8.20.010 Definitions. For the purposcsof this chapterthc following words and phrascsshall havethe rneaningsrespectlully ascribcdto them, unlcssit shall appearfiour the contextthat thcy havc a diffcrcnt nrcaning.Words and phrasesnot ascribcda meaningby this chaptcrshall havc the rneaningascribed by Division 30. "Act" meansthe CaliforniaIntegratcd Waste Management Act of 1989,as may be arnendedin the Public ResourcesCode Scction40000 et scq. and implcrncntingrcgulations of tlre Calilbrnia IntegratedWastc ManagementBoard. "Balilg" mcansthe processof compactingby prcssurcresulting in a hornogenousmass of like composi- tionbound together by strapsor wirc. "Bin" meanscontainers, whether residential, multi-family residential, commcrcial, industrial, or institu- tional,provided for temporaryaccumulation and collectionof solid wastefor removalfrom all premisesIo- catedwithin the city. Bins includebut arenot limitedto, solid wastecontainers with capacityof at leastonc cubicyard androll-off type servicecontainers. "City" meansthe city of Industryand all of the territorylying within the municipalboundaries of the city aspresently existing, including all federalfacilities and all geographicareas which may be addedor annexed to the city. "City rnanager"means an individualhaving the title in the employof the city or the city manager'sau- thorizeddesignee. "Collection"means the act of collectingsolid waste, at or nearthe placeof generationor accumulation.

"Collection vehicle" meansthe vehicle utilized in the collection,transportation, storage, transfer, or processingof solid wasteor recyclablesolid waste. "Collector"means a solid wastecollector with a writtenfranchise, contract or pennit for the collectionof solid waste,issued as setforth in this chapter,including salvaging or salvagecollecting. "Commercialcollection" means the regularlyscheduled removal of solid wastc from commercialprop- erty by the city's authorizedfranchisee. "Commercialpropcrty" means non-residential unit including,but not limited to, a placeof business,ho- tel, restaurant,office building, shop, storc, hospital,auto court, industrialpropcrty, including a placc of manufacture,production or fabrication,warehouse, and residentialunits containing five or rlorc family resi- dcntialunits. "Commcrcialsolid waste"means solid wastc gencratcd by commercialunits. "Construction"mcans thc buildingof any facility or structureor any portionthereof inclucling any tenant improvemcntor rcnovationto an cxistingfacility or structure. "Constructionand demolitiondebris" rneans bricks, stoncs, rnortar, concrete. asphaltic concrete, wood, or other dcbris includinguscd or discardedmaterials removed fiorn prcmiscsduring construction,rcnova- tion,remodeling, repair, or dernolitionoperations including thc dcmolitionof buildingsor structurcs. "Curbsidecollcction" rncansthc rcgularly scheduledcollection of solid wastc from bins as spccified hcrcin. "Deconstruction"mcans to disasscmblcany facility, structureor building,whcthcr in whole or in part, whetherintcrior or cxterior,picce by picccin ordcrto salvagethe parts. "Dcmolition"means the disserninating,razing, ruining, tcaring down or wreckingof any facility,struc- turc,pavement or building,whcther in wholeor in part,whether intcrior or cxtcriorincluding, but not lirn- ited to soft demolitionsuch as that associated with remodelingor the replacemcntof roofs. "Franchise"means the right of a personor entityto makearrangcmcnts for the collectionand transporta- tion of solid wastc,recyclable material and recyclablcsolid wasteto landfills,transforrnation facilities, ma- terialrecovery fircility or other licensedsolid wastcmanagement facilities, and/or the ability to extricatere- cyclablcmaterial from all solidwaste including recyclable solid waste and . or compostingtnate-- rial. "Franchisefee" meansthc fcc or asscssmcntimposed by the city on a collectorbecausc of its statusas a collector: "Creen waste"means leaves, grass clippings, brush, branches and other forms of organicmattcr gencr- atedfrom landscapesand gardensand incidentalpieces of untrcatcdand unpaintedscrap lurnber no longcr than twenty-fourinches and containingno metal objects,separated from other forms of solid waste.Green wastealso includesholiday treesfrom which all tinsel,flock, baseattachments and ornamentshave been removed.Green waste does not includestumps or branchesexceeding six inchesin diameteror two feet in length,palm fronds,yucca, food waste,manure, dirt, rocks,garbage or any otherform of solid wastewhich arenot suitablelor composting. "Hazardouswaste" means(a) all wastedefined or characterizedas hazardouswaste by the Resource Conservationand RecoveryAct of 1916(42 U.S.C.Section 6901 et seq.)in 42 U.S.C.Section 6903 (5) as amendedfrom time to time, and all implementingregulations, (b) all wastedefined or characterizedas a hazardoussubstance pursuant to the provisionsof the ComprehensiveEnvironmental Response, Compensa- tion and Liability Act,42 U.S.C.Section 9601 et seq.("CERCLA" or "Superfund"),as in 42 U.S.C.Section 9601(14), may be amendedfrom time to time,and all implementingregulations, and (c) allwastedefined or characterizedas hazardouswaste by agenciesof the stateof California(including without limitationsthe Departmentof HealthServices, the Departmentof Toxic SubstancesControl and the CaliforniaIntegrated

WasteManagement Board) having jurisdiction over solid and hazardouswaste. The term "hazardouswaste" means,in additionto any substance.included in any of the foregoingcategories, those substances which are not normally pcrrnittedto be disposcdof by generallyaccepted, sanitary landfill disposalmethods, but which may be containedin solidwaste streams. In the eventof a conflict in the definitionsemployed by two or more governmentalagencies having concurrentor overlappingjurisdiction over hazardouswaste, the broader,more encompassing dcfinition shall apply. "Permittee"means any individual,partnership, joint venture,unincorporated privatc organization or pri- vatecorporation who hasbeen issued a permitby the city to conductsalvage and recyclingactivities as well asthose permits issucd to salvagcgcncrators. "Person"mcans any individual,partnership, joint vcnture,unincorporated privatc organization. or private corporation. "Redeemablematerial" means a rnaterialwhich hascommercial value and which is sold or donatedto an entityotherthan a solidwastccollcctor. Rcdccmablc materials are commodities and arc not partof thesolid wastcstrcam. Redeemable rnaterials lose the ir charactcras rcdccmablcmatcrials upon bcing disposcdof in thcwastestreamandbecomcsolidwastesubjecttothischapter.lf thesellerordonorof redeemablernatcrial pays thc buyer or donee,including any solid wastecollcctor, any considcrationfbr collecting,proccssing, rccycling,transporting or disposingof "redeemablernaterial" or for providingconsultation or otherscrviccs, the transactionshall not bc rcgardcdas a salcor donationof "redeemablernaterial", but as an arrangel-nent fbr thc disposalof solid wastesubject to this chapter.Redeernable rnatcrial shall be deernedto be contami- natcdif the containerinto which is hasbeen placed contains more thanone pcrccntnonrecyclable rnaterial, or any amountof hazardouswaste. "Rccyclablcmatcrial" means matcrial which hasbccn scparatcdby a solid wasteservicc rccipicnt fronl otherforms of solid wastcbcforc having bccn disposcd of into thc wastestream. "Recyclablc matcrial" is a part of the solid wastestrealn which can be reusedor processedinto a form suitablefbr reusethrough re- proccssingor remanufacture,consistent with the requirernentsolthe act.Rccyclable material shall be scgrc- gatedfiom othcr wastc rnatcrialand is sourcc-scparatcdsinglc-catcgory recyclable matcrial. "Rccyclablc rnaterial"does not includcthosc potcntially rccovcrablc itcms which are commingledwith non-rccyclablc solid wastc.Rccyclable material shall be deemedto be contarninatcdif thc containerinto which it hasbccn placedcontains morc thanone pcrccnt non-recyclablc solid wastc,or any amountof hazardouswastc. "Recyclablernatcrial bins" mcansa bin, vessel,can, cart or othcr receptacleused for accumulatingand collectingrecyclablc matcrial. "Rccyclc or rccycling" meansthe processof collecting,sorting, clcansing, trcating, and reconstituting sourceseparated singlc-category materials that would otherwisebecomc solid wasteand returningthem to the cconomicmainstream in the fonn of raw material.reused. or reconstitutednroducts which meetthe oual- ity standardsnecessary to bc uscdin thc markctplacc. "Refuse"means solid waste. "Residentialproperty" means every lot in the city upon which is situatedone or morebut not more than four dwelling units includingplanned development projects and any otherparcel which hasbeen improved with a so-called"duplex" or "triplex" residentialdwelling unit designatedand usedas living quartersby human beings.Residential units shall not includehotels, motels, lodge halls, clubs,tourist camps,trailer camps,churches, commercial and industrialestablishments, or any other lot containingmore than four dwellingunits or uponwhich commercialor industrialoccupation is conducted. "Salvage"means refuse for which a permit to treatas salvagehas been obtained under this chapterand which includesrecyclable material. Salvage is sourceseparate single-category recyclable material.

"Salvagecollector" means any individual,partnership. joint venture,unincorporated private organiza- tion, or privatecorporation regularly engaged in the businessof providingsalvage collection services includ- ing thosewho usethird partyhaulers. "Salvagegenerator" rneans any individual,partnership. joint venture,unincorporated private organization or corporationwhich created,accumulates, imports or causesto be irnportcdinto the city salvagewhich is soldor givento a salvagecollector. "Salvaging"or "salvagecollecting" means the controllcdremoval, collcction, accumulation, baling or transportationof salvagefor utilization. "Scavenging"Incans the unauthorizedrernoval of rccyclablematcrial or any othcr comrnoditydesig- natedby thc city to haverecyclable propcrties or value by any person,individual, business, or solid wastc cntity othcrthan those authorizcd by thc city or establishedin accordancewith this chapter. "Self-haulcr"means any individual,partnership, joint venture,unincorporated privatc organization, or privatecorporation engaged in salvagingwhich it crcates,accumulates, irnports or causesto bc irnportcd intothc city. "Solid wastc"mcans non sourceseparated or comminglcdmatcrial including, but not limitcdto: | . All putresciblcand nonputrescible solid and sernisolid waste; 2. Garbagc; 3. Trash; 4. Rcfusc; 5. Papcr(including atl formsof papcrproducts, shredded documents and cardboard)l 6. Rubbish; l. Ashes: 8. Industrialwastcs, 9. Demolitionand construction : 10. Abandonedvehicle parts; I l. Discardcdhome and industrial applianccs; 12. Dewatered,trcatcd or chernicallylixed sewagcsludgc which is not hazardouswaste, ll. Manure:and 14. Vegetablcoranimalsolid and sernisolid wastcs and otherdiscarded solid and sernisolid wastes. Solid wastcdocs not includehazardous waste, radioactive waste or medicalwaste. As usedin this chap- ter, the term solid wasteincludes grecn waste and recyclablesolid waste,as wcll as wastcgcneratcd by dc- constructionand demolition. "Solid wastecollection services" means the collection,transportation, storage, transfer, or processingof solidwastc or recyclablesolid waste fbr residential,commercial, industrial, or institutionaluser(s), custonr- ers,patrons, or residents. "Solid wastecollcctor" means any individual,partnership, joint venture,unincorporated private organi- zation,or privatecorporation regularly engaged in the businessof providingsolid wastecollection services or recyclingservices. "Speciafwaste" shall mean an item or elementof solid wasteidentified in 22 CalifomiaCode of Regula- tionsSections6626l.l20.6626l.l22,or any otherwaste which has been classified as special waste by reso- lution of the city council. "Third party hauler"means any commercialcarrier or commoncarrier who transportssalvage or recy- clablematerial at the direction,request or hiring of a salvagecollector. "Vehicle" meansany truck, trailer.or otherconveyance or equipmentused to collect,haul or transport solid waste,, recyclable material, or recyclablesolid waste. (Ord. 686 $ I (part),2002)

8.20.020 Policy. The city councilfinds and detennines that the storage,accumulation, collection and disposal of commcr- cial solid waste.construction, dernolition and deconstructionwaste, green waste, hazardous wastc, refuse, solid wasteand other discardedmatter is of greatpublic concern,in that impropercontrol of suchmatters may crcatca public nuisance,or leadto air pollution,fire hazards,insect breeding, rat infestationand other problernsaffecting the health,welfare and safetyof the rcsidentsof this and surroundingcities. The city council further finds that the periodiccollection of commercialsolid waste,construction. dcmolition and deconstructionwaste, green waste, hazardous waste, refuse, solid wasteand otherdiscarded matter from all rcsidentialand commercialpropcrtics within the city and that the lettingof one exclusivefranchisc as well as salvageand otherpermits, by the city for suchcollection will providethe mostorderly and efficicntsolu- tion to suchproblcms and promote the public health,safety and welfarc and to providefor accuraternonitor- ing for compliancewith the act.(Ord. 686 $ l (part),2002)

8.20.030 Authorizationrequired to collect. No pcrson,collector, or salvagecollector shall engage in thc collection.caring, conveyance, salvage or transportationof any solid wasteor recyclablematerial from or at any locationwithin the limits of the city, withoutthe cxprcss writtcn consent of thecity councilby meansof a franchiscor pcnnitgranted by thecity councilor, whereauthorized, the city rlanagcr,pursuant to this chapteror other provisionssct fbrth in thc city of IndustryMunicipal Code. 8.20.040 Solidwastc collcction required. h,veryowner or occupantof any prcmisesin the city shalldispose of the solid wastethrough the rcgular solid wastecollection service of thc collcctor,and shallpay therefbrethe rateor ratesset by the city a corn- ponentof which ratc shall be appliedto the solid wastc rccovcryfund. Evcry owncr or occupantof any prcrnisesin thc city shallmaintain, at rninimum,a bin of not lcssthan two cubicyards with collectionser- vicc occurringnot lessthan onc tirnc pcr wcck. Arrangementswith the collectorshall be rnadeby eachsuch owncr or occupantfor the requircdcollcction of solid waste,and sucharrangements shall specilythc loca- tion ol'the prerniscs,solid wastcbin typcsand sizes,and the fiequencyof collcction.The ownerof a single- larnilydwelling or rnulti-familydwelling of not morethan fbur units,must by prioragreement with thc col- lectorand with the occupantsof suchdwcllings arrange lor the individual,joint, or comrnunaluse of solid wastebins thereon. 8.20.050 Accumulationunlawful-Abatement. It is unlawfuland dcclared to be a public nuisanccfor any owncror occupantof a rcsidcntialor corrrncr- cial premisesto permitthe accumulationof solid wasteto becomeor remainoffensive, unsightly, or unsaf-e to public healthor createsa fire hazard,or to deposit,keep, or accumulate,or permit,or causeany solid wasteto be deposited,kept, or accumulatcdupon any lot or parcelof land,or any public or privateplace, street,lane, alley, or driveway,except as providedin this chapter.The city manageror authorizeddesignee may takeaction to abatethe nuisancepursuant to the proceduresset forlh in this code.(Ord. 686 $ I (part), 2002)

Article ll. SolidWaste Fees, Franchises and Permits

8.20.060 Exclusivefranchise. The city may, from time to time, enterinto an exclusivefranchise agreement with a collectorregarding the collectionof solid wastefrom residentialand commercialproperty. The collector,under the franchise agreement,shall be allowedto conductsalvaging and the collectoris deemedto be in compliancewith Sec- tions8.20.370, 8.20.380, 8.20.390 and 8.20.400.Howcver, with respectto salvagingonly, the rightsof the collectorshall not be exclusive.So long as the franchiseagreement remains in force,collection of thc matc- rial providedfor in this chaptermay be madeonly by suchcollcctor in accordancewith the tennsand condi- tions of this chapterand thc franchiseagreement. The chargesfor suchcollection of solid wastc,including removaland disposalserviccs shall be thoscagreed upon between such collector and thc pcrsonutilizing the scrvicc;provided, however, that such charges shall not bc greaterthan the ratespermitted by the tennsof thc franchiseagreemcnt between thc city and the collcctor.No personother thanthe city or thc collcctorshall collect,rcmovc or disposcof any solid wastcwithin the city, nor transportthe sameover any pLrblicstreets or highwayswithin the city. All rccyclingand salvagcactivities not otherwisegoverned by the termsof thc exclusivclranchise agrccment shall bc conductedonly pursuantto this chapter.(Ord. 6tt6 $ | (part),2002)

8.20.070 Collectionof solid wasterestricted to collector. It is unlawful for any personother than thc collcctoror thosepersons employcd by thc collcctorto col- lcctor haulany solid waste within the city exccpt: A. Sourccseparatcd single-category rccyclable materials, including but not limitcd to thosecollected by a pcrsonunder pcrmit by the city as providedin Scction8.20.370 of this chapter.Loads which consistof sourccscparated singlc category rccyclables comrningled with any residualsolid wasteshall not bc consid- eredsource scparated rccyclables; B. GreenWaste (a) rcrnovedfrom a prcmisesby a contractoras an incidcntalpart of a total landscap- ing or gardeningscrvice off-ered by that contractor,and loadedinto a fixcd body vehicle,rather than as a separatclycontractcd or subcontractcdhauling servicc using debrisboxes or similar apparatus;or (b) di- rcctly loadedonto a fixed body vehiclesuch as a "chipperand truck" and hauleddirectly to a transf-erstation or disposalfacility; C. Anirnalwaste and rcmains from slaughtcrhousesand butchcr shops, or greasewaste; D. Specialwaste; E. Hazardouswastc. (Ord. 686 S I (part),2002)

8.20.080 Franchise-Terms. Any franchiseentered into or issuedby the city shall regulatcthe dutiesimposed upon thc collcctoras wellas the ratesto be charged.Without limiting the scopeof the foregoingregulatory power, in general,said regulationsshall control: A. The maximumrates to be chargedand the time of billing; B. The mannerin which the work of solidwaste collection shall be performed; C. The conditionand maintenance of the equipmentused by the collector; D. The hourswithin which suchcollection work may be performed; E. The securityand insurance which the collectorshall provide to the city; F. Any otheritems which the city councildeems to be necessaryfor the bestinterest of the city and its residentsand ownersoroccupants of propertytherein. (Ord.686 $ I (part),2002)

8.20.090 Collector-Compliance with all laws. The collectorshall comply with the provisionsof this chapterand any and all applicablesections of the city of IndustryMunicipal Code, Public Resources Code or any othcr local,statc or federalcode having ju- risdiction.The collectorshall be requiredto cooperatewith the city in solid wastegeneration studies, prcpa- rationof wastcstrcarn audits and the subrnissionof infonnationrequired by the city to meetthe reporting requirementsof the act or otherapplicable legislation as may be amendcdfrom tirneto time. and to irnple- lnent rreasuresconsistent with the city's sourcereduction and recyclingelement and houscholdhazardous wastcelernent in orderfor the city to reachthe mandateddiversion and othergoals as establishcdby thc act as it may bc amendedfrom time to time. The collcctorshall subrnit to the city monthlyrcports which show the numberof tonscollected and the tonnagcde livcrcd to disposalfacilities, itemizcd by disposalfacility. Ord. 686 $ I (part),2002)

8.20.100 Flow control. The city reserveswhatcvcr, if any, right it may receivefrom local,state or federalauthoritics to cxercisc "flow control",i.c., thc rightto selectdisposal f-acilities and materials rccovcry facilities to whichthe solid wastecollected pursuant to thc franchiscis taken.In the eventthat the city directscollector to transportsolid wasteto a particulardisposal f-acility or materialsrecovery facility, city and collectoragree to usetheir best effortsto obtain indernnificationagainst CERCLA Supcrfundand relatedclaims frorn thc opcratorof thc disposalfacility or matcrialsrecovery facility to which solid wastccollcctcd pursuant to the franchiseis takenfbr disposalor materialsrecovery. In the eventthat thc city rcquircscollcctor to utilizca disposalfacil- ity or matcrialsrccovcry lacility not owncd or opcratcdby collcctoror an affiliatc of collcctorpursuant to thisprovision, the city shallindcrnnily and hold harmlesscollector for deliveringsolid wastc to. the dcsig- nateddisposal facility or materialsrccovcry lacility. In the eventthat the city selectsa transferor disposal facility pursuantto this provision.collector shall be entitledto a ratc adjustmcntto offlet fbr any substanti- atcdincrease in cxpcnscsrcsulting from the city's exerciseof "flow control".(Ord. 686 $ I (part),2002)

8.20.110 Existingfianchise-Continuedeffcct. Any lianchisewhich is in cffcct on the dateof the ordinanceenacting this chaptershall remainin full forceand ef-fectthrough the durationof thc respectivefianchise. A franchiseeshall comply with the provi- sionsof this chapterso long as the rcquircmentsset forth for cornpliancedo not conflict with any current lranchiscagreement or the constitutionallyprotected rights provided fbr underany existingfranchise agree- mcnt. The provisionsof this chaptcrin no way confinn, modify or cxtcndcxisting contractual agrccrncnts. (Ord. 686 $ I (part),2002)

8.20.120 Franchisefees. The collectorshall be requiredto pay a franchisefee in an amountand underterms and conditionsas set forlh in the franchiseagreement. (Ord. 686 S I (part),2002)

8.20.130 Costrecovery special fund. The collectorshall be requiredto includea line item chargeon its regularbilling invoiceas a fee based on volumefor purposesof establishinga "Cost RecoverySpecial Fund" pursuantto the act.The arnountof the fee shallbe determinedby the city manager.Funds deposited into the Cost RecoverySpecial Fund shall be usedand appliedto pay for costsassociated with the preparation,adoption and implementationof the city's sourcereduction and recyclingelement. Any and all such feesshall be paid monthly in accordance

All ownersor occupantsof residentialor commercialpremises and all personsand entiticsinvolved in deconstruction,demolition and constructionwithin the city are requiredunder this chapterto arrangefor solid wastecollection with the collectorand to keep readily accessibleto the collector,one or more bins providedby the collectorand of adequatesize and quantity,so as to be capableof holdingwithout spilling all solid wasteaccumulated on the residcntialand/or commcrcial prcmiscs betwccn thc time of two succes- sive collections.All solid wastegenerated or accumulatedon the residentialand/or cornmcrcial premises shallbe depositcdin saidapproved bins. 8.20.150 Placementof bins. All solid wasteto bc collcctcdshall be set out or nlacedbv the owner or occuDantof a residcntialor commercialpropcrty as follows:

ResidentialProperty: A. Whcrca residentialproperty is contiguousto a pavcdalley, all articlcsfor collcctionshall be setout or placcdat oneand the samelocation at thc allcy or propertylinc; B. Wherethe rcsidcntialproperty is not contiguousto a pavedalley, all articlesfor collectionshall bc setout or placedat onc andthe samelocation in the publicparkway or at the curbline; C. No solid wasteshall be set out for collectionexcept that which is accumulatedon thc rcsidcntial premisesfrom which the collectionis madc,by the ownersor occupantsof said premisesin thc useof the premises;

CommcrcialProperty: D. Eachowncr or occupantof a commercialpropcrty shall placc all solid wasteoriginating from such propertyin bins providedby the collector.Such bins shallbe placedat the rearof suchpropertics, or if the premisesare so situatedthat the collectoris unableto collectat suchlocation, then at the sidesof suchprop- ertiesif spaceis availableat suchlocation. Under no circumstancesshall the bins be pushedto the front of the propertyor curbsidefor pickup.Bins may be locatedwithin industrialproperties where necessary to ac- commodateplant operation.All solid wasteshall be placcdin suchbins and not upon or aroundthe same. Solid waste shall not be compactedin bins furnishedby the collectorby any mechanicalmeans without permissionof the collector.The owner or occupantof commercialor industrialproperty shall arrangewith the collectorfor as many collectionsper week as shall be necessary,but in no caseless than one time per week to removeall suchsolid wastefrom saidproperty as frequentlyas the bin becomesfilled. 8.20.160 Collectors'obligation. The collectorshall: A. Collect solid wastefrom every residentialproperty, commercial properly in the city with respectto which collectionarrangements are madeby the owner or occupantthereof;

Make collectionsof suchsolid wasteon the datesand betweenthe hoursspecified in the written fianchiseagreement with the city or in resolutionor ordinancefrom time to time adoptedby the city council, or in schedulesto be approvedby the city managerwhen the franchiseagreelnent so provides; C. Provideand maintainadequate equiprnent and vehiclesincluding standby vehicles with adequate capacityand provide all laborand services necessary to perfonnthe dutiesassumed by the collector; D. Providea collectionand disposalservice in sucha manncras to preventany leakageor droppingof garbageor refuseon privateproperty or uponthc strcets,ways andpublic places within the city; E. Maintainall of collector'scollcction equiprrrent in a unifonnlypainted condition with a Lrnifbnl colorschemc with the narneof thecollector and thc numbcrof thc truckor rnotorvehicle engagecl in collec- tions,in a mannerapproved by the city managcr; F. Disposepromptly of all garbageor refusein sanitarydumps or other disposalpoints approvcd by the governmentalagency having jurisdiction thereof; G. Providccontainers on castersof a size,shapc and constructionapprovcd by the city managerfor all rcsidcntial,industrial and corlrlcrcial propcrty occupanls utilizing collectors collcction scrviccs. H. Providcan officc and telephoneservicc al all tirncsbctwccn thc hoursof eighto'clock a.nr.and fbur o'clock p.m.,Monday through Friday. and eighto'clock a.m. to twelveo'clock noonon Saturdayto cnableprompt responsc to all callsand action upon all requestsand instructions pertaining to the collcction of solidwastc. I. Providcat collcctor'scxpcnse public liability and property damage insurance covering liability fbr not lessthan ten million dollarsfor personalinjurics including dcath of onc pcrson,ten million dollarson accottntof any onc accidcnt,and property darnagc of not lcssthan tcn million dollars.The cornpanyand pol- icy shallbc subjectto the approvalof thc city attorney,and a copy thereofshall be kcpt on filc in thc officc of thecity clerkat all timesduring the tcrms of collcctor'scontract. J. Deliverto thc city a goodand sulflcient surety bond in thc amountof fifty thousancldollars to se- curc thc full, true and taithful pcrforrnanceby the collectorof the provisionsof this chapterand ol'the tcnns of the franchiseagreement between collcctor and thc city. Suchbond shall be kept in full forcc and cffcct at all tirnesduring the termof the franchiseagrccrncnt and shall be subjectto the approvalof thc city attorney. K. In no eventshall thc collcctorcharge, collect or receiveany sumsin excessof the ratesapproved by thecity managcrfor collector'sserviccs undcr this chaptcr. (Ord. 686 S I (part).2002)

8.20.170 Collectionsystem. Thc collcctorshall providc fbr thc collcctionand disposalof solid wastefrom all residerrtizrlpropcrty within its assignedor designatedarea at leastonce each calendar week and from commercialproperties as providcdin the contractor franchisc.The city managershall have chargc and supervisionof suchcollection and removal,and shall approvethe routesand daysas proposedby the collectorfor thc collectionso as to confbrm to the provisionsof this chapter.When such routesand days of collectionare establishedor changed,the city managershall be givennotice thereof. 8.20.180 Collectionvehicles. Collectionvehicles used by collectorswithin thecity shallcomply with the requirementsof thissection and shall conformto the highestindustry standards and all provisionsof the CaliforniaVehicle Code. The city reservesthe right to inspector causethe inspectionof any collectionvehicles. (Ord. 686 $ I (part), 2002\

8.20.190 Vehiclecompliance. The city shallrecognize the bi-annual inspection of terminal"BIT Program"performed by the California Highway Patrolfor all collectionvehicles operating within city lirnitsfor the purposeof executingthe provi- sionsherein. Satisfactory rating certificates demonstrating "BIT Program"compliance for eachcollector or salvagecollector shall be filed with the city clerk.Any collectoror salvagecollector utilizing a third party haulershall comply with the provisionsof the Motor Carriersof PropertyPernrit Act, CalrforniaVehicle Code Sections34600 et seq.,and shallhave on file with the city clerk a comnroncarrier permit as rcquircd therein.(Ord. 686 $ I (part).2002)

8.20.200 Maintenanceof collectionvehicles. All collcctionvehicles shall at all tirnesbe keptclcan. in goodrepair and painted to thesatisfaction of the city and shallcornply with all measurcsand procedurespromulgated by agencieshaving jurisdiction. All collcctionvehiclcs shall be cleanedon a rcgularbasis. (Ord. 6tl6 $ I (part),2002)

8.20.210 Leakageand spillage. Eachcollection vchiclc slrall be so constructcdand utilized so as to preventany solidwastc, oil, greasc or othcrliquid frorn blowing, falling. or lcakingout of thc collcctionvchicle onto any publicright of'way or any residential,or commcrcial.property whethcr or not the propertyhas been establishcd for public or pri- vatc use.(Ord. 686 li I (part),2002)

8.20.220 Transportation of solid waste. All solid wasteshall be transportedby meansof vehiclesequippcd with watertightboclies fitted with closefitting metalcovcrs so as to prcvcntany leakage,spillage or offcnsiveodor to emit frornthe contents thereol-.Should any solid wastebe droppedor spilledin collecting,transf-crring or transporting,it shall be irnrnediatelycleaned up. Sufficicntequipment to containor cleanany of the collectionvchiclc's contcnts which may havebccn allowedto cscapethe inner body of the vehicleshall be carricdon cachtruck at all timcs tbr suchpurposc. 8.20.230 Audible warning device. Eachvehiclc uscd for thc collcction,hauling and disposal of solidwaste shall bc equippcdwith an audi- ble warningdevicc that is activatedwhen the vehiclc is backingup. (Ord. 686 $ I (part),2002)

8.20.240 Vehicle removal from service. Shouldthe city at any tirnegive notificationin writing to thc collectorthat any designatedcollection vc- hicle doesnot comply with the standardsof this chapter,such vehicle shall forthwithbe removedfrom ser- vice by the collectorand not againso uscdherein until inspectedand approvedin writing by the city. Article IV. ProhibitedActs and Enforcement

8.20.250 Throwing or scatteringsolid wasteprohibited. No personshall throw, place,scatter or depositany solid wastein or upon any public street,alley, or highwayexcept as expresslyauthorized by this chapter,nor throw, place,scatter or depositany suchmate- rial upon or below the surfaceof any premisesin sucha filannerthat the sameis or may becomea nuisance or endangerthe public health.(Ord. 686 $ I (part),2002)

8.20.260 Unauthorizeduse of bins. It is unlawful for any personto placeor depositinto any bin any medialwaste (as defined in Healthand SafetyCode Sections I17690), hazardous. waste or specialwastc requiring unique collection and disposal procedures,in any bin asdefined herein. 8.20.270 Solidwaste burning. It is unlawfulto burn any solid wastewithin the city exceptin an approvedincincrator or transfonnation facility or otherdevice for which a permithas been issued by the city andwhich complicswith all applicablc licensc,pcrmit and other rcgulationsof thc air pollutioncontrol authoriticsand providedany such act of burningin all respectscomplics with othcrlaws, rules and regulations. 8.20.280 Unauthorizedremoval. It is unlawful for any pcrson,othcr than a collcctoror salvagccollcctor to takc,rcrnovc. or appropriatc fbr his or her own usc any solidwaste, recyclable solid waste,potentially recyclable arliclcs cornrninglcd with solid wastc,source-separated single recyclable solid waste(recyclable matcrials) or greenwaste which hasbeen placcd for collcctionor removalby a collectoror salvagecollector, whether so placedin contain- crs, bins or not.Unauthorized removal as definedherein shall include scavenging. 8.20.290 Unauthorizeddisposal. It is unlawful for any personto placcsolid wastcin, or to othcrwiscusc thc solid wastc.grccn waste or rccyclablesolid wastccontaincrs of anotherperson without the pennissionof suchother person. (Ord. 6U6s\ l (part),2002)

8.20.300 Unauthorizedbins. It is unlawful for any pcrsonto utilize bins for the collection,deposit or transportof solid waste,cour- mercialsolid waste,construction, dcmolition and deconstructiondebris, green waste, or other solid wastc unlcsssuch bins havcbccn issued by the collector.It is unlawfulfor any personto utilizebins for the collec- tion, dcpositor transferof recyclablcmaterial, or othersolid waste or recyclablesolid wasteunless such bins havebccn issuedby thc collcctoror a salvagecollector authorized by the city managerto issuesuch bins. Suchbins shallbe subjectto removalas setforth at Section8.20.360. (Ord. 686 $ I (part),2002)

8.20.310 Spills. It is unlawful fbr any persontransporting solid wastcto fail to immcdiatclyclcan up, or arrangefor thc immediatecleanup, of an solid wastereleased, spilled or dumpedduring removal or transportwithin the city by suchperson. It shallbe unlawfuland a nuisancefbr the personin chargeof the day to day operationof any premiseswithin the city to permit or suffer solid waste to be deposited,released, spilled, leaked, pumped,poured, emitted, emptied, discharged, injected, dumped or disposedinto the environmentor other- wise come to be locatedoutside an authorizedbin for the collectionof suchsolid wasteat the premisesof which the personis in charge,notwithstanding human or animalinterference with bins,wind or othernatural forces,and weather during storage, collection, removal or transfer.(Ord. 686 $ I (part),2002)

8.20.320 Unlawfuldumping. It is unlawful for any personto deposit,release, spill, leak,pump, pour, emit, empty,discharge, inject, dumpor disposeinto the environment,including the abandonmentof or discardingof barrels,containers and

163 8.20.330 otherclosed receptacles of solidor liquidwaste of any kind whatsoever,any solidor liquidwaste upon any prenrises.including, but not lirnitedto, any storm drain or channel,within the city, or to cause,suffer, or permitsuch solid or liquid wasteto cometo be locatedupon any premiseswithin the city, exceptas author- izedby the city of IndustryMunicipal Code. 8.20.330 Enforcement. Pursuantto CaliforniaPenal Clode Section 836.5, the city manager,persons designated by the city man- ager,and all city codeenforcement officers are hereby ar,rthorized to enforcethe provisionsof this chapteras well as thoseof CaliforniaPenal Code Sections 373 (a). 374.2,374.3,374.4.and 375;California Govcrn- mentCoclcSection63055etscq.;andCaliforniaVehicleCodeSections3T4.T,3T4.S,23llland23l12.The city managermay promulgatcadrninistrative regulations to providethose integrated waste lnanagement ser- viccswhich arc not specificallyprovidcd for in this chapter.(Ord. 6tt6 $ l (part),2002)

8.20.340 Violation. Violationsof this chapterarc punishablcas set forth in Chaptcrl.0tl of this code.(Ord. 6tt6 $ I (part), 2002)

8.20.350 Civil actionby collcctor. Nothingin thischapter shall bc dccmcdto lirnitthc rightof a collectorto bringa civil actionagainst any personwho violatesthis chaptcr,nor shall a convictionfor suchviolation exempt any personfiorn a civil actionbrought by a collcctor.(Ord. 6tt6 $ I (part),2002)

8.20.360 Unauthorizedbins impoundment. Any bin usedfor storingor transportingsalvagc or solidwastc which is not tlrcpropcrty of thc collcctor, or undercontrol of a duly pcrmittedsalvage collector in the city, may be removcdfrom any prcmiscsin thc city andimpounded without noticc to the ownerof the bin. Suchremoval and impoundmentmay bc madeby any pcrsonor entitydesignated by the city manager.In the eventthc bin hascontents, they may be held with the bin or disposedof if the city managerdetennines disposalto be ncccssary,in his or hcr solediscretion, to prcservethe public health.safety and welfare.Any suchbin shallbe heldunder his or herdirection subjcct to theright of theowncr thcrcof to takcit uponpay- ment of a surn as providedin a fee scheduleapproved by the city rnanagcrfor eachday said bin is im- poundedor hcldto coverthc costof removal,storage and overhcad chargcs. Within twenty-fourhours of thc timethat the city hasrcmoved and impounded the bin, and its contentsif any,the city managershallcause to be sentto the ownerof the bin written noticeadvising the ownerthat the bin hasbeen removed and is in thc possessionof the city and,that if saidbin is not redeemedby the ownerwithin thirty days,said bin will be subjectto sale.If the bin is not redeemedby the owner within thirty daysafter suchremoval and impound- ment,it may be thereaftersold at publicauction under the directionof the city managerto the,highest bidder after the city rnanagerhas, within forty daysfrom the dateof removaland impoundmentof the bin, sentby regularmail with postageprepaid notice of suchsale to the personowning or in controlof suchbin and to four or more other collectorsat leastten daysbefore such sale. The proceedsof any suchsale shall be ap- plied to the costof suchsale and to the costof removaland holdingof suchbin plus twenty-fivepercent of suchcosts for the overheadexpenses of the city in causingsuch sale. Any balancesuch proceeds shall be paid upondemand to the personwho ownssuch bin at the tirneof its removal.In the instanceof a deficiency wherethe salesprice of the bin doesnot generatesufficient money to pay for the costsof removal,storage and overheadcharges, the city managershall submit an invoiceto the bin owner,for paymentin an amount

Article V. Regulationof Recyclingand SalvageBusiness

8.20.370 Salvaging-Policy. Thc city councilfinds and dctcnnincs that the storage,accumulation, collcction and disposal of salvage is of grcatpublic concern,in that impropercontrol of suchmatters may createa public nuisance,or leadto air pollution,fire hazards,insect brceding, rat infestationand other problemsaffecting the health.welfare and safctyof the residentsof this and surroundingcities. The city council furtherfinds that the activity of salvagingwithin thc city would be bestregulated through pcrmit which would providcthc most ordcrlyand cfficient solutionto suchproblems and to promotcthc public health,safety and welfarc,as wcll to bcttcr enablethc city to complywith theprovisions of theact including the reduction of thetotal tonnage of mate- rialstakcn to landfills. 8.20.380 Salvagecollector permit-Rcquired. h,xceptlbr thecollcctor, no individual,partnership, joint vcnturc,unincorporated privatc organizution, or privatecorporation shall engagein salvagecollcction unless a pennit to do so hasbeen issued as provided hcrcin.(Ord. 686 $ I (part),2002)

8.20.390 Salvagingcollector pcrmit-Application. Applicationsfbr salvagccollcction pcrmits required under this chaptcrshall bc filcd with thc city man- agerupon printedlonns to be prescribcdand suppliedby the city managcr.Within thirty daysaftcr receipt of all thc infbnnationrcqucstcd of an applicant,thc city managershall eithergrant or deny salvagecollec- tion pcnnit and shall imrncdiatclynotily the applicantby first classmail of the actiontakcn. 8.20.400 Salvagingcollector permit-Term. The salvagecollection permit issuedundcr this chaptershall be valid for a pcriodof onc ycar unlcssrc- vokedearlicr pursuant to this chapter.Thc tcnn of the salvagecollection pcrmit shallrun concurrcntlywith the fiscalyearof the city beginningJuly I and endingon June30 of eachycar. Rcnewal applications fbr sal- vagecollcction pennits shall bc subrnittedto the city clcrk no laterthan June I of eachycar. (Ord. 686 S I (part),2002)

8.20.410 Salvagecollectorpermit-Provisions-Fees. A permit issuedpursuant to this chaptershall providefor the paymentof pennit feesto the city, in an amountestablished from time to time by the city manager,and shallcontain additional provisions agreed to by and betweenthe city andthe salvagecollector and shall constitute a writtenagreement of the parties.The permitfees shall consist of two componentsincluding Salvage Collector Decal Fee and a fee basedupon the weightof salvagecollected during any given month.New applicantsfor a salvagecollection pennit shallbe assesseda proratedfee adjustedto the nearestquarter year. The city shallissue to the pennittedsalvage col- lector decalswhich the salvagecollector shall affix to all bins utilizedby the salvagecollector within the city. Any bins not displayingsaid decal shall be subjectto impoundment.Fees for suchpermits shall be at a rateas determined by the city manager.(Ord. 686 S I (part),2002)

8.20.420 Permit-Limitation of assignmentof transfer. No assignmentor transferof a permit issuedpursuant to this chapteror any right accruingunder such permit shall be madein whole or part by the salvagecollector without the prior expressconsent of the city manager.[n the eventany assignmentor transferis authorizedby the city manager,thc assigneeshall as- sunrethe liability and all other obligationsof the salvagecollector under the permit.(Ord. 686 $ I (part), 2002)

8.20.430 Salvagegenerator-Permit required. Everysalvage generator within the city shallsecurc a pennit to create,accumulatc, import or causeto be irnportedsalvage which is sold or given to a salvagecollector. Applications for salvagegenerator permits requircdundcr this chaptershall be filed with the city managerupon printed forms to be prescribedand sup- plied by the city manager.Within thirty daysaftcr rcceiptof all informationrequested of an applicant,thc city managershall eithergrant or deny thc salvagcgenerator pennit and shall immediatelynotity applicant by first classmail of thc actiontaken. The city shall chargeno fee for thc issuanccof a salvagegenerator pennit.(Ord. 6t36{ I (part),2002)

8.20.440 Self-hauler-Permit required. Every sclf-haulerwithin the city shall securea permit to create,accumulatc, irnport or causeto be im- portedor transportsalvage. Applications for sclf-haulerpennits required under this chaptershall be filed with the city managerupon printcd forrnsto be prescribedand suppliedby the city manager.Within thirty daysafter rcccipt of all infonnationrcqucsted of an applicant,the city managershall either grant or denythe sclf-haulcrpermit and shall immediately notify thc applicantby firstclass mail of thc actiontakcn. Thc pcr- mit shallprovide for thc paymentof feesto thc city in an arnountestablished lrom tirneto tirneby the city managcr.(Ord. 686 $ I (part),2002)

8.20.450 Reportingrequirements. Eachsalvage collcctor, salvage generator or sclf-haulcroperating under the provisions ofthis codeshal. be requiredat the discretionof thc city to submitmonthly, quartcrly and annualreports containing infbrrna- tion rclativeto its salvagingactivities including collection tonnage of salvageor recyclablesolid wastecol- lcctedwithin the city limits andothcr information as may be reasonablyrequired by thc city to dctcrmincthe effectivenessof scrvicesprovided, cffectiveness of city and/orsalvagc collector, salvagc gcncrator or sclf- haulersponsored programs for compliancewith the act, as well as currcntcollcction tonnagcs within thc city. Suchrecords shall be submittedin a formatapproved by the city with the affixed signatureof a duly authorizedrcpresentative of the salvagecollector, salvagc gcnerator or self-hauler.Such reportsshall be submittedto the city pursuantto a scheduleestablished by the city manager.Notwithstanding the foregoing, eachsalvage collector, salvage generator or self-haulershall submit,on or beforethe twenty-eighthday of eachmonth, a monthlyweight report prepared on a form approvedby the city which shallenable the city to determinethe volumeof salvagefor the precedingmonth. Eachsalvage collector, salvage generator or self-haulershall maintain all recordsrelating to the services providedfor in this chapterfor twenty-fivemonths from the dateupon which such servicesare provided. The city shallhave the right,upon reasonable advanced notice, to inspectand/or audit records which may be relevantto the operationswithin the city or relatingto the impositionof any feeswhich be imposedby the city. Suchrecords shall be madeavailable to the city at the regularplace of businessof the salvagecollector, salvagegenerator or self-hauler.Should an inspectionor audit of a salvagecollector, salvage generator or self-haulerresult in the obtainingof proprietaryinformation between the salvagecollector, salvage generator

8.20.460 Binsand equipment. All salvagcshall bc collccted,accumulatcd or transportedin binsor othcrmcthods approved by thc city man.tger.Salvagc shall not bc collcctcciin a packerbox systernwhere material has been packed into a closcd container.E,ach such bin shallat all timesbe keptin goodrepair and maintaincd in a cleanand sanitary con- dition.Each such bin shallbear upon at leasttwo of its sidesthe narne and tclephone number of thc salvage collcctor,which natneand telcphonenumber shall bc in legibleletters and nurncrals.Any bin which does not complywith therequirements of tlrissection shall be subjcctto rcmovalas providcd in Scction8.20.360 of thischapter. 8.20.490 Right to appealto city council-Hearing. Shouldany pentritbe revokedor suspendedin accordancewith this chapter,or any otherprovision set forth in this codeor applicablelegislation, or shouldthe city managertake any adverseaction against the perrnitteeor pennitapplicant as providedin this chapter,the pennitteeor pennit applicantshall have the right to appealthe decisionto the city counciland to requesta hearing.The requestrnust be in the forrnof a written requestmade within fifteencalendar days of the effectivedate of the suspension,revocation or ad- verseaction. Such request must be filed directlywith the city clerk by way of certifiedmail or personalde- livery. The permitteeor permit applicantshall havethe right to subrnitits appealto the city council in the fontt of a writtenargurnent and waive its right to a hearing.When a requestfor hearingis filed with the city clerk,the city councilshall set the matterfor hearingand give noticeof the tirneand place thereof to theper-

t6l 8.20.500 son requestingthe hearing,the city manager,and any other personor public agencyrequesting notice thereof.The hearingshall be held not more than thirty daysafter a written requestthereof has been filed with the city clerk and not lessthan ten daysafter the issuanceof the noticethereof. The decisionof the city councilshall be final andbinding upon all partiesand shallbe issued,in writing, within thirty daysfrom the datcof the hearing.Nothing contained within the contextof thissection shall prevent any personor pennit- tec or pennit applicantfrom pursuingremedies to the extentallowablc by law. 8.20.500 Cooperationwith city. Eachsalvage collector, salvage generator or self-haulershall cooperatewith the city and/ordesignated consultantsin solid wastedisposal characterization studies and waste streamaudits and shall implernent rleasuresadcquatc to achicvethe city's sourcercduction, rccycling and waste strearn diversion goals for the solid wastestream. Each salvage collector, solid waste generator or self-hauler,at its own expcnseshall sub- mit to the city infonnationand rcportsncccssary for thc city to meetits reportingobligations irnposed by the act and/orothcr lcgislation, and the regulationsirnplementing thc act and/orothcr lcgislation. 8.20.510 Educationalmaterials and public awarenessprograms. It shallbc thc rcsponsibilityof eachsalvage collcctor to dcvclopand distributcmatcrials and infonnation sufficientto (a) educatcits custorncrsas to thc rccyclingscrvices provided by the salvagecollcctor; (b) al- low the city to mect recyclingcducational nccds of thc city, as may be requiredby local,state or fedcralau- thoritiesduring thc pcriodof thc salvagccollcctor's pcrmit. 8.20.520 Cost recoveryspecial fund. The salvagccollector and self'-haulershall be requiredto pay a f'eefbr purposcsof cstablishinga "cost recoveryspecial fund" pursuantto thc act in an amountto bc cstablishcdfrorn tirnc to time by the city man- agcr.Funds deposited into thc cost rccovcryspccial fund shall bc usedand applicdto pay for costsassoci- atcd with thc preparation,adoption, and irnplementationof the city's sourcereduction and recyclingclc- ment.Any and all suchfees shall be paid monthly concurrentlywith the regularsubmission of the monthly wcight rcport.(Ord. 6tl6 $ I (part),2002)
