MISSISSIPPI LEGISLATURE REGULAR SESSION 2020 By: Senator(s) McMahan To: Municipalities SENATE BILL NO. 2583 1 AN ACT TO AMEND SECTION 27-104-301, MISSISSIPPI CODE OF 1972, 2 TO CLARIFY THE USE OF FUNDS FROM THE 2018 TRANSPORTATION AND 3 INFRASTRUCTURE IMPROVEMENTS FUND MISSISSIPPI, TO ASSIST THE CITY 4 OF GUNTOWN IN PAYING COSTS ASSOCIATED WITH IMPROVEMENTS TO 5 MUNICIPAL STRUCTURES AT OR NEAR MAIN STREET; AND FOR RELATED 6 PURPOSES. 7 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI: 8 SECTION 1. Section 27-104-301, Mississippi Code of 1972, is 9 amended as follows: 10 27-104-301. (1) A special fund, to be designated the "2018 11 Transportation and Infrastructure Improvements Fund," is created 12 within the State Treasury, which shall consist of funds made 13 available by the Legislature in any manner and funds from any 14 other source designated for deposit into such fund. The fund 15 shall be maintained by the State Treasurer as a separate and 16 special fund, separate and apart from the General Fund of the 17 state. Unexpended amounts remaining in the fund at the end of a 18 fiscal year shall not lapse into the State General Fund, and any 19 interest earned or investment earnings on amounts in the fund 20 shall be deposited into such fund. No. 2583 *SS26/R873* ~ OFFICIAL ~ G1/2 20/SS26/R873 PAGE 1 (rdd\lr) 21 (2) Monies deposited into the fund shall be disbursed, in 22 the discretion of the Department of Finance and Administration, as 23 follows: 24 (a) To pay the costs incurred by the Mississippi 25 Transportation Commission and the Mississippi Department of 26 Transportation to widen Mississippi Highway 16 to three (3) lanes 27 as follows: 28 (i) From near the Neely Town Road at the DeKalb 29 City Limits to the point at which Old Philadelphia Road ties into 30 Mississippi Highway 16; and 31 (ii) Between the two (2) points at which 32 Mississippi Highway 39 ties into Mississippi 33 Highway 16.......................................... $2,000,000.00. 34 (b) To assist in paying the costs associated with 35 preconstruction, design, engineering, land acquisition, 36 right-of-way acquisition, construction and development of the 37 Reunion Parkway project from Bozeman Road to Parkway East in 38 Madison County, Mississippi......................... $8,000,000.00. 39 (c) To assist the East Metropolitan Corridor 40 Commission, which is a commission operating as a local public 41 agency representing the Jackson Municipal Airport Authority, the 42 City of Brandon, Mississippi, the City of Flowood, Mississippi, 43 and the City of Pearl, Mississippi, in paying the costs associated 44 with land acquisition and implementation of the East Metro 45 Corridor project in Rankin County, Mississippi, from its current S. No. 2583 *SS26/R873* ~ OFFICIAL ~ 20/SS26/R873 PAGE 2 (rdd\lr) 46 terminus at the southeast corner of, and within, the 47 Jackson-Medgar Wiley Evers International Airport, traversing 48 easterly and southerly and terminating at Interstate 20 at 49 Crossgates Boulevard in Brandon, Mississippi........ $8,000,000.00. 50 (d) To assist DeSoto County, Mississippi, in paying the 51 costs of rebuilding Holly Springs Road in DeSoto County and 52 drainage improvements to the road................... $3,000,000.00. 53 (e) To assist Carroll County, Mississippi, in paying 54 the costs of repair, renovation or replacement of two (2) closed 55 bridges on or near County Road 57 in 56 Carroll County...................................... $ 500,000.00. 57 (f) To assist Lamar County, Mississippi, in paying the 58 costs associated with necessary infrastructure improvements in 59 Beat 5 of Lamar County and/or construction of recreational 60 facilities in Beat 5................................ $ 500,000.00. 61 (g) To assist Lamar County, Mississippi, in paying the 62 costs of improvements to the intersection of Scruggs Road and 63 Mississippi Highway 589, including, but not limited to, the 64 relocation of portions of the road, the purchase of property 65 related to the relocation, signage, paving, other costs related to 66 improving the safety of the intersection and other road safety 67 projects in Supervisors District 5 of 68 Lamar County........................................ $1,500,000.00. No. 2583 *SS26/R873* ~ OFFICIAL ~ 20/SS26/R873 PAGE 3 (rdd\lr) 69 (h) To assist Bolivar County, Mississippi, in paying 70 the costs associated with preplanning and construction of a 71 Mississippi River landing dock facility and related 72 facilities in Bolivar County........................ $1,000,000.00. 73 (i) To assist Rankin County, Mississippi, in paying the 74 costs related to the extension of Gunter Road in 75 Rankin County....................................... $2,800,000.00. 76 (j) To assist the Pearl River Valley Water Supply 77 District in paying the costs associated with the repair, 78 rehabilitation, reconstruction or replacement of seawalls at the 79 Ross Barnett Reservoir as required by the settlement agreement in 80 the case of Bobby L. Baker, Jr., et al. v. Pearl River Valley 81 Water Supply District, in the Circuit Court of Rankin County, 82 Mississippi, Civil Action No. 212-133E.............. $4,000,000.00. 83 (k) To assist the City of Hattiesburg, Mississippi, in 84 paying the costs associated with resurfacing and other 85 improvements to Hardy Street in the City of Hattiesburg from its 86 intersection with U.S. Highway 49 East to its intersection with 87 West Pine Street in the City of Hattiesburg......... $ 400,000.00. 88 (l) To assist the City of Hattiesburg, Mississippi, in 89 paying the costs associated with resurfacing and other 90 improvements to 38th Avenue in the City of 91 Hattiesburg......................................... $ 100,000.00. 92 (m) To assist Hinds County, Mississippi, in paying the 93 costs of construction and development of the Byram-Clinton Parkway S. No. 2583 *SS26/R873* ~ OFFICIAL ~ 20/SS26/R873 PAGE 4 (rdd\lr) 94 project in Hinds County............................. $2,000,000.00. 95 (n) To assist the City of Senatobia, Mississippi, in 96 paying the costs associated with the following purposes, in the 97 following order: 98 (i) Construction and development of roundabout 99 projects and other improvements at the intersection of Main Street 100 and Scott Street and adjoining or related intersections in the 101 City of Senatobia; 102 (ii) Improvements at the intersection of Front 103 Street and Main Street in the City of Senatobia; and 104 (iii) Improvements at the intersection of Heard 105 Street and Main Street in the City of Senatobia..... $2,300,000.00. 106 Any such funds that are in excess of that needed to complete 107 the projects described in this paragraph shall be used to assist 108 the City of Senatobia in paying the costs associated with making 109 historically relevant infrastructure improvements in the city's 110 downtown historic district. In addition, the scope of work for 111 any projects described in this paragraph that are located in the 112 city's downtown historic district must be in keeping with the 113 character of the district. 114 (o) To assist in paying the costs associated with: 115 (i) Constructing, developing, extending and 116 implementing wastewater infrastructure and related facilities, 117 systems and infrastructure within and/or near Gateway Industrial 118 Park in Pike County, Mississippi; and S. No. 2583 *SS26/R873* ~ OFFICIAL ~ 20/SS26/R873 PAGE 5 (rdd\lr) 119 (ii) Constructing access roads and related 120 infrastructure within and/or near Gateway Industrial Park in 121 Pike County......................................... $3,000,000.00. 122 (p) To assist the City of Petal, Mississippi, in paying 123 the costs associated with (i) the repair, rehabilitation, 124 resurfacing, construction and reconstruction of Leeville Road/Main 125 Street located in Forrest County, Mississippi, in the City of 126 Petal from its intersection with the Evelyn Gandy Parkway 127 southerly to the boundary of the corporate limits of the City of 128 Petal; and (ii) the repair, rehabilitation, resurfacing, 129 construction and reconstruction of Smithville Road located in 130 Forrest County, Mississippi, in the City of Petal... $ 750,000.00. 131 (q) To assist the Town of West, Mississippi, in paying 132 the costs associated with repairs, resurfacing and making other 133 improvements to streets in the Town of West......... $ 500,000.00. 134 (r) To assist Oktibbeha County, Mississippi, in paying 135 the costs associated with the resurfacing and repaving of Longview 136 Road in Oktibbeha County............................ $ 750,000.00. 137 (s) To assist in paying the costs associated with the 138 completion of the four-lane of Mississippi Highway 19 South at the 139 south Philadelphia City boundary intersection at Holland Avenue 140 and extending south along Mississippi Highway 19 South to the 141 intersection of BIA Road 241 (also known as Tucker Road), 142 including, but not be limited to, all necessary acquisition, 143 preconstruction and construction activities......... $2,000,000.00.
