GOP KEEPS CONTROL OF LEGISLATURE

Republicans will maintain control of the West Virginia Legislature, although with not quite as large a majority as they have had the last two years. CAWV’s 2018 General Election endorsements posted a nearly 80 percent success rate. The House of Delegates will be led by Republicans with a 59-41 margin going into the 2019 legislative session. The State Senate Republican majority will be 20-14. It is expected that House Speaker Roger Hanshaw and Senate President Mitch Carmichael will continue in their leadership roles, although both will need new majority leaders. Delegate Riley Moore, R-Jefferson, whom Hanshaw had tapped to be his majority leader, lost his race to John Doyle, who will be returning to the Legislature. And Senate Majority Ryan Ferns, R-Ohio, lost his re-election bid to former federal prosecutor William Ihlenfeld.

Some notable legislative results:

• In Raleigh County, newcomer Brandon Steele unseated longtime Delegate Ricky Moye.

• Trial lawyer-backed Richard Lindsay defeated Senator Ed Gaunch in the 8th Senatorial District by just 288 votes.

• In Hancock County, Delegate Mark Zatezalo lost his re-election bid to Randy Swartzmiller, who will be returning to the House of Delegates.

• The Morgantown area appears to be the only sign of an actual “blue wave” – the entire 51st Delegate District is now represented by Democrats, and incumbent Senator beat Mike Oliverio, who was looking to return to the State Senate as a Republican. • Senator trailed the entire evening but surged late on Election Day to deliver a 4-point victory for re-election to the 17th Senatorial District over challenger Terrell Ellis.

U.S. Senator easily defeated Attorney General Patrick Morrisey for another six- term in the U.S. Senate, keeping him the lone Democrat in West Virginia’s congressional delegation.

Republican Carol Miller delivered a decisive victory over her opponent, Democrat Richard Ojeda, in the 3rdCongressional District to keep the state’s U.S. House delegation firmly in the GOP. And while judicial races now are nonpartisan, Republican appointee Justices Tim Armstead and Evan Jenkins bested their respective fields to secure terms on the West Virginia Supreme Court of Appeals.

The CAWV congratulates all the winners and looks forward to working with the new Legislature on issues affecting West Virginia’s Construction industry and our members.

IMPLICATIONS OF 2018 CONGRESSIONAL ELECTIONS ON CONSTRUCTION

AGC of America has reviewed what impact the Midterm Congressional elections will have on construction-related federal policies and legislation (reprinted from the November 8 AGC Construction Legislative Week in Review). The results of the Midterm Congressional Elections will have an impact on construction-related federal policies and legislation. See below brief overviews of how the election outcome may impact a wide range of issues impacting your construction business and market.

Transportation & Infrastructure Infrastructure is a top priority for the incoming Congress Democrat House Leader Nancy Pelosi, President Trump, Republican Majority Leader Mitch McConnell and Democrat Minority Leader Chuck Schumer all made public statements on Nov. 7 citing infrastructure as an issue they can work together on. Rep. Peter DeFazio (D-Ore.) will become Chairman of the House Transportation & Infrastructure (T&I) Committee. With the Federal Aviation Administration reauthorization, Water Resources and Development Act, and Federal Emergency Management Agency authorization passing current Congress, the T&I Committee enters the new Congress able to begin a broader discussion on an infrastructure package. The challenge – as it always is – will be how to pay for a broad infrastructure bill. Rep. DeFazio, along with likely Ways & Means Committee Chairman Richard Neal (D-Mass.), has pledged to put together a package that makes bold new investments in infrastructure. AGC expects expect both committees to devote significant time in the beginning of 2019 to setting the ground work for such a proposal.

Workforce One of the few areas that saw bipartisanship in Congress were education and workforce policies. Only a couple months ahead of the divisive election, Congress overwhelmingly approved a re-write of the Career and Technical Education (CTE) law in addition to increases in CTE funding during the last two fiscal years. The new Congress is expected to give additional priority to CTE and apprenticeship programs to help address workforce shortages.

Immigration House Democrats’ primary focus will be passing stand-alone legislation protecting Deferred Action for Childhood Arrivals (DACA) program recipients with a path to citizenship. However, those efforts will be stymied unless they are coupled with increased border security funds and visa program reforms. Border security—and, more specifically, border wall funding—could dominate the government funding debate ahead of a Dec. 7 deadline to keep several agencies operating, including the Department of Homeland Security. State and local government initiatives to blacklist of contractors involved in the construction of a southern border wall will remain an AGC concern. The change of power in the House and even at the Department of Justice will put renewed pressure on the administration to protect contractors from unlawful discrimination.

Taxation With Rep. Richard Neal (D-Mass.) likely to lead the Ways and Means Committee in the House, we expect to see a number of hearings on the effects of the new tax reform law on businesses, individuals, and the economy. Provisions in the law, such as the $10,000 cap on the deductibility of state and local taxes (SALT), were highlighted in a number of successful Democrat campaigns and will face greater scrutiny. Expect Democrats to call for raising corporate and/or individual tax rates to pay for anything from infrastructure to paid parental leave. The GOP-Senate very likely ensures that attempts to significantly raise tax rates or repeal the new tax law will not go far. However, minor changes are certainly possible, with President Trump recently noting his willingness to raise corporate and/or wealthy individuals’ tax rates to finance a new middle-class tax cut.

Environment A Democratic majority in the House will likely result in a renewed focus on climate and energy issues, which may include carbon taxes or renewables mandates. Indeed, the House may choose to pass legislation that have little chance of becoming law in order to “go on the record” on key policy issues that will shape the 2020 elections. However, some of those policies may survive: legislation to advance top Congressional priorities –perhaps an infrastructure package– may need to include compromises on environmental permitting and reviews to pass both chambers and be signed into law. The federal agencies like the U.S. Environmental Protection Agency continue to actively tackle long-standing environmental inefficiencies and correct past regulatory overreaches. The midterm election is unlikely to change the course or focus of the agencies.

OSHA ISSUES FINAL RULE ON CRANE OPERATOR CERTIFICATION AND NEW EVALUATION REQUIREMENTS

On Nov. 7, the U.S. Department of Labor’s Occupational Safety and Health Administration (OSHA) published its final rule that clarifies certification requirements for crane operators and maintains the employer’s duty to ensure that crane operators can safely operate the equipment. Under the final rule, employers are required to train operators as needed to perform assigned crane activities, evaluate them, and document successful completion of the evaluations. Employers who have evaluated operators prior to Dec. 9, 2018, will not have to conduct those evaluations again, but will only have to document when those evaluations were completed.

The rule also requires crane operators to be certified or licensed and receive ongoing training as necessary to operate new equipment. The final rule also revises a 2010 requirement that crane operator certification must specify the rated lifting capacity of cranes for which the operator is certified. Operators can now be certified based on the crane’s type and capacity, or type only. Compliant certifications that were already issued by type and capacity are still compliant under this final rule.

The final rule, with the exception of the evaluation and documentation requirements, will become effective on Dec. 9, 2018. The evaluation and documentation requirements will become effective on Feb. 7, 2019. The CAWV is reviewing the rule as it relates to West Virginia’s crane certification requirement to determine what, if any, modifications must be made to West Virginia’s law.

CAWV ASSISTANT EXECUTIVE DIRECTOR ELECTED WVSAE VICE PRESIDENT

CAWV Assistant Executive Director Pat McDonald was elected Vice President of the West Virginia Society of Association Executives (WVSAE) during their annual meeting held November 3-4 at The Homestead. WVSAE is the only association in West Virginia that focuses on serving the state’s association management industry. WVSAE has nearly 100 members throughout the state, who are involved in association management. Members include executives from various trade, technical, and professional associations. The CAWV congratulates Pat on this achievement.

YOUNG CONTRACTORS FORUM TO MEET NOVEMBER 28 - ALL MEMBERS INVITED

It’s time once again to get together for the Young Contractors’ annual planning session. Chairman Chet Rodabaugh will hold the event on Wednesday, November 28, from 5:30 to 7:00 p.m. at the newly renovated Charleston Coliseum & Convention Center (CCC) in Charleston. KANAWHA COUNTY SCHOOL EXCESS LEVY PASSES

Kanawha County Schools’ 2018 excess levy passed Tuesday by 34,799 votes to 18,930. The excess levy will last five years, and the current excess levy will expire in June 2019. An excess levy has been approved in Kanawha County since 1937 and approximately 75% of West Virginia counties have an active excess levy. Kanawha County’s excess levy makes up 19% of the current expense fund budget. This year’s Kanawha County Schools levy includes funding for HVAC, roofing and other construction projects at schools around the county. For a breakdown, see below (numbers provided are for first year):

• $39,584,000 for professional, service and substitute wages, including specific funds for custodians, counselors and art teachers. • $18,577,687 for HVAC improvements at 15 schools with the greatest need. • $4,869,807 for roofing projects. • $239,994 for safety & security improvements across the district. • and, $1,648,512 for athletic turf installation at 7 of 8 high schools.

1. FALSE. Studies have found a direct correlation between the numbers of hours a person works and their risk of being in a drowsy driving crash. People who work more than one job where their primary job involves an atypical schedule are twice as likely to be involved in a sleep-related crash when compared to people in non-sleep related crashes.

2. FALSE. According to a study by the AAA Foundation for Traffic Safety, working the night shift increases a person’s risk of being involved in drowsy driving crash by nearly six times.

3. FALSE. Sleep-related crashes are most common in young people, who tend to stay up late, sleep too little, and drive at night. One study found that in 55 percent of sleep-related crashes, drivers were age 25 years or younger and were predominantly men. Another study found almost one-third of commercial drivers have some degree of sleep apnea.

The most common signs of sleep apnea are loud, irregular snoring, and excessive daytime sleepiness. Studies indicate that persons with untreated sleep apnea have two to seven times more crashes than people without the disorder. Studies also show that once treated, most patients can be safe drivers once again.

6. FALSE. Things such as heavy meals, warm rooms, and long drives only unmask the presence of sleep deprivation or sleep debt; they do not cause sleepiness.

7. FALSE. Sleep is not voluntary. If you’re tired, you can fall asleep and never know it. When driving at 60 miles per hour and fall asleep for a few seconds (a microsleep), you can travel up to the length of a football field without any control of your vehicle.

WVDOH ESTIMATES BEING PROCESSED

The scheduled changeover to wvOASIS for Construction Estimate Payments has been completed and the scheduled blackout period is over. Estimates are reportedly being processed by the WVDOH and State Auditor’s Office. The DOH paid everything up through the September 7 Estimate Cut-Off Date under the “old” system and skipped the September 21 Estimate, as they transferred to the new OASIS system.

ARTBA NAMES JEANNERET EXECUTIVE VICE PRESIDENT & COO

The American Road and Transportation Builders Association (ARTBA) has named Matthew J. Jeanneret as new executive vice president and chief operating officer, effective November 1. Jeanneret replaces Executive Vice President & Chief Operating Officer William D. Toohey, Jr., who was recently appointed interim president and CEO. Jeanneret joined ARTBA in 1998 as director of public affairs. He has been serving as the association’s deputy chief operating officer since January. As ARTBA’s senior vice president of communications and marketing over the past decade, he led its award-winning external communications initiatives aimed at building political support for increased transportation infrastructure investment in the past four federal highway and transit program authorization laws.

2019 CAWV/WVDOH TECHNICIAN AND INSPECTOR COURSES ANNOUNCED

The CAWV is pleased to announce that registration is open for the 2019 Technician Certification Training Courses. The courses, which are offered annually to help individuals prepare for WVDOH certification examinations required under their Quality Assurance Program, have seen greater demand this year due to the passage of the “Roads to Prosperity Bond Amendment”. Thousands of individuals have attended courses in Compaction, Aggregates, Asphalt and Portland Cement Concrete over the last several years. Test comparisons prove that those persons who attend the CAWV/WVDOH courses have a higher success rate for passing the exams.
