Additional fees and account terms are described in the Credit Card Agreement (the “Agreement”) that will be enclosed with the card if a card is issued. The terms disclosed below and in the Agreement are not guaranteed for any period of time; all terms may change at any time before or after the account is opened, in accordance with the Agreement and applicable law. TD Bank, N.A. (“we,” “us,” “our,” and “TD Bank”) may change terms and add new terms and fees at any time, based on information in your credit report, market conditions, our business strategies, or for any other reason. If you are approved for a TD Simply FlexibleSM VISA® card you may receive a minimum credit line of $1,000 or a higher credit line, based on our evaluation of your credit and other factors.

We may limit the number and types of credit card accounts from which we will allow Balance Transfers, and the times, manner, and circumstances in which Balance Transfers may be requested. The Penalty APR will apply to all new and outstanding balances, until the start of the first monthly billing period after all events of default under the Agreement have been cured, no new events of default have occurred, and after we have received at least one (1) monthly payment by no later than 5:00 p.m. Eastern Time on the payment due date, together with the payment portion of the monthly billing statement. Provided nothing else occurs to cause the Penalty APR to continue, the Penalty APR will then end and the standard (non-introductory) APRs will apply.

2 The Introductory APR is effective upon the initial opening of your Account and the initial issuance of a Card to you. The Introductory APR does not apply to Cash Advances. The Promotional Period does not recommence if we issue a substitute, replacement or renewal Card to you (even if the Account type and/or Account number for the substitute, replacement or renewal Card changes). When a Promotional Period ends, the standard (non- introductory) APRs for your Account will apply to new and outstanding balances, unless a Minimum Payment is late or another event occurs to cause the Penalty APR to apply.

If your account has balances with different APRs, payments are usually applied to Finance Charges and other fees, and to balances with the lowest APRs, before being applied to balances with higher APRs. This means that balances with higher APRs are not reduced until balances with lower APRs have been paid off.

3 Cash Advances obtained from a financial institution, an , or any other party that agrees to honor the credit card for cash advance purposes, and all Convenience Checks (including Convenience Checks used to transfer balances), and all Cash Equivalents posted to your account are considered Cash Advances. Cash Equivalents include the purchase of money orders, foreign currency, travelers checks, wire and other funds transfers, bets, lottery tickets, casino gaming chips, fines, bail bonds, and similar financial transactions and instruments.

■ The grace period (number of days from the end of a monthly billing period to the Payment Due Date) may vary from month to month, but will be at least 21 days. No periodic rate of finance charge will be imposed on new purchases posted to the account during a monthly billing period if both (a) the account balance at the end of that period is paid in full by the Payment Due Date, and (b) the account balance at the beginning of that period was zero (or a credit balance) or was paid in full by the Payment Due Date for the previous period.

^ If the total Finance Charges accrued for a monthly billing period (including transaction fees) are less than $0.50, the FINANCE CHARGE for that billing period will be $0.50.

∆ Account transactions (including Purchases and Cash Advances) made in a foreign currency will be converted to U.S. Dollars by or on behalf of Visa U.S.A. Inc. (or any of its affiliates) using its currency conversion procedures and charges then in effect, as of the date on which the transaction is first posted to the VISA system.
