GOVERNING BOARD MEETING MINUTES – March 25, 2020
Under the guidelines issued by Arizona Governor Doug Ducey, the Tempe Union High School District Benedict Education Center Governing Board Room was closed to the public to protect against the spread of COVID-19. This meeting was streamed live on Facebook.
A. Meeting Opening Call to Order Ms. Hodge called the meeting to order at 4:04 PM.
Roll Call Board Members present via teleconference: Berdetta Hodge (President), Brian Garcia (Vice President), Andres Barraza, Michelle Helm, and Sandy Lowe. Absent: None.
Adoption of the Agenda On motion of Ms. Hodge, seconded by Mr. Garcia and passed 5-0 (Ms. Hodge: aye; Mr. Garcia: aye; Mr. Barraza: aye; Mrs. Helm: aye; Mrs. Lowe: aye), the Governing Board approved the meeting agenda.
Welcome—Ms. Hodge welcomed everyone.
Pledge of Allegiance/Moment of Silence—Dr. Mendivil led the Pledge of Allegiance. Ms. Hodge asked the audience for a moment of silence.
B. Report from Superintendent B-1—School Closure Update Dr. Mendivil said he is proud of the work all employees are doing during this time. He commended Julie Peterson, Food and Nutrition Director, and her team. To date, they have served 3,924 meals to families in need. Meal services will continue as long as necessary. Nearly 1,500 laptops have been distributed to students; additional laptops will be distributed tomorrow. Currently, student learning is focused on review and enrichment. Teaching & Learning is planning long-term online learning opportunities that will be meaningful to students.
C. Communications C-1—Governing Board Members Mrs. Lowe hopes all Board members are doing well, she misses them and looks forward to talking with them in person; thanked Dr. Mendivil, the Executive Team, site administrators, teachers and support staff for making sure we’re providing learning for students; wants students to know she misses going to the academic, fine arts, and athletic activities that take place during the spring; wished everyone the best. Mr. Barraza hopes everyone is doing well; agreed with Mrs. Lowe’s comments; thanked everyone involved in the laptop distribution, it was efficient and well-coordinated; reminded everyone to stay safe and wash their hands. Mrs. Helm asked if parents and students will receive progress reports or letter grades during this period. Dr. Mendivil said lessons may not be graded but we may create a rubric to measure student progress. Mrs. Hilgers said Teaching & Learning is working to ensure all students, including students without access to technology, receive instruction and feedback on their progress. Teaching & Learning will need to follow ADE’s direction as well. Mrs. Helm misses the other Board members, wished everyone good health and asked all to continue with social distancing; thanked Dr. Mendivil for pulling the meal fee item from the agenda—the longer we can keep our prices down, the better it will be for the community. Mr. Garcia misses Board members and hopes everyone is doing well and staying healthy; thanked Dr. Mendivil and district administration for the proactive leadership in providing laptops to students; thanked
Governing Board Meeting Page 1 of 30 March 25, 2020 the individuals and organizations in Consent Agenda Item D-4 for their donations in support of students and programs; wants everyone to continue to practice social distancing, wash hands and stay safe. Ms. Hodge agreed with other Board members’ comments on the district’s efforts to keep everyone safe; went to all laptop distribution sites on Saturday and thanked incoming Tempe High principal Brian Guliford for being there talking to students and families; she, Mrs. Lowe, Mr. Barraza and Dr. Mendivil attended Seussical the Musical; wished Marcos senior Brock Drew good luck; congratulated Desert Vista coach Gino Crump for being named 6A Basketball Coach of the Year and a Desert Vista senior for being named 6A Player of the Year; Corona and Desert Vista placed first and sixth place in most dominant boys basketball programs of the last ten years.

D-6—Acceptance of Grant Award from Salt River Project “Touchdown for Teachers” Program and the Arizona Cardinals The Governing Board accepted the grant award to Mountain Pointe in the amount of $500 from Salt River Project “Touchdown for Teachers” program and the Arizona Cardinals.
D-7—GPPCS Contract #19-003-5, Occupational Therapist (STARS) The Governing Board approved the purchase on GPPCS contract #19-003-5 to STARS for an occupational therapist in an amount not to exceed $105,000.00.
E. Board Policies E-1—Policy BEDH – Public Participation at Governing Board Meetings (First Reading and Adoption) Dr. Mendivil said Mr. Ellel’s recommended changes are based on the Board’s discussion in its March 4th Study Session regarding time limits on public comment. Dr. Mendivil recommended adding a sentence that establishes potential consequences if an individual addressing the Board makes continued personal attacks on Board members, staff or others. Board members agreed with the additional language. Mrs. Helm thanked Dr. Mendivil for strengthening the policy; this was a concern she had raised with him. Mr. Barraza said the time limits for public comments are reasonable and make sense.
On motion of Ms. Hodge, seconded by Mr. Garcia and passed 5-0 (Ms. Hodge: aye; Mr. Garcia: aye; Mr. Barraza: aye; Mrs. Helm: aye; Mrs. Lowe: aye), the Governing Board approved Policy BEDH, Public Participation at Governing Board Meetings, with the additional sentence in Section E as presented by the Superintendent.
E-2—Policy JICA – Student Dress (First Reading and Adoption) Dr. Mendivil and Mr. McDonald said students, parents, certified staff and classified staff were on the committee; students provided much needed insight to teachers and administrators during this process. The language will be added to policy IKFB, Graduation. Mrs. Lowe thanked Mr. McDonald, the students and staff for their work; policies like this should be reviewed periodically to reflect the times; she supports the stakeholder group and will vote for the policy. Mrs. Helm asked why we are removing the statement “Student dress shall not prevent students from achieving their educational objectives.” Mr. McDonald said the committee agreed with ASBA’s recommendation to remove this sentence; the committee wants to add it to the regulation. Mrs. Helm thanked those who talked with committee members for sharing the information they learned. Mr. Garcia thanked Dr. Mendivil, Mr. McDonald and the committee for their work, especially for including language regarding religious and cultural messages and symbols. Ms. Hodge talked to members of the committee, including students; they felt they were heard and they contributed to the process; students are comfortable with the result; thanked Mr. McDonald and everyone on the committee. Mr. Barraza thanked the district for ensuring cultural and religious sensitivities are respected and addressed; thanked the students.
On motion of Ms. Hodge, seconded by Mr. Garcia and passed 5-0 (Ms. Hodge: aye; Mr. Garcia: aye; Mr. Barraza: aye; Mrs. Helm: aye; Mrs. Lowe: aye), the Governing Board approved Policy JICA, Student Dress, as presented.
F. Business Services F-1—Renewal of Contracts for Self-Funded Medical Claims Administration, Pharmacy Benefit Management Services, and Health Multi-Line Plans for the 2020-21 Fiscal Year. Dr. Mendivil said the increase in insurance premiums for next fiscal year will cost approximately $640,000. Because of the COVID-19 pandemic and school closure, administration is unable to have in-person discussion with employee groups to discuss the possibility of employees making a nominal contribution toward their insurance coverage. Dr. Mendivil said he recommends the district absorb the entire increase for fiscal year 2020-
Governing Board Meeting Page 28 of 30 March 25, 2020 2021 using one-time funding so there is no financial impact to employees. He will ask the consultant to present information at a Study Session this fall so that employees have a better understanding of the cost of healthcare. Mrs. Meulemans said the Employee Benefit Trust board has been informed of Dr. Mendivil’s recommendation. She believes they will understand our position based on current circumstances. Mrs. Lowe said it’s good to do this considering what we’re going through; looks forward to having our consultant present information about what’s happening to healthcare and how we may have to take some action next year; thanked Dr. Mendivil, Mrs. Meulemans and the committee for their work. Mr. Barraza said in the fall we’ll have more information and be back on track. Mrs. Helm said administrators are to be complimented for recommending the district absorb the increase; hopes employees and the community are informed about this recommendation. Mr. Garcia said this recommendation helps teachers and staff and shows the district is looking out for them. Ms. Hodge thanked the Employee Benefit Trust committee and Mrs. Meulemans; thanked Mrs. Lowe for her work on the committee.
On motion of Ms. Hodge, seconded by Mr. Garcia and passed 5-0 (Ms. Hodge: aye; Mr. Garcia: aye; Mr. Barraza: aye; Mrs. Helm: aye; Mrs. Lowe: aye), the Governing Board approved contract renewals for self- funded medical claims administration, pharmacy benefit management services, and health multi-line plans for the 2020-2021 fiscal year as itemized.
F-2—Approval of Letter Agreement with Local Initiatives Support Corporation (LISC) for the NFL Field Grant Award at Tempe High School Dr. Mendivil said this grant will be used to help offset the cost of installing artificial turf at Tempe High School. Some Governing Board questions/comments: Mrs. Lowe said she is grateful we’re moving forward with this; it will be good for all students; thanked the Cardinals and the NFL Foundation. Mr. Barraza said the field can be used year round, it won’t be restricted to certain activities, and water usage will be reduced; he asked if we can meet the deadline for the start of the 2020-2021 school year. Mr. McDonald said in order to meet the goal, Tempe and Desert Vista won’t have a home football game until week three. Mrs. Helm said she hasn’t received information about the full cost for construction or the cost for upkeep and field replacement and is uncomfortable voting without knowing the total cost; asked if this was the best use of the proceeds from the Ahwatukee land; said it would be unfair not to do this at every school if this item is approved for Tempe High School. Mr. Garcia said he has worked with LISC before; LISC invests in communities, especially those with different needs; he thanked LISC and the NFL Foundation for their contribution. Ms. Hodge said she has talked to site administrators and student groups about this; said this is a great opportunity to move the district into the future.
Dr. Mendivil said that as he gets more information, he will share that with Board members and the public.
On motion of Ms. Hodge, seconded by Mr. Garcia and passed 4-1 (Ms. Hodge: aye; Mr. Garcia: aye; Mr. Barraza: aye; Mrs. Lowe: aye; Mrs. Helm: opposed), the Governing Board approved the letter agreement with LISC to accept grant funding the amount of $250,000 provided by the Arizona Cardinals and National Football League Foundation.
G. New Business G-1—Tempe Union High School District – Resolution to Close Schools Dr. Mendivil said this resolution allows us to continue pay employees who, through no fault of their own, are unable to do their normal duties; all employees are considered to be on-call. Mr. Ellel said the resolution was initiated by Arizona school attorneys and came about before districts received clear guidance on school closures. It was intended to give the district and the superintendent the flexibility to adapt to the changing environment. Mrs. Lowe thanked the district for its leadership. Mr. Barraza thanked the Executive Team, teachers, and staff for taking the lead in this.

Mr. Garcia thanked State Superintendent of Public Instruction Kathy Hoffman and US Senator Kirsten Sinema for their leadership; thanked the district for working to provide quality education for students. Ms. Hodge thanked all staff for their work.

Mrs. Lowe thanked administration for its work. Mr. Barraza reminded everyone to wash their hands and said anyone with questions should contact the superintendent. Mrs. Helm said the district has done a wonderful job putting information on the website. She reminded everyone to practice social distancing. Mr. Garcia asked everyone to practice social distancing, wash their hands, and stay safe. Ms. Hodge asked everyone to stay safe.
