CLOSURE ORDER WITH DISCONNECTION OF ELECTRICITY

WHEREAS a complaint petition was received by the West Bengal Pollution Control Board (hereinafter will be referred to as the `State Board'), on 25­01­2011, 27­07­2011, 29­08­2011 and 24­07­2012 and again on 11­06­2013 against a Sweet Manufacturing Unit namely M/s New Sundari Sweets, located at DD­121, Narayan Tala East, Aswininagar, P.S. Baguiati, Kolkata­700 059 allegedly causing air pollution due to manufacturing of sweets and snacks in the kitchen with diesel oven and noise pollution due to running of DG set. . AND WHEREAS inspection of the said unit was conducted by the State Board official on 28­ 04­2011 and it was observed during inspection that the unit had 5(five) diesel oven and 2(two) gas fired oven without having any fume extraction system. The unit uses 1(one) DG set of capacity 10KVA without having acoustic enclosure, silencer etc. The said unit had obtained Consent to Establish(NOC) of State Board at the time of inspection.

AND WHEREAS the unit was called for hearing on 06­05­2011 by the State Board to remain present with all statutory licenses, including ‘Consent to Establish/Consent to Operate’ of the State Board and Sri Samir Bagui appeared on behalf of the unit. The unit was directed to apply for Consent To Operate of the State Board immediately and remove the DG set in question within seven days.

AND WHEREAS the unit was called for hearing again on 31­08­2012 for its gross violation of environmental norms and Sri Samir Bagui appeared on behalf of the unit and failed to produce valid ‘Çonsent To Operate’ of the State Board.

AND WHEREAS the unit was called for hearing once again on 26­07­2013 and Sri Samir Bagui appeared on behalf of the unit. The unit submitted a copy of the current trade license which stated the trade as ‘Sweet Seller’.

NOW THEREFORE, considering the total non­compliant attitude on the part of the unit in complying with the environmental statute, that M/s New Sundari Sweets(Prop. Samir Bagui) is hereby directed to close all kinds of sweet manufacturing operations at the present location with immediate effect

Electricity connection of the said unit is ordered to be disconnected forthwith. The General Manager­Operation (C&M), CESC Ltd., is requested to take necessary steps to disconnect the electricity connections of the unit immediately.

Closure order will take immediate effect and the Inspector­in­Charge, Baguiati Police Station, under Bidhannagar Police Commissionerate is requested to execute the closure order against the aforementioned unit and submit the compliance report to the State Board within seven days from the receipt of this memo.

This direction has been issued to the Inspector­in­Charge, Baguiati Police Station and the General Manager­Operation (C&M), CESC Ltd., in conformity with the orders of the Hon'ble High Court, Calcutta, dated 21­08­1998 and 28­04­1999 respectively. ­2­

The Environmental Engineer, Salt Lake Regional Office of the State Board is requested to take necessary steps for proper execution of the closure order and ensure the disconnection of electricity of the said unit. He is also requested to visit the unit involving the local police authority, if situation demands.

This direction has been issued in exercise of the powers conferred under the Water (Prevention & Control of Pollution) Act, 1974, the Air (Prevention & Control of Pollution) Act, 1981 and the Environment (Protection) Act, 1986 and Rules made thereunder.

This order has the approval of the Competent Authority.
