SUSPENSION OF CLOSURE ORDER WITH RESTORATION OF ELECTRICITY

In due consideration of the prayer submitted by M/s West Well Iron & Steel Pvt. Ltd. located at Vill: Bramhindanga, Rajgram, P.S.: , District: Birbhum, Pin 731 222 (hereinafter shall be referred to as the industry) on 28.01.2020 for suspension of closure order issued by West Bengal Pollution Control Board (hereinafter referred to as the State Board) against the industry, submission of Environmental Compensation (EC) and Bank Guarantee (BG), each amounting to Rs. 10,00,000/- (Rupees ten lakhs), by the industry and the report of the inspection carried out by State Board on 13.02.2020, the State Board is hereby pleased to suspend the order for closure with disconnection of electricity issued against of M/s West Well Iron & Steel Pvt. Ltd., Vill: Bramhindanga, Rajgram, P.S.: Murarai, District: Birbhum, Pin 731 222 vide Memo No.: 4035L/WPB2019/W0001 dated 10.12.2019 with the following conditions:-

1. That, this order is being issued subject to any order, which may be passed by the Hon’ble Tribunal in connection with pending OA NO. 903/2019. 2. That, the industry shall only operate its stone crushing activity in compliance of the environmental norms and only with valid Consent to Operate of the State Board. 3. That, the industry shall always operate dust suppression system for minimizing the secondary emission of the dust due to stone crushing activity.

The electricity connection of the industry is ordered to be restored with immediate effect.

The Director (HR), WBSEDCL is requested to take necessary steps for restoration of electricity connection of the above mentioned industry immediately.

The Environmental Engineer, Durgapur Regional Office of the State Board is requested to keep a vigil on the industry. If the industry is again found to operate violating the environmental norms, the Board will be at liberty to take strict regulatory action against the industry.

This direction is issued in exercise of the powers conferred under the provision of Water (Prevention & Control of Pollution) Act, 1974, Air (Prevention & Control of Pollution) Act, 1981, the Environment (Protection) Act, 1986 and Rules made thereunder after being approved by the Competent Authority.
