposes on Certain Residential Streets A. No person shall park any motor vehicle, trailer or semitrailer, as defined in Section 46.2-100 of the Code of Virginia, when used for commercial purposes, on the following streets: Belmont Boulevard (from the intersection of Gallant Fox Way to the intersection of Triple Crown Drive) Johnstown Lane Whirlaway Lane Gallant Fox Way Triple Crown Drive Citation Way Sir Barton Court Seattle Slew Lane Travers Street Affirmed Court. These provisions shall not apply to motor vehicle carriers when picking up or discharging passengers. B. It shall be the duty of the Caroline County Sheriff’s Office is authorized to cite any vehicle which is the subject of a violation under this article by attaching a citation to the vehicle. or by mailing the citation to the violator at the address shown for such violator on the records of the department of motor vehicles via first class mail. The citation shall state thereon the information necessary to establish the offense, fine, method of payment and consequences of nonpayment. 108.23 Collection and Payment of Parking Fines A. Except as otherwise provided by this article, the collection and payment of fines for parking citations shall be governed by the provisions of this section. B Violations of section 108-22 may be satisfied in full by the payment to the County Treasure of a fine in the amount of $___ within thirty (30) days of the date of the citation. The treasurer shall ensure that any violator permitted uncontested payment of the penalty provided in this section shall be informed of his rights and liabilities in the manner of payment, delinquency in payment, and contest of the citation. If a person elects to contest the citation such contest shall be certified in writing within 30 days on an appropriate form to the general district court of Caroline County. provided, that the person may have recourse to the Sheriff or his designee, prior to his court date. The Sheriff or his designee may void a citation upon a written finding that it was issued in error. C. The treasurer shall comply with Code of Virginia § 46.2-941, in connection with the collection of fines pursuant to this section and shall collect, in addition to any fines, the late fee prescribed in Table 58-161. D. If a violator fails to respond to a parking citation within the thirty-day period allowed under Subsection C of this section, the Treasurer shall cause a complaint, summons, or warrant to be issued for the delinquent citation. In the alternative, the Treasurer shall proceed to collect the delinquency using the means and methods available by law. 2. That this ordinance shall be effective upon the date of adoption.
