Energy Community Secretariat's SUMMARY REPORT on the final list of opted-out plants Following the adoption of Decisions 2013/05/MC-EnC on the implementation of Directive 2001/80/EC on the limitation of emissions of certain pollutants into the air from large combustion plants and 2015/07/MC-EnC on amending Decision 2013/05/MC-EnC to reflect the specific situation of Ukraine, the Ministerial Council considered the applications submitted by the operators of large combustion plants under Article 4(4) of the Directive. Decision 2016/19/MC-EnC of the Ministerial Council on authorising exemption of plants from compliance with the emission limit values set by Directive 2001/80/EC of the European Parliament and of the Council (hereinafter: “the Decision”) established the list of large combustion plants that can benefit from the opt-out implementation option. According to Article 1(1) of the Decision, the plants listed in Annex I may be exempted from compliance with the emission limit values referred to in Article 4(3) of Directive 2001/80/EC subject to the following conditions: (a) they submit each year to the competent authority a record of the used and unused time allowed for the plants' remaining operational life; (b) they are operated not more than 20 000 operating hours in the period starting on 1 January 2018 and ending no later than 31 December 2023. According to Articles 1(2) and 2 of the Decision, the plants listed in Annexes II to IV may be exempted from compliance with the emission limit values referred to in Article 4(3) of Directive 2001/80/EC subject to the following conditions: (a) they submit each year to the competent authority a record of the used and unused time allowed for the plants' remaining operational life; (b) they are operated not more than 40 000 operating hours in the period starting on 1 January 2018 and ending no later than 31 December 2033, (c) they undertake in a written declaration submitted by 31 December 2017 to the competent authority to comply with point (b).1 Since the list established by Decision 2016/19/MC-EnC includes all large combustion plants for which opt-out is a possibility (but not an obligation), the Secretariat investigated with the competent authorities of the Contracting Parties the plants that have started implementing the opt-out.2 Based on these exchanges, the plants for which the competent authorities of the relevant Contracting Parties have confirmed the start of the opt-out are marked in the below tables with yellow shading. 1 Point c) is a condition for plants included in Annex III only.
