121. MINUTES OF THE MEETING HELD ON 10TH JANUARY 2018

The minutes of the Meeting held on 10th January 2018 were taken as read and the Chairman was authorised to sign them.

122. VACANCIES ON PARISH COUNCIL FOLLOWING ELECTIONS

The Chairman advised that there were still 2 vacancies. Two parishioners had come forward interested in the position, Sarah Chilvers from Stonehill Road and Brian Perry from . Sarah Chilvers could not attend tonight’s meeting so will attend the May meeting. Mr Perry gave a brief summary of why he wanted to join the Parish Council. Cllr. Wallace proposed that Mr Perry be co-opted onto the Parish Council which was seconded by Cllr. Pavitt. All in favour.

The Chairman advised that the grant would be paid once the works had been completed. e) Review pitch hire charges for 2018/19.

The Chairman gave details of the figures he had prepared and which recommended the following charges be considered:-

Football £50.00 per match Cricket Senior £57.00 per match Cricket Colts £39.00 per match

Acceptance of these figures was Proposed by Cllr. Wallace. Seconded by Cllr. Page. All in favour. f) Clerk’s salary - To be reviewed in May. g) Any Other – The Chairman advised that all invoices issued for pitch hire had been paid.

129. PLANNING MATTERS & APPLICATIONS

a) 47 GREEN LANE – Proposed front porch, two and single storey rear and side extension. No Objection APPROVED. b) LAND AT 48 ST. MICHAELS DRIVE – Part-retrospective amendments to previously approved permission 16/00243/FUL to include two dormer windows and a rooflight to the front of roof pitch, a rear dormer window, and a ground floor side window. No Objections. No Decision Yet. c) LAND AT TIFFANYS, BISHOPS STORTFORD ROAD – Demolition of two existing buildings and construction of three new dwellings. No Objections. APPROVED. d) LAND ADJACENT TO TIGGERS, BISHOPS STORTFORD ROAD – Proposed detached 4 bed dwelling and two new vehicular crossovers. No Objections. REFUSED. e) LAND ADJACENT BROADACRES, VICARAGE ROAD – Proposed new single storey bungalow. The following comments/observations are made by Roxwell Parish Council. ARBTECH -BAT SURVEY – was carried out during October 2017.

Point 4.2 Evaluation -B1 & B2 states that three bat emergence/re-entry surveys are required during the bats active season which is May -September). Therefore this survey is of no value to the application at this point in time.

The site in general, having in the past been an orchard in a countryside location is surrounded by well substantiated trees/bushes and hedgerows, offering good habitats for wild birds and insects.

Although there are no watercourses on the site, it should be noted that during exceptional wet weather Vicarage Road from the bridge close by the Hare PH, and Thatchers Farm can flood, and at times it can be too deep for motor vehicles to drive through.

The proposed development is very loosely covered by policies DC12 & DC 23.

The design of the proposed property is not in keeping with the current properties within the Parish of Roxwell.

The proposed entrance onto Vicarage Road is going to be hazardous as this Road is subject to a current maximum speed limit of 60 mph, with no pathway for pedestrians.

Technical Notes

2.0 Development proposals.

Point 2.2 – Although existing is listed as industrial the usage by the previous owner was very ad-hoc, as for many years no known works had been carried out on the premises, it has been used more as a storage facility for dysfunctional machinery. Vehicles movements were very few and far between, and certainly did not reach the figures offered in this application.

With reference to the appeal decision (for properties in Northumberland) put forward as part of the application it bears no relevance to this site in the Parish of Roxwell.

This proposed development cannot in my view be classed as sustainable.

With the facts presented in this application I strongly object to this application being granted permission. Cllr.C.Pavitt -1st January 2018

Pp7 -Refers to 5 bus services running from the village to Chelmsford on an hourly basis between the hours of 7.30 – 18.30, in support of their claim and argument that this is a sustainable development.

The current timetable for the 46 bus service run by the present operator show 6 services throughout the day, these are not on an hourly basis.

The ‘ Context Analysis & Design Principle makes a number of statements regarding local build architecture that have no bearing to that within the village, and is highlighted by the image

Of a supposed existing house in Roxwell pp9 that does not exist.

The design is not in keeping with its surroundings or building design within the Parish of Roxwell.

The NPPF review the and use of the Northumberland Planning Appeal has no similarities to this application as it is an urban context.

The bat survey has been put together using details from visual inspections only, and as stated 2 surveys are required during their active season.

I therefore object to this application. Cllr.M.Page 8th January 2018

This application contains many, of what can be considered to be incorrect statements and facts.

The bat surveys carried out are inadequate, as highlighted in previous comments offered.

B1 states the destruction of the existing buildings could result in death/injury of bats.

The proposed access point is of concern due to the lack of visibility available for vehicles on Vicarage Road and those exiting the site.

The design and materials to be used do not conform to the other properties in the surrounding area.

I therefore object to this application. Cllr.M.Plom 9th January 2018. APPLICATION WITHDRAWN.

f) 2 VICARAGE CLOSE - T1 Sycamore - Rear garden - Fell to ground level. Reason: Has not responded to pollarding, has bark coming of and rotting at the top - see 07/05263/TPO. T3 Pine - Rear garden - Fell to ground level. Reason: Storm damaged, in decline. T4 & T6 Lime - 5 year management plan to annually remove epicormic growth. Renewal of 07/05148/TPO. Replacement planting is required under TPO. APPROVED. g) 4 VICARAGE CLOSE - T1 Pine - Fell to ground level. Reason: Health and Safety - number of limbs shed due to damage caused by snow. Remove damaged branches to make safe. APPROVED. h) BARN 17, BOYTON HALL FARM, – Construction of steel framed portal building for storage of potato boxes. No Objections. No Decision Yet. i) THE COTTAGE, BOYTON CROSS – Proposed drop kerb access. No Objections. APPROVED. j) LITTLE BOYTON HALL, BOYTON HALL LANE - Construction of a new warehouse building for the purposes of Storage/Distribution and Business uses (Use classes B1, B2, and B8). No Objections. No Decision Yet. k) LAND AT BARN 3 MOUNTNEYS, ELM LANE – Construction of stable block with tack room and hay store. No Objections. No Decision Yet. l) ROXWELL QUARRY COMPLEX, BOYTON CROSS - For continuation of development permitted by planning permission ESS/05/15/CHL without compliance with conditions 2, 3, 15 to allow the restoration of Area Z, the Former Plant Site and Brittons Hall Farm Landfill Site to be completed by 31 December 2019. ESS/05/15/CHL was for the following development ‘the modification to the restoration profile and the restoration scheme for the non-hazardous landfill arising from overtipping of approx. 85,250 cubic metres (part retrospective). Enhanced restoration of a former landfilling area by the importation of inert materials and biosolids to enable agricultural after-use and restoration scheme for the former mineral processing plant site to woodland, nature conservation and agricultural after-uses (including retention of hardstanding and workshop). All to be completed by 31 December 2015. No Objections. 130. RECREATION FIELD/TODDLER PLAYAREA a)Renewal of Grass Cutting Quotes – Minute 108 – The Chairman advised that the Toddlers Play Area remained unchanged at £22.50per cut. Chairman to confirm to Evans Garden Maintenance that this quote is accepted. M.D. Landscapes had quoted £55.00 per cut, spiking field £110 and hedge cutting £175 for a three year quotation from 2018 – 2020. D.W. Maintenance had quoted £60.00 per attendance for grass cutting but they would have to hire in the spiking and hedge cutting equipment. The Chairman felt that the Parish Council had use M.D. Landscapes for many years and they had always been happy with his work. The Chairman therefore proposed renewing the contract with M.D. Landscapes which was seconded by Cllr. Wallace. All in favour. b) Any Other – The Chairman advised that the Play Area inspections would be carried out in May/June.

The Chairman reported that a survey from English Rural had been sent out with the Roxwell Recorder. 19 forms had been returned out of 500. It was agreed that the Chairman and Cllr. Wallace should liaise with English Rural, RCCE and CCC to go through the final documents when available.

Chairman to chase matter with Highways.

134. HORSES DEAD SLOW, HORSES CROSSING SIGN IS NEEDED BY LIGHTFOOT1S FARM ON THE APPROACH FROM WILLINGALE ON SKREENS PARK ROAD – Minute 4,48,70,93 & 113.

The Chairman advised that the village gateway would include this. If Highways cannot do the work then the Parish Council will look into having gateways erected themselves.

135. VILLAGE GATEWAY APPLICATION TO LOCAL HIGHWAY PANEL – LCHE 172013 – Minute 52,72,94 & 114.

The Chairman had contacted Jon Simmons at ECC who advised he was waiting on the Local Highways Panel scheme validation. Chairman and Cllr. Wallace to walk around village and look at best places for erecting gateways.

136. DRAINAGE ON CORNER OF THE STREET/VICARAGE ROAD BY WARWICKS – Minute 74,96 & 116.

Nothing to report. Clerk to remove item from the Agenda.

137. GREEN LANE RESURFACING – Minute 117.

The Chairman advised that Highways are due to come back anytime to redress and remark the junction.

138. DEFIBRILLATORS – Minute 78 & 118.

Cllrs. Bradbury, Wallace and Parishioner Mike Prowse had a meeting. Cllr. Bradbury had spoken to Community Heartbeat Trust who had sent lots of paperwork. There are three ways to get a defibrillator, lease, buy outright or a managed solution whereby Heartbeat Trust deal with everything including training, replacing defibrillator if damaged or faulty. It is a 4 year contract which Cllr. Bradbury felt was the ideal solution. Cllr. Bradbury thought people and the village should be advised and see how many would be interested in training. Cllr. Bradbury advised that a minimum of 6 -8 volunteers are needed. It was agreed that Cllr. Bradbury would write a brief article for the Roxwell Recorder. Lots of villages have applied to the National Lottery and been successful. The grant pays for everything including the training. The cost would be £1,500 - £2,000 if the Parish Council do it themselves without training. Cllr. Wallace advised that Cllr. Bradbury had done a tremendous job and on his own.

139. TRAFFIC ATC – VICARAGE ROAD

The Chairman advised that a speed survey had been carried out between 30th January and 5th February 2018. The results showed a mean average speed of 39.5mph Eastbound, and 39.8mph Westbound from a daily average volume of traffic of 802 Eastbound and 818 Westbound. These results were well within the current speed limit in force of 60mph. Should a scheme be put forward to the Local Highway Panel to consider lowering the current limit, he advised it would very unlikely a scheme would be approved.

140. PARKING RESTRICTIONS AROUND ROXWELL SCHOOL

The Chairman advised that the consultation ends on 16th March 2018 for new parking restrictions around the school The Chairman suggested extending on the Northern side opposite Glynn Eastman’s house. Chairman to submit comments. The Chairman advised that there would be some no waiting anytime and some restricted waiting times. Glynn Eastman said parents can park in the Memorial Hall car park and parents have been informed about this on numerous occasions.

141. SPECIAL CONSTABLES - Minute 104.

The Chairman advised that this scheme is on hold at the moment due to some technical problems. The Police will come back to the Parish Council once it has been resolved.

142. 2018 LITTER PICK – 14TH APRIL 2018

The litter pick had been arranged for 14th April 2018. Hugh Dibben is liaising with people to come along. The Parish Council had donated £50.00 in previous years towards refreshments. It was agreed to donate the same again this year.

143. DATA PROTECTION OFFICER

The Chairman advised that on 25th May 2018 officially every Council, including City, County and Parish Councils have to be registered with the ICO (Independent Commissioners Office) and also have an elected Data Protection Officer. The Chairman had reviewed what data the Parish Council have. Cllr. Goodwin advised that she could assist with helping set it up and will only continue for as long as her health allows. It was therefore agreed that Cllr. Goodwin be elected as Data Protection Officer at May meeting. The Chairman and Cllr. Goodwin would meet to prepare details for the May 2018 meeting.
