Complaint to TGA: The ongoing and dangerous promotion of ear candles

I submit that this is a "high priority" complaint because the sponsors (&/or other advertisers) are recalcitrant, this class of products have had numerous upheld complaints and the sponsors (&/or others) continue to make claims that I allege breach the Therapeutic Goods Advertising Code 2017. This clearly impacts on consumers ability to appropriately use these goods.

Background

Ear candling is a widely promoted alternative medical practice that involves inserting and lighting a hollow candle in the ear canal. There are at least 15 ear candles currently included on the Australian Register of Therapeutic Products (ARTG) as “other” therapeutic goods.1 There are also seven Class I medical device entries in the ARTG that appear to be ear candles.2

As with listed medicines, there is no pre-market evaluation by the TGA of these goods. In theory, the listing application process for ear candles should ensure that the presentation, claims and labelling for these products are appropriate and that the product is safe.

In practice, sponsors can, and do, say whatever they like in their promotion and on the ARTG public summary document. The only check is the complaint system and rare post-marketing reviews by the TGA.

There have been at least 20 complaints about ear candles upheld by the TGACRP on various grounds, such as claims that candling removes wax (which it does not) and statements that the product has “TGA approval” (which is not allowed).3 It is also claimed (without evidence) that candling may assist with tinnitus (ringing in the ears), headaches, sinusitis, swimmers ear, migraines, glue ear and bacterial infections such as tonsillitis (see screen shots below).

In fact, ear candles (and candling) are ineffective and dangerous. They do not remove wax from the ear and have caused injury from burns, ear canal occlusions, ear drum perforations and secondary ear canal infections with temporary hearing loss.4,5

Neither the promotion of these products, nor their ARTG Public Summary documents point out these dangers.

Given the lack of effective sanctions against upheld complaints more definitive regulatory action has been requested. The U.S. FDA and Health Canada have acted against manufacturers of ear candles by providing public warnings, import alerts, seizures, injunctions, and warning letters.6

A recent TGA consultation asked for submissions on options for reform.2 Nine of 451 public submissions discussed ear candles (the rest were mainly concerned about ). These submissions can be found in appendix I.

• Option 1 (continue to be regulated as Therapeutic Goods by TGA) was supported by 5 bodies: NICM, FSM (Harvey), ASMI, ATMS and the ACCC (but with caveats). • Option 3 (excluded from Therapeutic Goods framework) was supported by 4 bodies: PSA, MTAA, Australian Skeptics, Victorian Skeptics.

Regardless, on 21 June 2018, without providing any analysis of these submissions, or giving any reason for its decision, the TGA / Government decided that ear candles will be excluded from the Therapeutic Goods framework. Friends of Science in Medicine (FSM) has written to Minister Hunt concerned about the decision-making that led to this result and the impact on consumer safety.

I can find no evidence that ear candles, as yet, have been added to the Therapeutic Goods (Excluded Goods) Order No 1 of 2011.7 Meanwhile, misleading and deceptive promotion of these potentially dangerous goods continues, as does similar misleading statements on ARTG Public Summary Documents. The following is a representative sample.

I allege that the following promotion breaches the Therapeutic Goods Act 1989, s.41ML and the Therapeutic Goods Advertising Code 2015, s.4(1)(b), 4(2)(a), 4(2)(b), 4(2)(c), 4(2)(d), 4(2)(i), 4(7) & 5(2). In addition, the failure of the TGA to act on this matter has encouraged many natural therapists to repeat these misleading and deceptive claims and offer this discredited therapy to the potential detriment of their customers (appendix II). Only nine of 451 public submissions mentioned ear candles (the rest were mainly concerned about homeopathy).

• Option 1 (continue to be regulated as Therapeutic Goods by TGA) was supported by 5 bodies: NICM, FSM (Harvey), ASMI, ATMS, ACCC. • Option 3 (excluded from Therapeutic Goods framework) was supported by 4 bodies: PSA, MTAA, Australian Skeptics, Victorian Skeptics

Regardless, the government decided that ear candles will be excluded from the Therapeutic Goods framework (handballed to the ACCC). The details follow:

1. Pharmaceutical Society of Australia. The PSA believes ear candles should be removed from the therapeutic goods regulatory framework (Option 3). Given the lack of evidence of therapeutic benefit and the potential to cause serious injury (and actual reports of injury) these products should not be making therapeutic claims and should be removed from consideration as therapeutic goods.

2. The National Institute of Complementary Medicine. NICM recommends Ear Candles continue to be regulated by the TGA as “Other Therapeutic Goods” (Option 1 – Maintain the status quo regulation). However, NICM further recommends that the TGA formally review ear candles to assess if they should continue to maintain low risk status.

It appears the scientific evidence suggests that ear candles do not work; that the residue left after burning which is used as evidence of effectiveness is in fact an artefact; and that the use of ear candles is associated with the potential for harm.

On this basis, Health Canada recommends to Canadians they avoid ear candling considering it dangerous and without proven medical benefits. It regulates ear candles as a medical device and has not issued any licences. They state that selling ear candles for medical reasons in Canada is illegal; and both Canada and the United States have banned the importing of ear candles.

NICM recommends that the low risk status of ear candles be reviewed.

3. Medical Technology Association of Australia. MTAA noted ear candles are currently included in the ARTG as Class I medical devices. In a recent BBC program, ENT surgeon Dr Gabriel Weston stated: “Research has shown that not only is ear candling ineffective at removing , but it can be dangerous. It can burn the face and ear, it can leave wax in the canal, and it can also puncture the ear drum.” (Dr Gabriel Weston, 2017).

The MTAA does not support the inclusion in the ARTG of substandard products that could be supplied to consumers with inappropriate therapeutic representations.

Therefore, we recommend Option 3 – Exclude ear candles from the regulatory framework (this approach is aligned with US and Canada; both countries have banned the importation of ear candles). This will result in ear candles no longer being considered therapeutic goods and removing the perceived ‘approved by the TGA’ legitimising of ear candles.

4. Friends of Science in Medicine (Harvey, et al.) Noted ear candling is an alternative medical practice (often practiced by naturopaths) that involves inserting and lighting a hollow candle in the ear canal. As with listed medicines, there is no pre-market evaluation by the TGA of Class 1 medical devices.

In theory, the listing application process for ear candles should ensure that the presentation, claims and labelling for these products are appropriate and that the product is safe. In practice, sponsors can, and do, say whatever they like in their promotion and on the ARTG public summary document subject. The only check is the complaint system and rare post- marketing reviews by the TGA.

It is often claimed that ear candles remove excess wax from the ears and promote relaxation and general wellbeing. Additional claims state that candling may assist with tinnitus (ringing in the ears), headaches, sinusitis, swimmers ear, migraines, glue ear and bacterial infections such as tonsillitis and that certain candles are “TGA approved”.

In fact, ear candles (and candling) are ineffective and dangerous. They do not remove wax from the ear and have caused injury from burns, ear canal occlusions, ear drum perforations and secondary ear canal infections with temporary hearing loss.

Neither the current promotion of these products, nor their ARTG Public Summary documents point out these dangers. There have been at least 20 complaints about ear candles upheld by the TGACRP on various grounds, such as claims that candling removes wax could not be substantiated, and statement that products have “TGA approval” is not allowed.

Given the lack of effective sanctions against upheld complaints more definitive regulatory action has been suggested. The U.S. FDA and Health Canada have acted against manufacturers of ear candles by providing public warnings, import alerts, seizures, injunctions, and warning letters.

Harvey advocated:

• The TGA as a specialist regulator should retain responsibility for these listed products (option 1) BUT ensure that a prominent warning is provided on their ARTG Public Summary documents, product packaging, labelling and promotion, for example, Warning: these products do NOT remove wax or other impurities from the ear and have been associated with INJURY including burns, ear drum perforations and ear canal infections. • The TGA should conduct a targeted post-marketing review on these products to ensure that the above warning is complied with. • The TGA should provide a public warning about these products on their web site like that provided by the U.S. FDA. The TGA should convey this warning to the organisations listed in Schedule 1. Part 2 of the Therapeutic Goods Regulations 19906 and ask them to pass it on to all their members

5. Australian Society ATMS noted that ear candles are therapeutic devices and should be regulated as such (option 1). No other option allows for this.

The claim is frequently made that ear candles can remove toxins or earwax by lowering the pressure in the aural cavity. However, there is nothing to suggest that detritus found in the remains of a burnt ear candle is extracted from the subject of the procedure.

As ear candles offer no therapeutic benefit, they are better regarded as a fraudulent parlour trick than a therapeutic good. By excluding them from the regulatory framework (Option 3) the TGA is giving a clear signal to alternative practitioners that there is no tacit endorsement or recognition of this crypto-medical performance.

The ACCC is an ideal body to deal with dishonest advertising of them or to consider product recalls or category wide ban on these goods owing to the dangers that they pose.

7. Australian Skeptics Inc. Ear candles have been shown to have potentially very dangerous impacts on users, even if used as directed. These dangers include damage to the inner and outer ear through the application or misapplication of hot wax. The US Food & Drug Administration warns that “ear candles can cause serious injuries, even when used in accordance to manufacturers’ directions. ‘Also,’ says Mann [Eric Mann, MD, PhD, clinical deputy director of FDA's Division of Ophthalmic, Neurological, and Ear, Nose, and Throat Devices], ‘FDA believes that there is no valid scientific evidence for any medical benefit from their use.’” - https://www.fda.gov/forconsumers/consumerupdates/ucm200277.htm

Classifying ear candles as “very low risk” is a misrepresentation of the serious dangers these products represent. The fact that these products are listed in the ARTG “with therapeutic claims to the effect of ‘for relaxation’, ‘general wellbeing’ and ‘ear wax cleaning’” indicates that the TGA listing for these products is ineffective and misleading.

Thus, we would recommend Option 3 – “Exclude ear candles from the regulatory framework”.

8. Australian Self Medication Industry ASMI questioned the inclusion of ear candles in the “very low” category. We suggest that any product that involves a naked flame in close proximity to the head of a prone patient should at least be considered to be a “low” risk. We also suggest that consideration needs to be given to how these products are marketed (e.g. for chronic ear infections, glue ear, etc.) which are conditions that may require different forms of treatment.

Option 1- Maintain the status quo regulation of ear candled is supported

Where a product is represented in any way to be for therapeutic use (or is likely to be taken to be for therapeutic use) then the product should be on the public register (the ARTG) and should be regulated by the TGA.

The consultation paper raises the possibility that the TGA's continued regulation of these products could be viewed as "legitimising" them. ASMI does not support this proposition. If the products are not legitimate then the TGA should take action against the sponsors and advertisers.

The legitimacy or otherwise of a group of products should have no bearing on whether the TGA (or some other agency) regulates them. If they are therapeutic goods, they are the TGA's responsibility. If they are not legitimate goods, then the TGA has an obligation to take action. Handing responsibility on to another agency is not an appropriate solution.

9. Australian Competition and Consumer Commission ACCC noted the advertising & claims made for these products can be problematic and if there is a lack of enforcement then these problems can be made worse.

The ACCC is concerned that by excluding the following “low risk” products from the TGA regulatory framework there is an expectation that the ACCC would provide the same level of regulatory oversight. The ACCC’s consumer protection role does not extend to assessing the efficacy of medical treatments such as ear candling. As an agency it does not hold the specialist knowledge required to evaluate this type of practice or associated health claim.
