Patients with diabetes rely on prescription drugs, including insulin, to help manage their conditions. Over the past two decades, manufacturers have systematically and dramatically raised the prices of their insulin products by more than tenfold—often in lockstep. These high prices lead many people to ration or stop taking their medications, which can result in serious health complications and even death, as the Committee heard in direct testimony earlier this year. The prices of diabetes medications—and insulin in particular—are far higher in the United States than they are overseas, in part because certain federal programs lack the authority to negotiate directly with drug manufacturers. In order to assess the impact of the high prices of diabetes medications on seniors and uninsured patients, this report was prepared by the staff of the House Committee on Oversight and Reform for the 44th Congressional District of California. Costs to Seniors and Medicare This report estimates that there are approximately 17,000 Medicare beneficiaries in the district who have been diagnosed with diabetes. The 50 most popular brand-name diabetes medications used by these beneficiaries are available at significantly lower prices in other countries.     HEALTH POLICY CENTER State Efforts to Lower Consumer Cost-Sharing for High-Cost Prescription Drugs Stakeholder Perspectives Sandy Ahn and Sabrina Corlette GEORGETOWN UNIVERSITY HEALTH POLICY INSTITUTE August 2017 Federal action to lower the cost of prescription drugs has broad support across the political spectrum. In one recent poll, over 60 percent of Americans identified lowering the cost of prescription drugs as a “top priority” for the Trump administration and Congress (Kirzinger et al. 2017). But to date, there has been little change in federal policy on drug pricing and costs. Perhaps in response to federal inaction on this issue, state legislators have introduced 80 bills in 2017 alone that attempt to lower prescription drug costs. One area of focus for states has been high out-of-pocket drug costs for consumers with chronic conditions such as multiple sclerosis or cancer that require treatment with specialty drugs. California, Colorado, Delaware, Louisiana, Maryland, Montana, New York, and Vermont have leveraged their authority to regulate health insurance to lower cost-sharing charges for consumers using these specialty drugs. To assess the goals and impact of these state policies, we conducted interviews with regulators, insurers, and consumer advocacy groups in four of the eight states: California, Colorado, Louisiana, and Montana. Most of the stakeholders said that these state policies have had their intended impact by reducing consumers’ out-of-pocket costs for expensive prescription drugs and by preventing insurers from discriminating against high-cost enrollees through the design of plan formularies. However, stakeholders had mixed opinions about the policies. Insurer respondents noted that they shift costs to other consumers, either through higher premiums or cost-sharing for other services, and mask the larger problem of escalating drug prices.

Girish Dighe, PharmD, MS, director of pharmacy, business services, at OhioHealth, a not-for- profit system of hospitals and healthcare providers in Columbus, notes that there are fundamental flaws within the healthcare system causing vastly complex challenges to drug pricing. “The multitude of stakeholders involved in the drug channels for bringing patients access to medications (manufacturers, insurers, pharmacy benefit managers (PBMs), providers, retail pharmacies, wholesalers) revolves around financial incentives driving each stakeholder,” Dighe says. “The growing spread between pharmaceutical list price and net price negotiated by drug channel stakeholders has negatively impacted patients’ out-of- pocket costs.” According to a recent survey from NORC at the University of Chicago and the West Health Institute, 77% of Americans believe prescription drug prices are unreasonably high. President Donald Trump took a big stance against rising drug prices early in his tenure and since then some drug companies—Pfizer, Novartis, Sanofi, Roche, and Merck among them—have announced that they’re freezing or even lowering drug costs. Alex Azar, HHS secretary, recently announced that the administration is also working to stop drug rebates to PBMs. The Pharmaceutical Care Management Association (PCMA), which represents pharmacy benefit managers, issued a report recently blaming high drug prices on drug makers, not PBMs. In the report, Mark Merritt, PCMA’s president and CEO, said the findings supported the belief that drug makers set and raise prices unrelated to the rebates they negotiate with PBMs.

A 2017 survey from the Council of Accountable Physician Practices (CAPP) found that consumers believe patient-provider relationships are the single most important factor in quality care.1 Through shared decision-making the patient and provider will develop a plan of care which meets their needs and expectations. Care guidelines are often used to establish safe and effective therapeutic plans. However, even peer reviewed guidelines acknowledge limitations and the need to individualize treatment decisions. Patients with rare, complex, and chronic diseases often need high-cost specialty medications to manage their conditions and maintain their health.
