Over the last 18 years of my involvement in Michigan's deregulated natural gas industry and more recently electric industry, I have developed a respect for the MPSC and its workings.

Having had the experience of being an intervener and witness in U-10755 in 1996, (Consumers Power, 'natural gas), I can appreciate the complexity of the issues currently facing the commission in 13808. This current electric case is substantially more challenging than U- 10755.

There are a few observations that I would like to make.

1. February's interim order in 13808 effectively reversed the economics for the primary account customers on Electric choice, causing most of them to now pay more that they would have paid on their prior tariff rates. Hopefully, this will be corrected in the final order.

2. After U-10755, Consumers Energy went through a series of restructuring initiatives in an effort to improve corporate efficiency and reduce costs. By comparison, DTE appears to be unwilling to do the obvious and reduce overhead; rather, they seek to pass their inefficiencies off

- L on their customers through tiiis rate case and their legislatiVi-initiativzs. -All-ofZs +inMich-igan would be better off had DTE used the money that it is spending on its misleading TV and radio campaign to hire efficiency experts to help DTE become more efficient and competitive. ~ 3. Michigan will continue to have some of the highest rates in the Midwest until DTE becomes more competitive. Perhaps competition is the only market force capable of re-directing DTE's senior management, who continue to receive generous bonuses for perpetuating business as usual, to reduce expenses so that DTE can lower its rates.

4. Why should every school, church, industrial and commercial enterprise on DTE's system, who is trying to reduce their operating costs, be penalized because DTE refuses to make changes that would lead to a reduction of its rates? Page 2 Commissioner Nelson October 19,2004

5. Where is the incentive for DTE to become more competitive? Perhaps this should be a prerequisite before DTE is granted any further rate increases?
