APOLOGIES FOR ABSENCE Apologies for absence were submitted on behalf of Councillors Lisa Stone, Stephen Coen and John Merry, from officers Miranda Carruthers-Watt and Mike Taylor – University of Salford. 2. DECLARATIONS OF INTEREST There were no declarations of interest. 1 3. MINUTES OF PROCEEDINGS The minutes of the meeting held on 11th September 2018, were approved as a correct record. 4. HMO ARTICLE 4 DIRECTION Consideration was given to the joint report of the Lead Member for Planning and Sustainable Development and of the Lead Member for Housing and Neighbourhoods. Legislative changes which came into force in October 2010 which allow for a change of use from Use Class C3 (dwellinghouse) to Use Class C4 (small HMO) without the need for planning permission. However, local planning authorities may if they so wish declare an Article 4 Direction removing these permitted development rights. On 14 November 2017 the Statutory Deputy City Mayor in consultation with Cabinet agreed to the making of a non-immediate Article 4 Direction to remove permitted development rights allowing the change of use from a dwellinghouse (C3) to a small HMO (C4). This was made having regard to evidence for the justification of introducing the Direction and applies to land in Central Salford (the wards of Broughton, Claremont, Irwell Riverside, Kersal, Ordsall, Langworthy, and Weaste and Seedley) and the wards of Barton and Eccles. Should the Direction be approved it will automatically come into effect on 25 November 2018, and from this date planning permission will be required for the change of use from a Class C3 dwelling. Having regard to the evidence prepared by the City Council justifying the introduction of an Article 4 Direction, and given that that objections are not considered sufficient to warrant amending it, the City Mayor in consultation with his Cabinet were asked to re-affirm the agreement made in 2017 and formally approve the Article 4 Direction without amendment. There was a general consensus and welcoming of the Article 4 Direction by Members. Ben Dolan confirmed that the pending Ward Boundary changes does not impact on the designated areas. RESOLVED: THAT the City Mayor in consultation with Cabinet approved that the Article 4 Direction made on 22 November 2017 will come into force on 25 November 2018, therefore removing permitted development rights for the change of use from Use Class C3 dwellinghouses to Use Class C4 small Houses in Multiple Occupation in: Central Salford (the wards of Broughton, Claremont, Irwell Riverside, Kersal, Ordsall, Langworthy, and Weaste and Seedley); The wards of Barton and Eccles. 2 5. REVISED TERM OF REFERENCE FOR THE INTEGRATED ADULT HEALTH AND SOCIAL CARE COMMISSIONING JOINT COMMITTEE (ICJC) Gillian McLaughlan provided an overview of the report submitted; which covers the revised Terms of Reference (TOR) for the Integrated Adult Health and Social Care Commissioning Joint Committee. The TOR was redrafted to reflect the wider remit of ICJC, and also reflect changes to the elected City Mayor’s register of executive functions delegated to Lead Members. These were endorsed by the ICJC at its meeting in July 2018. The TOR was also approved by Clinical Commissioning Group Governing Body in July 2018. RESOLVED: THAT the City Mayor in consultation with Cabinet approved the revised Terms of Reference of the ICJC and noted the content of the report, including actions agreed and decisions made by the Integrated Adult Health and Social Care Commissioning Joint Committee (ICJC) in July 2018 6.
