JUNE 14th 2021

The Common Council of the City of Kokomo, Indiana met Monday June 14th,

2021 at 6:00 p.m. in City Hall Chambers.

President Grecu called the meeting to order.

President Grecu states those who wish to stand may, or you may remain seated.

Councilwoman Sanders introduced Pastor Devin Galloway New Life Church.

Pledge:

Present: Acord, Rudolph, R. Stewart, T. Stewart, Collins, Grecu, McKibben,

Sanders.

Absent: Miklik

Minutes for the Council Meeting held May 24, 2021 were deemed approved.

Communications: Councilwoman McKibben stated, from the Council and Public

Safety and Welfare Commission we would like to recognize Officer Tammy Cody of the Kokomo Police who retired. Officer Gary Quirk was promoted to Sargent and Officer Bruce Rood was promoted to Captain. The Kokomo Fire Department also promoted to the rank of Captain, Mike McKibben and Josh Rodabaugh.

The Clerk read Ordinance #6994 by title only. Councilman Collins moved for passage on second reading. Seconded by Councilman Grecu. Councilman Collins states, this is an ordinance establishing a local fund for Federal Assistance received from the American Rescue Plan of 2021

The Clerk read Ordinance #6995 by title only. Councilwoman Sanders moved for passage on the first reading, seconded by Councilman Grecu. Councilwoman

Sanders states that on behalf of the petitioner Charles Reed requesting the Kokomo

City Plan Commission petition and recommend the Kokomo Common Council for a change in zone classification.

Charles Reed Kokomo turned the floor over to Dennine Smith Kokomo. Ms. Smith explained the change in zone gave them the opportunity to spread out more, to expand services they offer. Councilwoman McKibben inquired if they would be moving out of the current building at 210 N Market. Denine Smith stated yes all services would be offered at 625 N. Union. Councilwoman McKibben asked if the bed space would change. Dennine Smith said it would be staying at 12.

Councilman T. Stewart inquired about shower services to individuals. Dennine

Smith stated at this time those services are only offered to the individuals utilizing their services. Councilman Grecu inquired as to how many people a day do you see come through the shelter who do not stay-over. Dennine Smith estimated around fifty people a day.

Councilman Grecu inquired what the plans were for the building they currently are housed in. Charles Reed of Kokomo stated there were no current plans at this time.

Darwin Star of Kokomo provided a hand out of a hand drawn map with his concerns on the tax base for that block.

Councilwoman Sanders states Fortune Companies on behalf of Lafountian LLC are requesting a zone change from a C1 to M1 for property located at 415 W

Sycamore St. Kokomo IN 46901. Danny Butcher on behalf of the petitioner states they are requesting the re-zone to be able to convert a commercial space into three one-bedroom apartments. Councilman Grecu stated the first floor being commercial at this time. Councilwoman McKibben inquired how many bedrooms would they have. Danny Butcher Kokomo stated three one-bedroom apartments.

Councilwoman McKibben inquired on parking spaces. Danny Butcher stated he believed twelve off street spots.

Brian Munch Plainfield IN. states he is here on behalf of Bunn Real Estate. Brian

Munch states that Bunn Real Estate is a new business owner in the community, bringing with him a business dealing with construction demolition debris along with commercial waste disposal. Bringing with him to Kokomo an enclosed transfer station. Mr. Munch also stated, the Indiana Department of Environmental

Management would closely monitor this business. Councilman T. Stewart inquired if there would be any new jobs. Mr. Munch stated typically 5-10 new jobs.

Councilman Acord inquired as to a time frame to get started. Mr. Munch stated as soon as possible.

Project: Area Five Agency will continue to maintain their five-county (Tipton, Howard, Cass, Miami, and Fulton) adult guardianship services with maximizing resources allowing for further program growth in 2022. This Program covers adult guardianship as written in Indiana Probate Code 29 and directed by leadership appointed to the Indiana Adult Guardianship Office ofthe . It is established, managed, and directed by Area Five Program Director, Linda Johnson, StaffCoordinator, Alachia Sturgess, and Guardian Specialist, Shawn Durham along with utilizing volunteer advocates who are screened and trained by the same. The policies and procedures will adhere in accordance to the VASIA guidelines which fol1ow the National Guardianship Association. The lndiana Supreme Court has funding set aside awarded through a grant process that requires 50% of local matching funds.

Population Served: Seniors and incapacitated adults who are indigent or without the support of suitable family members. This target popUlation is growing in number with the baby boomers holding 20% ofUS population and growing. The communities will benefit from an organized program in many ways through help to the po1ice, sheriff, EMT's, City and County offices, hospitals, and nursing homes as well as giving the indigents timely and quality medical care, advocacy and dignity throughout the remainder oflife along with safe financial support.

Guardianship Stories from Actual Served Clients

In Tipton County cHent served had mice in her bed, feces all over, and cockroaches everywhere. The fire department had been called 83 times in 10 months by this client (before we got her) for the FD to help pick her up when she had fan en. Her home'was condemned by the Tipton County Health Department on the last FD run provided and we were awarded her as a client soon after. This not only saved a tremendous amount of dol1ars for the City ofTipton on those full 911 runs; but also took a dear soul out of her deplorable conditions. To date, she continues to thrive wen in her group home, attends daily workshop activities (COVID pennitting), and is eating healthier and lost about 60 pounds which were much' needed to improve her health. She is so happy and loves her home and friends.

This past year in Fulton County, we worked with the Court and an ad litem attorney to be appointed Guardianship for a pair ofadult siblings whom were being, as it turned out, not only fmancially exploited but also sexually abused by mother and boyfriend. These incapacitated adult siblings were removed from the home into safe housing immediately and proper care granted to them thru the workings ofthe Area Five Guardianship Program and continues with Area Five now over a year later.

This past year in Cass County we assisted APS in a case that involved a mother and son who were living in deplorable, sickening conditions. Both of them were too sick to call for help and too fuzzy headed to know their own conditions. Feces were throughout the house) the bathroom beyond words, and maggots had invaded into a deep skin wound ofthe son. They were behind in their biJIs and on eviction notice standby pending COVID. Both were immediately removed and hospitalization provided. The son was young enough and able-minded once medically cared for to continue on his own; but neither he nor 'his sisters capable of taking care ofmom or being her guardian. We were appointed by Court to be mom's guardian. She is thriving well in a nursing home at this time but suffers ITom advanced dementia and mental health to ever be in the community again. However, she is much healthier, clean, eating well, and happier.

Late into the winter we were alerted by APS of a case in Miami County of a mother and son who had been evicted from their home in Peru which had been condemned. Both had mental and medical issues. We now have guardianship of both individuals. Mom is getting the love and care she needs in a nursing home; and the son is in a group home and enjoying daily life. Both are eating well, not on the street and not in deplorable conditions. Our hope in time once they stabilize is to get them visits back and forth. We do have tablets that we provide for our clients . to be able to make "face time" chats to keep in touch with family, staff, and volunteers. This seems to be helping for now and with periodic phone calls. By the way, as guardians, we will deed over their property to the City of Peru to use as it sees fit upon demoHtion.

EMPLOYEES CALLED IN FOR WORK OUTSIDE THEIR REGULAR SHIFT, OR REQUIRED TO APPEAR ON UNSCHEDULED DAYS, OR ARE ORDERED TO WORK FROM OFF-DAY BY THE CHIEF IN AN EMERGENCY, WILL BE AWARDED THREE (3) HOURS MINIMUM OVERTIME PER OCCURRENCE.

THE CITY SHALL MAKE EVERY REASONABLE EFFORT TO PAY ACCUMULATED OVERTIME WITHIN TWO (2) PAY PERIODS FOLLOWING THE OCCURRENCE OFTHE OVERTIME.

THE EMPLOYER SHALL NOT UNREASONABLY REQUIRE ANY EMPLOYEES TO WORK OVERTIME. PERSONNEL SHALL NOT REFUSE TO WORK OVERTIME, IF THE RESULT OF SUCH REFUSAL WOULD RESULT IN DANGER TO THE PUBLIC SAFETY OR INABILITY OF THE POLICE DEPARTMENT TO PROPERL Y DISCHARGE ITS RESPONSIBILITY TO THE PUBLIC AND CARRY OUT ITS POLICE FUNCTIONS IN AN ADEQUATE MANNER. IF AN EMPLOYEE HAS GOOD AND SUFFICIENT REASON FOR REFUSING OVERTIME, AND ANOTHER EMPLOYEE IS AVAILABLE TO WORK SUCH OVERTIME AND IS CAPABLE OF DOING SO, THE EMPLOYER SHOULD NOT INSIST ON THE FIRST MENTIONED EMPLOYEE WORKING SAID OVERTIME. WORKING DETAILS THAT ARE COMPENSATED AT AN OVERTIME RATE SHALL BE SCHEDULED WITH PREFERENCE GIVEN TO A DEFINED POOL OF OFFICERS. THESE POOLS ARE THEN ROTATED SO THAT EACH POOL RECEIVES FIRST CHOICE DURING THE ROTATION PROCESS. OFFICERS FROM THE FIRST POOL IN THE ROTATION WILL BE GIVEN A DESIGNATED TIME FRAME TO SELECT A TIME SLOT OR SLOTS AS DIRECTED. AT THE END OF THE SCHEDULED TIME, THE SCHEDULE IS PASSED TO THE NEXT POOL IN ROTATION AND SO ON. DEPENDING ON THE SIZE OF THE DETAIL, THE DEPARTMENT MAY ELECT TO REPEAT THE ROTATION PROCESS OR ADD AN OPEN POSTING TIME AFTER WHICH ANY OFFICER MAY SIGN TO FILL THE REMAINING SLOTS. THE POOL SCHEDULE WILL BE ROTATED WITH EACH NEW DETAIL OR MONTH OF SCHEDULE.

OFFICERS MA Y ONLY SIGN FOR SLOTS DURING THE POSTED TIMES OF THEIR RESPECTIVE POOLS. THE DEPARTMENT WILL POST THE OVERTIME DETAIL OPPORTUNITY AND THE ROTATION SCHEDULE AND POOL SIGNING TIMES AT LEAST FIVE (5) WORKING DAYS NOT COUNTING THE DAY OF POSTING PRIOR TO THE ACTUAL SIGN UP DATES.

FROM TIME TO TIME, CERTAIN SHORT DURATION, LIMITED OVERTIME DETAILS ARE UTILIZED. THESE WILL BE POSTED IN ROLL CALL FIVE (5) DAYS PRIOR TO THE DETAIL. THE POSTING WILL INCLUDE A CUT-OFF TIME AND DATE. ANY INTERESTED OFFICER MUST SUBMIT A REQUEST TO WORK THE DETAIL TO THE DIVISION COMMANDER WHO POSTED THE OPPORTUNITY. IN EMERGENCY OVERTIME SITUATIONS WHERE THE OVERTIME INVOLVES THE CONTINUATION OF A SPECIFIC ASSIGNED JOB BEYOND THE END OF THE REGULAR SCHEDULED WATCH, THE OFFICER(S) ASSIGNED TO THAT JOB SHALL HAVE THE FIRST OFFER OF OVERTIME. IN ALL OTHER EMERGENCY OVERTIME SITUATIONS, OVERTIME SHALL BE OFFERED FIRST TO THE SENIOR OFFICER ON DUTY AND CONTINUING TO THE LEAST SENIOR OFFICER ON DUTY. ORDINANCE OF THE COMMON COUNCIL OF THE CITY OF KOKOMO, INDIANA CONCERNING PUBLIC RECORDS REQUESTS AND FORM TO SUBMIT PUBLIC RECORDS REQUESTS

WHEREAS, the City of Kokomo, Indiana (the "City") is a duly organized municipal corporation and political subdivision under the laws of the State of Indiana, governed by its duly elected Common Council (the "Common Council"); and

WHEREAS, the Common Council agrees with the public policy that government is a servant of the people and that the public is entitled to full and complete information regarding the affairs of government and the official acts ofthe City; and

WHEREAS, providing persons with information is an essential function of representative government and an integral part of routine duties of public officials and employees; and

WHEREAS, the Common Council desires to provide access to the full extent ofthe access to public records law as set forth in I.C. § 5-14-3-1, et. seq.; and

WHEREAS, the Common Council desire to create a process, form and procedure so that the requests for access to information are streamlined and uniform throughout the City.

A RESOLUTION OF THE COMMON COUNCIL OF THE CITY OF KOKOMO, INDIANA TO OPT OUT OF OPIOIDS SETTLEMENTS PURSUANT TO INDIANA CODE 4-6-15-2

WHEREAS, the passed and the ofIndiana signed into law regarding the distribution of potential Opioid Litigation Settlement funds, and,

WHEREAS, the new law is to become effective on July 1, 2021, and,

WHEREAS, pursuant to Indiana Code 4-6-15-2, a political subdivision that has filed opioid litigation on or before January 1,2021, may opt out ofthe settlement provisions ofthe new law by passing a resolution and submitting a certified copy thereof to the Indiana Attorney General by June 30, 2021.

NOW, THEREFORE, BE IT RESOLVED BY THE COMMON COUNCIL OF THE CITY OF KOKOMO, INDIANA as follows:

The Common Council of the City of Kokomo having considered whether to elect to opt out of the Opioids Settlements under Indiana Code 4-6-15-2, hereby resolves that the City of Kokomo now exercises its election to opt out of the opioids settlement, and orders its duly authorized agent to submit a certified copy of this resolution to the Indiana Attorney General by June 30, 2021.

This Resolution shall be in effect beginning after its passage by the Common Council, signature of the mayor or override ofany .
