PENNINGTON COUNTY BOARD OF COMMISSIONERS Meeting of January 7, 2020

The Pennington County Board of Commissioners met at 9:00 a.m. on Tuesday, January 7, 2020, in the Commission Chambers in the County Administration Building, Rapid City, South Dakota. Chair Deb Hadcock called the meeting to order with the following Commissioners present: Mark DiSanto, Gary Drewes, Lloyd LaCroix, and Ron Rossknecht.

ELECTION OF OFFICERS MOVED by Drewes and seconded by Rossknecht to vote by voice. Substitute motion: MOVED by DiSanto to vote by paper. The motion died for the lack of second. Original vote: The vote carried 4-1 with DiSanto voting no. Chair Deb Hadcock opened the floor for nominations for Chair. MOVED by Drewes and seconded by Rossknecht to nominate Commissioner Hadcock for Chair. MOVED by DiSanto to nominate Commissioner LaCroix for Chair. The motion died for the lack of a second. The 2020 Chair is Commissioner Hadcock on a unanimous vote.

MOVED by Rossknecht and seconded by LaCroix to nominate Commissioner Drewes for Vice Chair. Vote: Unanimous. The 2020 Vice Chair is Commissioner Drewes.

ESTABLISH COMMISSIONERS’ SALARY MOVED by Drewes and seconded by Rossknecht to set the 2020 salary for Commissioners at $876.92 bi-weekly. Vote: The motion carried 3-2 with DiSanto and LaCroix voting no.

REVIEW AND APPROVE AGENDA MOVED by LaCroix and seconded by Drewes to approve the agenda as presented. Vote: Unanimous.

CONSENT AGENDA ITEMS MOVED by Drewes and seconded by LaCroix to approve Consent Agenda Items as presented with the removal of Item 10. Vote: Unanimous.

2020 RESOLUTION DRUG-FREE WORKPLACE ACT CERTIFICATION FOR A PUBLIC ENTITY

1. The County of Pennington, SD certifies that it will provide a drug-free workplace by:

a. Publishing a statement notifying employees that unlawfully manufacturing, distributing, dispensing, possessing or using a controlled substance in the recipient’s workplace is prohibited and specifying the actions that will be taken against employees for violation or such prohibition. b. Establishing a drug-free awareness program to inform employees about: 1. The dangers of drug abuse in the workplace; 2. The recipient’s policy of maintaining a drug-free workplace; 3. Any drug counseling, rehabilitation and employee assistance programs that are available; and 4. The penalties that may be imposed upon employees for drug abuse violations occurring in the workplace. c. Making it a requirement that each employee to be engaged in the performance of the grant or cooperative agreement be given a copy of the statement required by paragraph (a). d. Notifying the employee in the statement required by paragraph (a) that, as a condition of employment under the grant or cooperative agreement, the employee will; 1. Abide by the terms of the statement; and, 2. Notify the employer of any criminal drug statute conviction for a violation occurring in the workplace no later than five days after such a conviction. e. Notifying the federal sponsoring agency within ten days after receiving notice under subparagraph (d) (2), with respect to any employee so convicted; 1. Taking appropriate personnel action against such an employee, up to and including termination; or 2. Requiring such an employee to participate satisfactorily in drug abuse assistance or rehabilitation program approved for such purposes by a Federal, State or local health, law enforcement, or other appropriate agency. f. Taking one of the following actions, within 30 days of receiving notice under subparagraph (d)(2), with respect to any employee so convicted; 1. Taking appropriate personnel action against such an employee, up to and including termination; or 2. Requiring such an employee to participate satisfactorily in a drug abuse assistance or rehabilitation program approved for such purposes by a Federal, State or local health, law enforcement, or other agency. g. Making a good faith effort to continue to maintain a drug-free workplace through implementation of paragraphs (a), (b), (c), (d), (e), and (f). 2.
