View Annual Report Dear Shareholder, Fiscal 2011 was a year fi lled with positive improvements and exciting new developments that enabled us to deliver record fi nancial results. Our revenue grew to $39 million, a 238% increase compared to fi scal 2010. One of our key objectives in fi scal 2011 was to generate positive operating income, and in each quarter of fi scal year 2011 we achieved that goal, and we generated annual operating income of $3.7 million—which represented an $11 million positive swing from an operating loss last fi scal 2011ANNUAL REPORT year. This accomplishment is a testament to the growing awareness about Protandim®, our fl agship product, combined with the experience, skill and dedication of the LifeVantage corporate team and our tremendous group of distributors, whose support and dedication are instrumental to our success and continued progress. These experts in direct selling have thoughtfully engaged new distributors in their networks and introduced thousands of Preferred Customers to our scientifi cally validated products. We are proud of all that we have accomplished, but believe that we have only just begun to realize our potential. Our focus is on improving our company with the best scientifi c practices and continuing to identify and implement ways to better our marketing and distribution strategies. I believe we have a heightened responsibility to operate LifeVantage in a measured and responsible, orderly manner. Why? Because we have an opportunity to play an important role in improving the physical and fi nancial health of many people as our customers reap the benefi ts of what we consider to be the best Nrf2 activator and oxidative stress reducer on the market. We are committed to increasing shareholder value by executing our strategic and tactical business plan and continuing to grow our business. As we mature and grow we believe it is prudent to make key investments in our operating infrastructure to ensure that we will capitalize on the robust opportunities ahead of us. Further, we recognize that focusing on our talent and our human capital will be critical in taking our business to the next level. In fi scal 2012, we will make strategic investments in our operating infrastructure to facilitate our expected growth. The combination of strong capital resources, a sound business plan, and our committed and experienced team, is expected to contribute to solid growth in our earnings while positioning LifeVantage as a leader in the rapidly growing and constantly changing nutraceutical, Nrf2, and anti-aging markets. I am not new to LifeVantage. Although I joined the company as President and Chief Executive Offi cer in March 2011, I have served on our Board of Directors since January 2010. I am honored and excited to lead our talented employees as we strive to reach new milestones with the fundamental goal of improving health and wellness of people worldwide. We believe that the growing number of peer-reviewed, published, independent studies and patents supporting Protandim®, as well as the recommendations by dermatologists regarding our scientifi cally based anti-aging skin care product, TrueScience® Anti-Aging Cream, are proof that we off er eff ective, safe, and powerful solutions to combat oxidative stress for a more youthful appearance. • Dietary Supplements Containing Ephedrine Alkaloids
SUMMARY OF DATA FOR CHEMICAL SELECTION Dietary Supplements Containing Ephedrine Alkaloids BASIS OF NOMINATION Dietary supplements containing ephedrine alkaloids from herbal sources (ephedra) are brought to the attention of the CSWG as part of an ongoing National Institutes of Health (NIH) Office of Dietary Supplements (ODS) research initiative on the safety and efficacy of these products. This initiative was recommended by the Senate Committee on Appropriations in fiscal year (FY) 2001. In its Report making FY 2002 appropriations for the Department of Health and Human Services, the Committee expressed pleasure that the ODS followed through on its FY 2001 recommendation and urged the ODS to continue and expand this important effort. The nomination of ephedra containing supplements to the National Toxicology Program (NTP) is part of the expanded effort by the ODS. As the Senate Committee noted, the number of Americans taking dietary supplements containing ephedra has risen dramatically. Dietary supplements containing herbal ephedra (chiefly Ephedra sinica Stapf.) are widely used as diet aids and athletic performance enhancers, with over 3 billion servings1 sold each year for weight loss alone. The active ingredients in these supplements are primarily ephedrine and pseudoephedrine with small amounts of other ephedrine alkaloids usually present. Ephedra-based diet aids often contain other stimulants, such as caffeine (guarana), as well as salicin, diuretics, and cathartics. Ephedra-containing performance enhancers often contain caffeine and other ingredients, such as chromium picolinate or l-carnitine, and may be consumed with other performance enhancers, such as androstenedione and creatine monohydrate. The ephedrine alkaloids are sympathomimetic amines, a class of compounds with fairly well characterized short to medium term biological activities.

Jay Leisner is a great teacher and has a strong, experienced perspective on Direct Sales. I learned a lot from Kevin Grimes and Jeff Jordan that I needed to learn. Scott Burnett and Troy Dooly were very inspiring and personable. Donna Marie Serritella was a perfect afternoon speaker to keep us engaged and interested. I also enjoyed the experience to be able to ask everyone questions afterwards.

MARY MERLIN Department of Management Studies, Manonmaniam Sundaranar University, Tirunelveli, India. Email: [email protected] ABSTRACT Direct selling is a multi-level marketing in which the sales force is compensated not only for the sales they make but also for the sales done through their recruit. This recruited sales force is referred to as the participants who can provide multiple levels of compensation. A person's job would be to recruit others to sell their product, and in return, receive a percentage of their sales. The next person's job then is to recruit people even more so below them, and receive a percentage of their sales. Other terms for Multi-level marketing include network marketing and referral marketing. Commonly, the salespeople are expected to sell products directly to consumers by means of relationship through referrals marketing. Academic Editor: Igor P. Pogribny Received: 22 February 2016; Accepted: 25 March 2016; Published: 9 April 2016 Abstract: Dietary supplements (DS) are extensively consumed worldwide despite unproven efficacy. The true incidence of DS-induced liver injury (DSILI) is unknown but is probably under-diagnosed due to the general belief of safety of these products. Reported cases of herbals and DS-induced liver injury are increasing worldwide. The aim of this manuscript is to report a tabular listing with a description of DS associated with hepatotoxicity as well as review the phenotype and severity of DSILI. Natural remedies related to hepatotoxicity can be divided into herbal product-induced liver injury and DS-induced liver injury. In this article, we describe different DS associated with liver injury, some of them manufactured DS containing several ingredients (Herbalife™ products, Hydroxycut™, LipoKinetix™, UCP-1 and OxyELITE™) while others have a single ingredient (green tea extract, linoleic acid, usnic acid, 1,3-Dimethylamylamine, vitamin A, Garcinia cambogia and ma huang).

  • Founder of Metabolife International, Inc. Sentenced
NEWS RELEASE OFFICE OF THE UNITED STATES ATTORNEY SOUTHERN DISTRICT OF CALIFORNIA San Diego, California For Further Information, Contact: Assistant U. S. Attorney Phillip L.B. Halpern (619) 557-5165 or Assistant U.S. Attorney Kyle W. Hoffman (619) 557-6157 For Immediate Release NEWS RELEASE SUMMARY - June 9, 2008 The United States Attorney’s Office announced today that Michael J. Ellis, the founder and former president of San Diego-based corporation Metabolife International, Inc., was sentenced today by United States District Judge Napoleon A. Jones, Jr. to serve six months in custody and pay a fine of $20,000. The sentence was imposed after Ellis pled guilty to the offense of making false statements to the Food and Drug Administration (“FDA”). According to court records, in April 1998 and February 1999, Ellis and his corporation sent letters to the FDA stating that Metabolife had “never received a notice from a consumer that any serious adverse health event has occurred because of the ingestion of Metabolife 356” and that Metabolife had a “claims - free history.” Metabolife’s own documents, however, demonstrated that Metabolife had received reports of seizures, heart attacks, strokes, losses of consciousness and other serious adverse health events -- often resulting in hospitalizations. At the time Ellis and Metabolife submitted these false representations to the FDA, the FDA was considering whether to regulate ephedra products more stringently. In particular, in1997, the FDA proposed a rule that would have banned the sale of products containing 8 mg or more of ephedrine alkaloids and would have required stricter labeling of other ephedra supplements.
