BE IT ENACTED BY THE PEOPLE OF THE TERRITORY OF GUAM: Section 1. Legislative intent. It is the finding of the Legislature that the primary purpose of Public Law 15-18 is to afford residents the opportunity to participate in agricultural leases. This program was implemented to revive, enhance, and generate agricultural activities for many of Guam's residents. It is the intent of the Legislature to remain consistent with Public Law 15-18, Section 2. Lease, The government of Guam is authorized to lease that government-owned real property in the municipality of Barrigada, described as Lot No. 5401 S. Adacao, containing an area of 133,050 square meters, to John L. G. Benavente, for agricultural purposes, for a term of 1 fifty (50) years, under the following conditions: The lease may not be assigned nor the property subleased; the property may not be used for other than agricultural purposes; no top soil nor betel palm, ifil, federico palm or flame tree may be removed; the rent shall be the property's fair market value, adjusted periodically; and violation of any of the terms of the lease shall terminate the same. Section 3. Approval. Notwithstanding any other provision of law, rule or regulation to the contrary, the lease as described in Section 2 of this Act is approved by the Legislature; except that no existing land use permitees occupying any portion of such property shall have their land use permits thereby terminated.
