If information is power, the ability of one branch of government to control information represents the ability to control federal legislation, policy, and decision-making. The Framers of the United States Constitution developed the Madisonian model of separated powers and functions, and a system of checks and balances to maintain those separations, with this in mind. History has shown a progressive shift of the power to control information toward the executive branch and away from the Legislature. Particularly when uni- fied, one-party government precludes effective Congressional investiga- tions and oversight, little recourse exists for accessing information. This article addresses an institutional design element that would increase transparency and accountability: periodic question-and-answer sessions between Congress and the President modeled on the United Kingdom’s Prime Minister’s Question Time. This article makes the case for such a measure in the U.S. by examining the comparative political history and legal norms of the U.K. and the United States, and the need for a Ques- tion Time to increase government transparency and efficiency. The current administration has asserted increased authority over the flow of information from the executive branch than was previously the case, has failed to respond to formal and informal queries by members of Congress, and has attempted to manipulate press coverage favorably while diminishing the information it actually discloses to the media.4 Similar criticisms—of a lack of public information, accountability, and transparency5 in government—have been directed toward most, if not all, recent U.S. presidents.6 This article considers one institutional element used by the United Kingdom and other democracies to hold their executives accountable and increase governmental transparency: a periodic opportunity for elected representatives to pose questions to the leader of the executive branch. This article asks whether a President’s Question Time, in which mem- bers of Congress would periodically question the President in person re- garding his policies, actions and plans, would be constitutional, or even desirable. In analyzing these questions, this article considers the historical and comparative bases for adopting a measure commonly used in parliamen- tary government. It also seeks to determine how a President’s Question Time would fit within the range of options that Congress typically uses to request information from the executive branch. 4 See discussion infra Part I; see also Daryl J. Part I also analyzes the current lack of trans- parency and accountability of the executive branch and addresses how these issues are amplified when one political party controls both the ex- ecutive and legislative branches of government. Part II considers as a comparative model the political history of the United Kingdom, including the increase in executive power of the Prime Minister, that led to the establishment of a Prime Minister’s Question Time in that country. Part III examines the U.S. framers’ deliberate institutionalization of a low level of presidential responsiveness to Congress and the public and discusses the framers’ expectation that the Legislature was likely to dom- inate and coerce both the executive and the judicial branches of govern- ment.

    15 Questions One of the more important functions of the House is its critical review function. This includes scrutiny of the Executive Government, bringing to light issues and perceived deficiencies or problems, ventilating grievances, exposing, and thereby preventing the Government from exercising, arbitrary power, and pressing the Government to take remedial or other action. Questions are a vital element in this function. It is fundamental in the concept of responsible government that the Executive Government be accountable to the House. The capacity of the House of Representatives to call the Government to account depends, in large measure, on its knowledge and understanding of the Government’s policies and activities. Questions without notice and on notice (questions in writing) play an important part in this quest for information. QUESTION TIME The accountability of the Government is demonstrated most clearly and publicly at Question Time when, for a period (currently usually over an hour) on most sitting days, questions without notice are put to Ministers.1 The importance of Question Time is demonstrated by the fact that at no other time in a normal sitting day is the House so well attended. Question Time is usually an occasion of special interest not only to Members themselves but to the news media, the radio and television broadcast audience and visitors to the public galleries. It is also a time when the intensity of partisan politics can be clearly manifested. The purpose of questions is ostensibly to seek information or press for action.2 However, because public attention focuses so heavily on Question Time it is often a time for political opportunism.

Box 1325 Dennis Port, MA 02639 1 Lyndon Johnson and the American Dream, Doris Kearns first book, published three years after LBJ’s death, present one of the first drafts of history for our thirty‐sixth President. President Johnson chose the twenty‐five year old Doris Kearns from the White House Fellows program for his staff after he shocking announced to the nation that he would not seek another term as President of the United States. The choice surprised many since the Harvard doctoral candidate had coauthored an article critical of LBJ’s Vietnam policy in the New Republic titled “How to Remove LBJ in 1968”. After his Presidency ended, he asked her to live at the LBJ ranch and help him write his autobiography, The Vantage Point. Kearns spent long weekends and breaks from her teaching of government at Harvard at the ranch with Lyndon and Lady Bird Johnson. Their relationship lasted the last five years Lyndon Baines Johnson’s life. Thesis Doris Kearns attempts to analyze the childhood, look at the conflicting demands his parents put on him and see how the larger than life personality that emerged dealt with each stage of his political rise and fall. Famed developmental psychologist and Harvard professor Erik Erikson is referred to frequently. Johnson’s motives for giving such access to his personal recollections and papers in the final stage of his life lead to speculation. “Perhaps, even at the end, Lyndon Johnson was looking, planning, for some chance to achieve that place in history that meant so much to him” (Kearns, pg.

    Political Studies GA 3: Written examination GENERAL COMMENTS In the 2001 Political Studies Examination the overall standard of answers was good. Responses to Section A the short-answer questions were generally of a higher standard than the essay responses in Section B. There was a significant number of students who clearly had a very good grasp of the subject matter covered in this course. However, many students wrote essays which were comparatively poor. Such essays were often too brief, failed to answer the question and did not present sufficiently detailed discussion of the major issues in the question. Students need more practice at analysing essay questions and writing essays within a timeframe similar to that in the November examination. Many students did not select four short-answer questions and answered parts of or all of five questions. Students were clearly instructed to answer four questions and only four questions in part A. Some of the responses in the short answer questions were too long and detailed. Students need to be reminded that exceeding the suggested length of an answer will not necessarily mean more marks are awarded. Exceeding the suggested length of a short answer usually wastes time.     “LET US CONTINUE” – Lyndon Johnson and the Rise and Fall of the “Liberal Hour” After Kennedy’s tragic death, Johnson addressed the Congress and urged members to pass Kennedy’s legislative agenda as a tribute to the slain president. This was the very agenda that the southern members of his own Democratic party had refused to support during the previous two years. Now, however, the grieving public responded positively to Johnson’s efforts to push the Kennedy agenda, and Congress, sensing that opposing the public mood could be politically risky, allowed his Civil Rights bills to come to a vote. Over the next two years, the landmark Civil Rights bills of 1964 and 1965 became law. The first ended segregation and empowered the federal government to enforce anti- segregation laws; the second gave black voters the protection of the federal government, making it a federal crime for white state and local officials to deny blacks their constitutional right to vote. Similarly, Johnson was able to convince Congress to pass Kennedy’s tax cut and to take up legislation intended to fight poverty. (This was the beginning of the “War on Poverty” – more associated with the Johnson administration, than the Kennedy administration, but part of the same liberal, activist approach to government that characterized the first half of the 1960s.) 1964-1965 marked the high point of post-World War II liberalism. When Johnson won a landslide victory in the presidential election of 1964, it appeared that liberalism had secured a place as the dominant political ideology in the United States.

Post-Colonial Political Institutions in the South Pacific Islands: A Survey Jon Fraenkel Vue d’ensemble des Institutions politiques postcoloniales dans le Pacifique Sud insulaire A partir du milieu des années 80 et jusqu’à la fin des années 90, les nouveaux pays du Pacifique sortaient d’une période postcoloniale marquée au début par l’optimisme et dominée par une génération de dirigeants nationaux à la tête d’un régime autoritaire pour connaître par la suite une période marquée par les difficultés et l’instabilité et qui a connu le coup d’Etat de Fidji de 1987, la guerre civile à Bougainville, le conflit néo-calédonien et l’instabilité gouvernementale au Vanuatu et ailleurs. Dans les pays de la Mélanésie occidentale, cette instabilité a été exacerbée par des pressions exercées par des sociétés minières et des sociétés forestières étrangères. Cette étude retrace l’évolution et explore les complexités des diverses institutions politiques postcoloniales dans le Pacifique Sud à la fois au sein de ces institutions et dans leurs relations entre elles ; elle montre que les questions de science politique classique ont été abordées de façons extrêmement différentes dans la région. On y trouve une gamme de systèmes électoraux comprenant à la fois des régimes présidentiels et des régimes parlementaires ainsi que des situations de forte intégration d’un certain nombre de territoires au sein de puissances métropolitaines. Entre les deux extrêmes de l’indépendance totale et de l’intégration, les îles du Pacifique sont le lieu où l’on trouve un éventail d’arrangements politiques hybrides entre les territoires insulaires et les anciennes puissances coloniales.
