Site Address: Firs Farm, Little Somerford, Chippenham, Wiltshire, SN15 5BJ On Behalf of: Mr R Greenhill I refer to your application for a determination as to whether the prior approval of the local planning authority will be required for this development. The local planning authority has determined in this case that its prior approval will be required as to the transport and highways impacts of the development / noise impacts of the development / contamination risks on the site / flooding risks on the site / whether the location or siting of the building makes it otherwise impractical or undesirable for the building to change from agricultural use to a use falling within Class C3 (dwellinghouses) of the Schedule to the Use Classes Order, and that this prior approval is refused for the following reason(s): 1. The application submission fails to demonstrate that the works required to the existing structures, are those reasonably necessary for the building to function as a dwellinghouse, which would be contrary to paragraph Q.(b) of Part 3, Class Q of the Town and Country Planning (General Permitted Development) (England) Order 2015 (as amended). The works required are so substantial that the proposed development would result in the rebuild rather than conversion of the existing structure, which goes beyond the scope of the operations permitted by of Schedule 2, Part 3, Class Q of the Town and Country Planning (General Permitted Development) (England) Order 2015 (as amended) 2. The siting of the building, in close proximity to a continuing agricultural buildings and uses including buildings use for the keeping of livestock, would give rise to an unacceptable level of noise, smells and disturbance that would significantly harm the amenity of future occupiers of the proposed dwellings contrary to Core Policy 57 (vii) of the Wiltshire Core Strategy and Q.2 (1)(e) Schedule 2, Part 3, Class Q of the Town and Country Planning (General Permitted Development) (England) Order 2015 (as amended). 3.
