FOLLOW THE YELLOW CHIP ROAD: THE PATH TO LEGALIZING INTERNET POKER Josh Chumbley* I. INTRODUCTION Some say it all started with an Academy Award winning actor playing the role of a law student. In the 1998 movie “Rounders,” Matt Damon1 starred in the role of Mike McDermott, a law student who plays in underground poker games in order to earn money and help pay for law school.2 The movie follows the exploits of McDermott as he struggles to balance his life as poker player with his desire to make a conventional life for himself as an attorney.3 Ultimately, thanks to advice given to him by his law school professor,4 McDermott decides that he is a poker player at heart and leaves law school to become a professional poker player.5 “Rounders” had a profound impact on poker in America. 6 Professional poker players Dutch Boyd, Gavin Griffin and Hevad Khan all credit the movie with getting them interested in poker.7 Professional poker player Vanessa Rousso said, “the movie helped define the underground poker scene in New York and showed how judges, cops and ultimately the pros in Vegas were all hooked on a game of skill.”8 Another player who was influenced by “Rounders” is the appropriately named Chris Moneymaker.9 Although there is some debate on how much impact “Rounders” has had on the poker community,10 there * J.D. Comparing the Professionalization of Pro Gamblers and Pro Video Game Players Introduction Although difficult to trace the earliest era of professional gambling activity - understood here as gambling which provides the primary or entire source of income for an individual to live off - professional gamblers have long been central to the cultural mythos of gambling practice (Hayano, 1984). However, by its nature - in casinos and card rooms, private clubs, in homes, on golf courses - the actual practice of the professional gambler is rarely noted through any formal means. It is instead recorded and reproduced through word-of-mouth, creating stories that circulate widely but, in some cases, run the risk of losing their original veracity the further from the gambler in question they drift. Equally, when so many stories feature significant losses, or cheating, or other practices gamblers might not want to own up to or otherwise be associated with, it is easy to see how the lines between the actual practice of pro gamblers and the cultural imagination surrounding them might diverge. What does a professional gambler actually do on their path to becoming a professional gambler, and what challenges do they face? What practices, beyond their obvious skill at gambling per se, mark them out as being “professional” material? More recently than professional gambling is the rise of professional video game play, known as “electronic sports” or more commonly “eSports”. Such competitions are played both online, and physically in stadium venues, which can sell out to crowds of as high as forty thousand concurrent attendees (Evans, 2014). -

In Business Q and A Jim Murren, President and COO of MGM Mirage Interviewed by Richard Velotta / Staff Writer Jim Murren's promotion to president and chief operating officer of MGM Mirage didn't get much attention when it occurred last summer. That's because, at the time, the company was in the midst of so much other news that overshadowed the announcement: A deal with Dubai World that places half of the ownership of Project CityCenter in the hands of a foreign investor; another with Sol Kerzner, whose spectacular Atlantis project in the Bahamas is considered one of the premier resorts in the world, to design a Jim Murren is president and project with MGM Mirage on a site at Las Vegas Boulevard and chief operating officer of MGM Sahara Avenue; and the opening of a new casino resort in Mirage. He started with the company as executive vice president and chief financial officer after a 14-year Wall Street career. In 1999, he was named president and chief financial officer, and he is a member of MGM Mirage's board of directors and its executive committee. A strong believer in philanthropy, Murren and his wife, Heather, founded the Nevada Cancer Institute, a nonprofit institution dedicated to providing a cancer center for the state. He also serves as a trustee for foundations at the University of Nevada, Reno, and UNLV. Full Tilt Phonies: American Gaming Association calls for legalized and regulated online poker in the U.S. The other shoe dropped on Full Tilt Poker last week, ending any hope that former customers could recoup their deposits and launching another effort by U.S. online poker interests to establish a legal internet poker industry with a strict regulatory system. The U.S. Department of Justice last week amended the original Full Tilt indictment, issued on April 15—“Black Friday”— that effectively ended Full Tilt in the U.S. The U.S. Attorney in the Southern District of New York filed a motion that accused professional poker players Howard Lederer, Christopher “Jesus” Ferguson and Rafael Furst, along with other senior level executives with Full Tilt, of operating a Ponzi scheme to defraud thousands of players of more than USD400 million. The DOJ amended indictment showed that Full Tilt had only USD60 million in the bank prior to the April indictments and owed its players USD390 million in deposits. The motion claimed that the company misled poker players that their money was safe when in fact it was quickly dwindling as Full Tilt paid it to the owners of the company, as well as its professional shills. According to Preet Bharara, U.S. Attorney for the Southern District, the company was never legitimate. She said that through hundreds of millions of dollars of payouts, “insiders lined their own pockets with funds picked from the pockets of their most loyal customers while blithely lying to both players and the public alike about the safety and security of the money deposited with the company.” The amended indictment also means new charges for Raymond Bitar, the company’s CEO, who was indicted by the government for alleged bank fraud and money laundering back in April.
