Inquiries should be addressed to SDS Publications, Locked Bag 500, Coorparoo DC, Qld, 4151. _____________________________ BRISBANE Printed by Government Printer, Vulture Street, Woolloongabba 28 April 2008 [2195] Queensland Government Gazette Extraordinary PP 451207100087 PUBLISHED BY AUTHORITY ISSN 0155-9370 Vol. 347] Wednesday 30 April 2008 [No. 106 South East Queensland Water (Restructuring) Act 2007 TRANSFER NOTICE Amendment to certain transfer notices 1 Amendment Pursuant to section 67(1) of the South East Queensland Water (Restructuring) Act 2007 (Qld), I, Andrew Fraser, Treasurer, make the following amendments to each of the Transfer Notices with effect on and from the Effective Date: (a) omit paragraphs 2(a) and (b) of each Transfer Notice and insert: “(a) Pursuant to sections 67(1)(g) and (k) of the South East Queensland Water (Restructuring) Act 2007 (Qld), I, Andrew Fraser, Treasurer, provide that the Deed of Indemnity shall be taken to have been made and entered into between the Transferor and the State and the ISLA shall be taken to have been made and entered into between the Transferor and the Transferee, in each case, with effect on and from the Effective Date and will apply and be in force without the need for the Transferor, the Transferee and the State (as applicable) to sign those documents. (b) Pursuant to section 68 of the South East Queensland Water (Restructuring) Act 2007 (Qld), and without limiting paragraph 2(a) of this Transfer Notice, I, Andrew Fraser, Treasurer, direct and require that: (i) the Transferor perform its obligations under the Deed of Indemnity; and (ii) the Transferor and the Transferee perform their respective obligations under the ISLA.”; (b) in the definition of “Deed of Indemnity” in paragraph 4 of each Transfer Notice: (i) omit “between the Transferor and the Transferee” and insert “between the Transferor and the State”; and (ii) omit “inspection by the Transferor and the Transferee” and insert “inspection by the Transferor”; and (c) in paragraph 4 of each Transfer Notice insert the following definition: “State means the State of Queensland, through the Queensland Treasury Department.”. 2 Definitions In this Transfer Notice: Effective Date means the end of the day of 14 March 2008. Transfer Notices means each of the transfer notices made by me, Andrew Fraser, Treasurer, under the South East Queensland Water (Restructuring) Act (Qld) set out in schedule 1 of this Transfer Notice.
