” SECTION 3. NEW LAW A new section of law not to be codified in the Oklahoma Statutes reads as follows:

In the event that any federal or Oklahoma court makes a final determination that this act violates either the Constitution of the United States of America or the State of Oklahoma, the amount of any litigation costs incurred by the state, or any of its political subdivisions, in challenges to the constitutionality of this act or paid by this state, or any of its political subdivisions, to the prevailing party in such an action, shall be reimbursed to the Office of the Attorney General or to the appropriate political subdivision as provided in this section. In such event, the Office of the Attorney General shall determine the amount of such costs or payments and shall certify such amount to the Oklahoma Department of Transportation. The Department shall withhold the amount of funds which would have been expended upon projects in the eight-year Construction Work Plan in the districts of the principal Senate and House authors of the act, as such districts exist on the effective date of the act. Two-thirds of the total amount shall be withheld from a project or projects in the district of the principal Senate author and one-third of the total amount shall be withheld from a project or projects in the district of the principal House author. After the funds are withheld, the amount of funds in the eight-year Construction Work Plan to be expended upon any projects in the districts of the principal Senate and House authors of this act may not be increased for eight years after the effective date of this act. The Department shall notify the Office of Management and Enterprise Services, which shall transfer the withheld amounts to the Attorney General’s Revolving Fund or to the appropriate political subdivision, as certified by the Office of the Attorney General.”; and by renumbering subsequent sections, which amendment failed of adoption upon roll call as follows:
