Question for written answer E-002545/2011 to the Commission Rule 117 Mariya Nedelcheva (PPE) Subject: Allegations of human organ-trafficking in Kosovo and Albania between 1999 and 2000 On 25 January 2011, the Council of Europe adopted a resolution, based on Dick Marty’s report of 16 December 2010, which alleges that members of the Kosovo Liberation Army (KLA) organised organ trafficking both during and after the conflict in Kosovo between 1999 and 2000. In the report, some KLA members, including Hashim Thaçi, are described as having directly participated in the kidnapping, inhuman treatment, murder and trafficking in the organs of Serbian detainees and other civilians in Kosovo and in Albania. The resolution insists on the fact that ‘this criminal activity, which developed with the benefit of the chaos prevailing in the region, at the initiative of certain KLA militia leaders linked to organised crime, may have continued, albeit in other forms, until today, as demonstrated by an investigation being carried out by the European Union Rule of Law Mission in Kosovo (EULEX) relating to the Medicus clinic in Pristina’. A few days ago, the press made public an unofficial report issued by the MINUK mission in 2003. The report confirms, on the basis of precise witness reports, the allegations presented by the Council of Europe Parliamentary Assembly in its Resolution 1782 (2011). This report is undeniable proof of the fact that the international organisations present in the region were already aware of these human rights breaches in 2003. In light of the above: 1. Was the EULEX mission in Kosovo aware of the report when it was published in 2003? 2. Has EULEX taken the report into consideration while conducting its investigation? 3.
