19. As piped sewer and water services are extended to the Middlechurch settlement centre, the Red River Planning District and West St. Paul Council will consider the cumulative supply of all new development proposals in an effort to manage growth pressures and corresponding infrastructure and servicing obligations.

20. Proponents of large-scale development proposals (generally those involving fifteen (15) residential lots / units or more) within the MIddlechurch settlement centre shall be required to provide:

1. A supply and demand study to provide justification for increasing the supply of residential lots / units within the Settlement Centre; and 2. Confirmation from a qualified engineer that municipal sewer and water services have sufficient capacity to accommodate the development proposal.

21. To ensure new development within Middlechurch is orderly, fiscally-sustainable and does not result in the premature development or expansion of municipal infrastructure or servicing. Council may utilize development agreements to phase large-scale development proposals.

Taxes on the land to be subdivided for the current year plus any arrears have been paid or arrangements satisfactory to Council have been made; b. Any applicable development fees have been paid.

2. Manitoba Land Surveyor prepares a 3-lot plan of subdivision as proposed include lot area and width calculations, and public reserve dedication along waterfront if required.

3. Applicant / owner enters into a Development Agreement with the municipality to address items such as, but not limited to: a. dedication of public reserve; b. overland drainage; c. construction standards and phasing for public roads, as well as the requirement for any temporary turn arounds, if required; d. holding tank placement and commitment to connect to municipal sewer and water, if and when available; e. traffic signage, if necessary; f. provision that future buyers must sign off they will be adjacent ot a cattle farm; g. provision restricting any development on proposed lot 3; h. and any other item Council deems necessary.

All expenses relating to the preparation of the development agreement shall be borne by the applicant, including the administration fee and service deposit requirements as per R.M. of St. Andrews By-Law no. 4165.

4. Applicant / owner provides a digital copy (AutoCad) of the survey plan of subdivision to the R.M., if required. Contact Chad Therein at (204) 996-1104 or [email protected] with questions or for clarification.

5. Applicant / owner obtains variance approval, if required.

6. Submission of an engineered drainage plan approved by Manitoba Conservation, if required (Water Control Works).

7. Applicant / owner obtains: a. joint easement agreement for existing and / or further Hydro and Centra Gas facilities associated with the subdivision; b. plan of easement prepared by a Manitoba Land Surveyor as required by The Real Property Act.

8. Establishment of adequate flood protection measures and levels as approved by the applicable government agencies, if required.

9. Applicant / owner to provide drainage / grading plan in digital form (final in AutoCAD) for review and approval by the R.M. of St. Andrews.

10. The Land Titles Office has indicated it will require a 3-lot plan of subdivision drawn by a Manitoba Land Surveyor. Therefore, the applicant / owner must submit to this office the surveyor’s final plan and two Mylar copies approved by Land Titles (together with three paper prints). If you have concerns with these requirements, please contact the District Registrar in the Winnipeg Land Titles Office.

RED RIVER PLANNING DISTRICT

BY-LAW NO. 245 / 2016

BEING a By-law of the Red River Planning District Board to amend the Selkirk and District Planning Area Development Plan By-law No. 190-08, as amended;

WHEREAS Section 56 of The Planning Act provides that a Development Plan By-law may be amended in accordance with the Act;

NOW THEREFORE the Board of the Red River Planning District, in a meeting duly assembled, enacts as follows:

1. That “Part 5 – Land Use Designations,” “Agriculture Restricted (AR), B. Policies” be amended by replacing existing Policies 1 to 13 with the following, and re-numbering the “Livestock Operation Policies” and “Industrial and Commercial Policies” accordingly:

“General Policies

1. In addition to the policies described in Part III and IV, the following policies are established:

a) Agricultural activities in Agriculture Restricted areas shall be limited to a restricted range of farming activities and residential activities as further defined in the applicable municipal Zoning By-laws.

b) Land uses which would interfere with agricultural production or which would have an inflationary effect on land values shall be avoided.

c) Land uses that may have a detrimental effect on the local environment or adjacent development shall be treated as Conditional Uses in municipal zoning by-laws to minimize land use conflicts and to prevent pollution of the natural environment.

d) Where an area of Agriculture Restricted development is bordered on one side by a major transportation corridor or facility such as a highway or rail line, new development shall be directed to the same side of a corridor to maintain safety conditions by eliminating unnecessary cross-corridor movements.

Subdivision Policies

2. General Subdivision The subdivision of lots, generally 4 acres in size, may be permitted in the AR Agriculture Restricted Area designation for the following uses, subject to compliance with “Lot Design Criteria”:

a) Farm and non-farm residential development; b) Agricultural activities excluding livestock operations exceeding – au in size, and including hobby farms and small-scale agricultural operations such as market gardening, tree nurseries, berry farms and similar may be permitted and gate sales may be permitted subject to conditional use approval; and c) Neighbourhood-scale institutional, commercial or industrial development subject to conditional use approval.

3. Infill – South St. Clements Area In recognition of the existing historic small-scale residential subdivision and development pattern, much of which was established prior to The Planning Act in the South St. Clements Area, defined as that area located between Henderson Highway and the Red River Floodway, the subdivision of smaller “infill” residential lots may be permitted along Hay Road, Wallie Road, Church Road, Ludwick Road, Donald Road, Dunning Road, McKay Road, Shalom Path and Coronation Road, and; as well as

Page 18 of 56 Rebeck Road and Raleigh Road in cases of dual frontage, subject to compliance with “Lot Design Criteria” and the following:

a) Proposed lots must be of sufficient size to accommodate on-site sewage disposal systems to the satisfaction of that department having jurisdiction, and shall be located and designed in a manner that would facilitate efficient future provision of municipal sewer and/or water servicing. b) Proposed lots may be located between or as an extension of an existing grouping of 4 or more non-farm residential lots, where each lot is separated from each other by no more than 100 metres (328 ft) on the same side of the developed public roads listed above. c) Proposed lot configuration should not impede or lessen potential for conservation subdivision design and development. d) Proposed lots must accommodate extension of roads per adopted concept plans or Secondary Plans.

4. Conservation Subdivision – South St. Clements Area The subdivision of residential lots less than 4 acres in size may be permitted within the South St. Clements Area as defined herein, subject to compliance with the following conservation subdivision criteria:

a) The “development area” should be comprised of at least 20 generally contiguous acres. b) Development density shall generally be a maximum of 1 lot per 2 acres of gross “development area.” c) The conservation subdivision design must: (i) Must provide public road access from Hay Road, Wallie Road, Church Road, Ludwick Road, Donald Road, Dunning Road, McKay Road, Shalom Path or Coronation Road, and only if no other option is available, from Rebeck Road or Raleigh Road. (ii) Designate a minimum of 60 % of the gross “development area” as Open Space, and that will be protected from development through conservation agreements, dedication to the Land Conservancy or similar organization, dedication as public reserve or similar means deemed acceptable to Council. (iii) Protect and preserve heritage and archaeological features of considered federal, provincial or local value, and may integrate said sites into the design as appropriate. d) Protect and preserve natural features such as creeks, substantial mature tree stands, and may integrate said sites into the design as appropriate. e) The “development area” will be re-zoned to “Conservation Subdivision” with land uses and bulk regulations as defined within the Zoning By-law.

5. Lot Design Criteria All lots, notwithstanding Conservation Subdivision, shall be located and designed subject to compliance with the following criteria:

a) Proposed lots shall accommodate on-site sewage disposal systems to the satisfaction of the provincial department having jurisdiction, and shall facilitate efficient provision of future municipal sewer and/or water servicing. b) Where municipal water is not available, all lots shall have sufficient supply of potable water. c) All lots shall have frontage or legal access onto a developed all-weather public road. d) All lots shall be located and designed so as to facilitate efficient and economical municipal service provision such as road maintenance, emergency and protective service provision, school busing, as well as future extension of municipal sewer and water services. e) Lots shall not be subject to flooding or other natural hazards such as erosion, unless flood proofing may be provided to the satisfaction of the provincial department having jurisdiction.”

2. That the Table of Contents page numbering be adjusted as required.

b) Pt. OTM Lots 269 to 288, Parish of St. Andrews from “AR” Agriculture Restricted Area to “GD” General Development Area,

1.0 ISSUE:

2.0 BACKGROUND:

Within the south St. Clements area (bounded between Henderson Highway and the Red River Floodway), much of the land is designated and zoned as “Agriculture Restricted” (AR), which requires that new lots be 4 acres in size. However, also within this area is a pre-existing development pattern consisting of smaller residential lots. Much of this development was established prior to The Planning Act.

3.0 RECOMMENDATION:

At this time our office recommends that First Reading be given to the proposed By-law, allowing the application to continue with further research and analysis, and triggering the Public Hearing process.

Page 26 of 56 Options: Under Section 125(1) of The Planning Act, 'where the council of a municipality receives an application pursuant to Section 124(2), it shall, after considering the application, by resolution

(a) reject or refuse to approve the application for subdivision; or

(b) approve the application for subdivision, without conditions or with conditions as set out in Section 135.

Recommendations:

Section 123 of The Planning Act outlines the criteria for subdivision approval which is as follows:

Restriction of approvals 123 A subdivision of land must not be approved unless

(a) the land that is proposed to be subdivided is suitable for the purpose for which the subdivision is intended; and

(b) the proposed subdivision conforms with (i) the development plan by-law and zoning by-law; (ii) any secondary plan by-law, and (iii) the regulations under section 146.

The subject subdivision proposal is consistent with the policies outlined in both the Development Plan and Secondary Plan. Note: some conditions of approval will be required to ensure that the new lots remain consistent with the Development Plan and Secondary Plan. In addition, a variance approval is required for lot width, in order to conform to the Zoning By-law, and a minor alignment adjustment to the new lot line would bring the lot size into conformance. It should be noted that there is not enough existing frontage to meet the lot width requirements.

Because the proposal adheres to the Development Plan and Secondary Plan, and can adhere to the Zoning By-law with a variance approval, it meets the criteria for approval and therefore the RRPD recommends that the subdivision be approved with conditions.

Conditions: If Council wishes to approve this application our office recommends that the following conditions be attached:
