Mr T Stephenson and Mrs V Fisher outlined their objections in relation to application 2/2000/0642. The applicant did not exercise his right of reply.

Mr G Simmons outlined his objections in relation to application 2/2000/0695. The applicant’s father, Mr G Sharp, exercised a right of reply.

Mr J Miller, Milburns, representing Mr Cowx outlined his objection to application 2/2000/0720. Mr E Telford exercised a right of reply on behalf of Mr Dahl.

309 PLANNING APPLICATIONS

The Panel considered individual reports from The Head of Planning Services regarding ten applications for planning permission.

RESOLVED – That the planning applications be determined, subject to the conditions indicated in the report as follows:-

Reasons : 1) The local Planning Authority consider the proposal by virtue of its location in the open countryside outside the designated settlement limits, poor relationship to Wigton settlement limit, absence of need and type of local need housing at this location and detrimental impact on the settling of the listed building and proposed occupancy criteria constitutes residential development in the open countryside to the detriment of its visual amenity; contrary to HS3 and HS15 of ALP. If allowed the proposal would act as an adverse precedent for other housing development in open countryside outside the designated settlement limits in the Local Plan. 306

2) The proposed development by virtue of its siting, design, size and land use would be detrimental to the setting of Spittal Farm listed building; contrary to C018 of ALP.

Reasons : 1) The proposed use would be detrimental to the character of the Conservation Area by virtue of increased noise generation and traffic movement caused by vehicles visiting the premises. Contrary to C02 and C09 of ALP. 307

2) The proposed use is inappropriately located by virtue of the potential for noise generation and traffic movement, causing detriment to the residential amenity of local residents and would therefore be contrary to Policy EM6 of ALP

Reasons : In the opinion of the local Planning Authority, the erection of a dwelling on this prominent and elevated site would be harmful to the character and appearance of the 309

locality and be harmful to the character and appearance of Maryport Conservation Area; contrary to Policies HS8 and CO13 of ALP

310 REPAIRS NOTICE, MOCKERKIN HALL, MOCKERKIN

The Head of Planning Services submitted a report which sought approval for repairs notices to be served on Mockerkin Hall, Mockerkin.

The purpose of the repairs notice was to urge the owner of the listed building to effect such repairs as were necessary to safeguard the future of the building.

If no remedial action was taken, officers feared that the condition of the building would continue to decline to a point where the building would either become dangerous or simply uneconomic to repair.

RECOMMENDED – (a) That the Committee authorise the commissioning of a structural survey of Mockerkin Hall, Mockerkin.

(b) That the Committee authorise the serving of a repairs notice under Section 48 of the Planning (Listed Buildings and Conservation Areas) Act 1990 on Mockerkin Hall, Mockerkin.

(c) That the Committee authorise compulsory purchase of Mockerkin Hall, Mockerkin should the following circumstances prevail:-

(i) The requirements of the repairs notice are not met in full within the allocated time. (ii) That there is in place a back to back legal agreement with a building preservation trust to facilitate the compulsory purchase.

(d) That a progress report be submitted to a future meeting of the Development Panel.

311 MARYPORT TOWN CENTRE BOUNDARY

The Head of Planning Services submitted a report which sought support for a change to the defined town centre in Maryport due to a decline in the designated town centre north of John Street.

RECOMMENDED – (a) That the area of Crosby Street/Kirkby Street as shown on Plan A attached to the report, be excluded from the town centre of Maryport as designated in the adopted Local Plan.

(b) That the area of Station Street/Curzon Street shown on Plan B attached to the report be excluded from the town centre of Maryport as designated in the adopted Allerdale Local Plan.
