mean all the people affected by the project through land acquisition, relocation, or loss of incomes and includes any person, household (sometimes referred to as project affected family), firms, or public or private institutions. APs therefore include; i) persons affected directly by the safety corridor, right-of-way, tower or pole foundations or construction work area; (ii) persons whose agricultural land or Affected persons (APs) other productive assets such as trees or crops are affected; (iii) persons whose businesses are affected and who might experience loss of income due to the project impact; (iv) persons who lose work/employment as a result of project impact; and (v) people who lose access to community resources/property as a result of the project.

Compensation means payment in cash or kind for an asset to be acquired or affected by a project at replacement cost at current market value.

means the date after which people will NOT be considered eligible for compensation i.e. they are not included in the list of APs as defined by the Cut-off-date census. Normally, the cut-off date is the date of the detailed measurement survey.

mean those people who move into the project area after the cut-off date and are therefore not eligible for compensation or other rehabilitation measures provided Encroachers by the project.

I. EXECUTIVE SUMMARY

1. The Surkhandarya Water Supply and Sanitation Project is a redesign of the earlier Djizzak and Surkhandarya Rural Water Supply Project prepared in August 2007. The new design focuses on the Oblast of Surkhandarya, retaining the seven subprojects previously identified and adding the main Provincial City of Termez. The design will incorporate the main elements of ADB water policy of institutional reform, full cost recovery and integrated water resource management. The project will provide improved water supply and sanitation service to 340,000 persons (127,000 in Termez and 212,700 in the rayons). This represents approximately 18% of the population of the province most of whom reside in the arid southern plains where irrigated agriculture is the predominant activity. Because the proposed project will operate in seven contiguous rayons plus the capital city, Termez it will create a critical mass of consumers and provides the opportunity to introduce a “service provider” culture within vodokanal and a consumer advocate role within makhallahs.

2. Only one of the Rayons – Djarkurgan – has any land impacts. The remaining projects entail construction in public rights of way, or within the boundaries of the vodokanals. As such, the following 7 sections of this report entail a documentation of the due diligence that has occurred in each of the 7 sub project to ensure that no resettlement impacts will occur. Each section covers one sub project and contains a brief description of the sub-project and the work involved; a diagram of the alignments; an outline of the resettlement survey and field work; a table of consultations and dates; and a conclusion.

3. It should be noted that upon project implementation, the social/resettlement consultant for the PMU will

II. DUE DILIGENCE FOR MUZRABAD SUB-PROJECT, SURKHANDARYA OBLAST

A. Project Description

1. Muzrabad Rayon is located in the south of Surkhandarya Oblast and borders on the Amudarya River. Total population is 152,000 people. The sub-project targets the population of the Muzrabad rayon centre (Khalkabad) and 13 rural settlements with total population of 55,000 people. The rural settlements include: Khujakyia, Khomkon, Muzrabot, Urmonkhujaligi, Navbakhor, A. Navoi, Korakamar, 162 Razezd, Chegarachi, Guliston.

2. The preliminary design for this sub-project proposes the following project interventions: • Complete reconstruction of the existing ‘central’ water intake; • Complete reconstruction of 29 km of water mains; • Rehabilitation of the Kungrad Water Distribution Centre; • Construction of over 30 km of distribution networks in rural settlements; • Sanitation interventions will include construction of improved ventilated toilets in schools and other public organizations, and mainstreaming sanitary knowledge and awareness. In Muzrabad rayon centre 9 toilets and 6 wash-stands will be constructed. • Connection to the Khodjiipak water main and reconstruction of the distribution networks in the settlements will be executed by Suvokova from GOU budget.

3. Implementation of these interventions will provide sustainable water supply to 55,000 people. Total estimated costs are USD 7.5 million. Tariff per 1 m³ of potable water as from network completion (2013) will be sum 169 (sum 140 for households).

C. Outline of the resettlement survey and field work

4. In 2007, the existing layout in Muzarabad was shown to have no resettlement impacts. However, due to the inclusion of further mains in the Muzarabad project an additional inspection of the proposed route was undertaken on the 4th June, 2008. A few issues were identified with the alignment and these have now been resolved. They are noted here for information to the detailed design team upon implementation

• At the egress from the water intake area to the main road, the proposal was originally for crossing of some agricultural land (20m) from the border of the vodalkanal to the road. In order to avoid any AP implications, the chief engineer agreed to instead align the main from the front gate of the vodalkanal, along the side road to the main road.

• At the end of the 22km line in Duslik Mahalla the original proposal was to cross a stream, pass through some trees and across some agricultural land and houses to the pumping station. Instead it is proposed that the main be aligned to cross the stream in line with a small (7 m wide) strip of unused land (mainly a trench and weeds) between the agricultural plots. The use of hand digging would also avoid any trees, or impacts on surrounding plots. Instead of crossing through houses, the main would instead follow the small access road around the houses to the pumping station. The Vodalkanal was asked to inform the surrounding farmers that this would be the alignment.

• The remainder of the proposed line was within the road alignment and will have no impacts.

5. As long as the above items are agreed, this sub-project will have no resettlement impacts.. Householders, Vodokanal officers and departmental officials were consulted to confirm that no impacts would occur. Any new construction is within the boundaries of the existing utility. There are neither dwelling houses or other structures, nor crops or perennial plantings on the stated route. People of neighboring houses will not be affected. The project does not provide for repair of water mains as the reconstruction of water mains of all the settlements is implemented by Vodokanal by means of budgetary funds of the Republic of Uzbekistan.

III. DUE DILIGENCE FOR TERMEZ SUB-PROJECT,SURKHANDARYA OBLAST

A. Project Description

1. The sub-project targets the population of Termez city, particularly the makhallas in the city’s periphery (e.g. clockwise from NE: Guliston, Surkhon Sokhilli, Pattakesar, Uchkum, Jomiy, Garm, Baynalminal, Navruz, Jaykun, Shifokor, Uylduz, Dustlik, Tuprokurgon).

2. The preliminary design for this sub-project proposes the following project interventions: • Replace and rehabilitate borefields at Shimoliy and Manguzar Water Distribution Centres. These supply sources for Termez were developed in the late 1960’s and early 1970’s; • Rehabilitate and replace pumps and electrical systems on secondary distribution systems; • Rehabilitate approximately 60 km of mainline to link into recently completed Vodokanal-funded rehabilitation on the northern side of the city; • Construct a new mainline to service the eastern growth area (Guliston makhallah); • Construct distribution lines within Guliston.

3. An inspection of the proposed routes was undertaken on 2 June, 2008. A few issues were identified and these have now been resolved. There were subsequent meetings with

4. During detailed design, the following areas need to have increased care so as to ensure the avoidance of AP’s.

• Just south of the existing water intake as the proposed mains enter the town, in Garm and Baynalminal Mahallas, the original proposal was for alignment within the footpath. This would impact some shops, fences etc and perhaps a small cotton field. The chief engineer agreed to a realignment within the road, obviating the need for any resettlement.

• In Uzbekistan Mahalla in the Pvo area, there was a question of the proposed main passing over the land that has a planned subdivision and in fact the foundations for one house has started. A review with the City Planner on the 3rd June indicated that the main would be re-aligned about 10 m to a proposed road way around the planned housing sub-division. This is unused, waste land.

• In Termiz 2500 Yil, Kattabong and Yulduz Mahallas, the proposal was for mains to be placed in new development land (existing urban and agriculture) where new roads were planned. In order to avoid impact issues it was agreed that the water mains would be laid along existing roads adjacent to these areas, or following the development of the land for residential purposes. It is expected that the former will occur and no impacts will occur.

5. Apart from the above noted items, the entire route is in the existing public rights-of-way and there are no new structures or activities within the area affected by the construction. Householders, Vodokanal officers and departmental officials were consulted to confirm that no impacts would occur. Any new construction is within the boundaries of the existing utility.

IV. DUE DILIGENCE FOR SHURCHI SUB-PROJECT,SURKHANDARYA OBLAST

A. Project Description

1. The Shurchi sub-project as originally designed (2007) had numerous impacts on AF’s and was subject to a short RP. Since then it has been redesigned due to adverse least cost criteria and this has resulted in no new development and no impacts.

2. The Shurchi sub-project will consist of the reconstruction and rehabilitation of the existing water intake and chlorination system. After chlorination, water will be distributed through the existing rayon center network, which is also being replaced and upgraded.

V. DUE DILIGENCE FOR KIZIRIK SUB-PROJECT,SURKHANDARYA OBLAST

A. Project Description

9. Kizirik Rayon is located in the west of central part of Surkhandarya Oblast. Kizirik Rayon Center with Yangiturmush, Dustlik, Rabotak, Kunchikish Makhallas is an urban type settlement with a population of 14,674. Water supply is from the Khodjiipak IRTM. Mains water is stored in a reservoir at the distribution center then chlorinated and pumped to the distribution network. The severely deteriorated condition of the system networks and water mains lead to regular breakdown of service. Chlorination room is out of order so water is delivered directly to the distribution network.

10. The project will

• repair the pumping and power equipment • clean and repair three 200 m3 reservoirs • construct a new 1 000 m3 reservoir • repair and re-equip chlorination room • provide internal and external electric supply • replace 2 km of D= 150mm water main • Reconstruct 20 km of D =.100-50 mm distribution network to connect all Makhallas of the rayon center to the network.

VI. DUE DILIGENCE FOR SARIASIYA SUB-PROJECT,SURKHANDARYA OBLAST

A. Project Description

1. Sariasiyskiy rayon is located in the north of Surkhandarya oblast in the highland and piedmont area of Gissar mountains. The 152,700 population in the rayon is mainly rural. The Sariasiya Rayon Center is an urban type settlement1 with 1881 single storey dwellings housing a total population of 9780 people. It has a centralized water supply system but the water intake near the Tupalang river is not operating forcing the center to use individual boreholes located though-out the center.

2. Thirteen rural settlements adjacent to the proposed water pipeline are planned to be included in the project. Total population of the settlements is 31,306 people. All dwellings are rural-type with one-storey buildings. All these settlements were originally supplied by bores with submersible pumps and standpipes. Only four of these are still serviceable and the communities rely on water from irrigation canals when available.

3. The project will:

• Water intake rehabilitation • Construct 2 new 1400 m3 reservoir3 • Bore 3 new boreholes • Construct 8 km of new water main

C. Outline of the resettlement survey and field work

4. The entire route of the reconstruction was walked or driven. Acquisition of land for construction of water intake is not needed as the plot of land is assigned to the Erman water intake. The route of the water main construction lies from Erman water intake along the left side of Tupolang river to Tupolang water intake, located in the territory of the rayon centre. Riparian lands mainly consist of pebble stone and are not agricultural lands. These are included in the category of lands of inventory of water resources, right-of –way along the riversides, and other water bodies.

D. Conclusion

6. The information is based on the alignments outlined to us by the project and the local water utilities. During detailed design, there may be some minor re-alignment of easements.

7. The project does not provide for repair of distribution network of the rayon centre and 12 RCAs as the repair is included in the posted list of constructions for improvement of RCAs of Surkhandarya oblast for the year 2007 and will be implemented by means of budgetary funds of the Republic of Uzbekistan. There will be no construction or replacement of distribution network

8. Where there is distribution pipe work and metering into peoples properties, this will be undertaken with minimal site disturbance. Overall, the inconvenience caused to people and businesses will be minimized, and is far outweighed by the improved service and reduced costs of an improved water supply system.

9. It was assessed, based on the results of the field survey, that the impacts were nil or negligible and that a resettlement framework was not required.

VII. DUE DILIGENCE FOR KUMKURGAN SUB-PROJECT,SURKHANDARYA OBLAST

A. Project Description

1. Kumkurgan rayon is located in the central part of the Oblast with the Surkhandarya River as the main artery. The new railway under construction is developing the - Kumkurgan water supply for settlements adjacent to the railroad. These will be financed by State Rail Company, Uzbekiston Temir Yullari.

2. The project will provide adequate water for complete coverage of the rayon center and the additional six settlements located in the broader dry zone. It will:

• reconstruct and replace pumping equipment of 4 existing boreholes. • bore 4 new boreholes and to install pumping equipment • reconstruct the stage two pumping station • replace pumping and power equipment • construct and equip chlorination room and laboratory • maintain and clean two water reservoirs of 2 000 m3 capacity and construction of new water reservoir of 1 000 m3 • replace technological communication • reconstruct and develop the area

3. The result will be an improved water supply for 29,093 people.

Householders, Vodokanal officers and departmental officials were consulted to confirm that no impacts would occur. Any new construction is within the boundaries of the existing utility.

VIII. DUE DILIGENCE FOR ANGOR SUB-PROJECT,SURKHANDARYA OBLAST

A. Project Description

1. Angor Rayon is located west of center in Surkhandarya Oblast a region with highly mineralized groundwater. Angor Rayon Center is an urban type settlement with a population of 3,127 people. The whole system is old and badly deteriorated with many periods of outage, some lasting several days. The reservoir of water the distribution center is leaking, and the chlorination room is out of order. Water is therefore delivered direct to the distribution system without any treatment. The network was originally constructed to urban standards with a loop main to meet domestic, drinking and fire fighting needs. Complete reconstruction of the system is needed.

2. Four rural settlement Makhallas, Uzbekistan, Navoi, Navruz and Dustlik with a total population of 10,040 adjoin Angor. Water supply for the settlements comes from the Angor distribution center. The whole system needs replacement.

3. The project will undertake the following improvements to the water distribution center:

• Rehabilitate the pumping-and power equipment • clean and repair a 1000 м3 reservoir of volume and to construct a new 500 м3 reservoir • repair and re-equip chlorination room • replace 5 km of D= 500mm water main • replace 0.3 km of D= 315mm water main • Construct 15 km of distribution network to link all Makhallas of the rayon center to the network.
