Enclosed in this newsletter, you will also find important information on UNO’s division status change and an update on ACS Athletics as well as other announcements and reminders. Also included is the new legislation that was passed at the January convention and is effective immediately. Additionally, please take note of the rules educa- tion dates for this Spring semester and other key dates for you and your athletes.

Interpretation: The committee determined prerecorded telephone or electronic mail messages from institutional staff members sent to individuals through services that allow such messages to be sent to any member of the general public are not considered to be initiated by the institution and therefore, are not subject to NCAA recruiting legislation, provided: (a) The message is sent by an individual other than an institutional staff member or a (b) representative of an institution's athletics interests; (b) The institution does not direct the individual to initiate the message; and (c) The message does not include athletically related information or other information related to the institution. Contributions to an Organization Consisting of Prospects and Nonprospects -- Sports Other Than Men's (I) Date Published: December 18, 2009

Interpretation: The academic and membership affairs staff confirmed that, in sports other than men's basketball, it is permissible for a member institution's coach or a representative of its athlet- ics interests to contribute to an organization that may consist in part of prospective student- athletes (e.g., YMCA, Boys and Girls Club), provided the assistance is not earmarked for a par- ticular prospective student-athlete, is not earmarked for the purpose of contributing to a boys' basketball program and is offered in conjunction with the organization's regular fundraising ef- forts. [References: NCAA Division I Bylaw 13.15.1 (prohibited expenses), and official interpretations (8/6/87, Item No. 10, which has been archived and 11/4/09, Item No. 1)]

ACS Athletics: Reminders & Procedures

Please be reminded that our institution committed to department-wide implementation of ACS Athletics by January 1, 2010 . This means that everyone in athletics should be reporting all necessary information into ACS at this time. Travel expenses will not be approved unless recruiting information has been entered into ACS. If you are having problems with your ACS account, please contact the Compliance Office immediately.

Compliance Corner: Promotional Activities

Promotional Activities

A member institution or recognized entity thereof (e.g., fraternity, sorority or student government organization); A member conference; Or a non-institutional charitable, educational or nonprofit agency may use a student-athlete's name, picture or appearance to support its charitable or educational activities or to support activities considered incidental to the student-athlete's participation in intercollegiate athletics, provided the following conditions are met: The following is the schedule of A. Promoting NCAA Championships, Events, Activities, or Programs • The NCAA may use the name or picture of an enrolled student-athlete to generally promote NCAA Championships or other NCAA events, activities, or programs.

Promotions Involving Commercial Locations/Sponsors • A member institution or a charitable, educational or nonprofit organization may use the appearance, name or picture of an enrolled SA to promote its fundraising activities at the location of a commercial establishment, provided the commercial establishment is not a cosponsor of the event and the SA does not promote the sale of a commercial product in conjunction with the fundraiser. The commercial estab- lishment would become a cosponsor if it advertised the presence of the SA at their commercial location or was involved in promoting the activity.

Distribution of Institutional Items through Commercial Outlets • A member institution may distribute noncommercial items that include names or pictures of student-athletes at commercial establishments, provided the institution generally distributes such items to other commercial estab- lishments in the community and the distribution of the items does not require the recipient to make a purchase at the commercial establishment.

Player/Trading Cards • Player/Trading Cards with SA’s names or pictures may be distributed by any member institution, fraternity, sorority, student government association, member conference, or charitable organization, but they may not be sold.

Schedule Cards • An advertisement on an institution’s wallet-size playing schedule that includes the name or picture or a student- athlete may include language other than the commercial product’s name, trademark, or logo, provided the com- mercial language does not appear on the same page as the SA.

Modeling & Other Non-Athletically Related Promotional Activities • If a SA uses his/her name or picture to promote the sale or use of a commercial product or service prior to enrollment in a member institution, continued remuneration for the use of the SA’s name or picture (under the same circumstances) after enrollment is permitted if all of the following conditions apply:

A. The SA’s involvement in this type of activity was initiated prior to his/her enrollment in a member institution. B. The SA became involved in such activities for reasons independent of athletics ability. C. No reference is made in these activities to the SA’s name or involvement in intercollegiate athletics. D. The SA does not endorse the commercial product E. The SA’s remuneration under such circumstances is at a rate commensurate with the SA’s skills and experience as a model or performer and is not based in any way upon the SA’s athletics ability or reputation.

Congratulatory Advertisement It is permissible for a SA’s name or picture, or team picture, to appear in an advertisement of a commercial business provided: A. The primary purpose of the advertisement is to publicize the sponsor’s congratulations to the SA or team; B. The advertisement does not include a reproduction of the product with which the business is associated or any other description of the business other than its name or trademark; C. There is no indication in the makeup or wording of the advertisement that the team, individually or collec- tively, or the institution endorses the product of the advertiser; D. The SA has not signed a consent or release granting permission to use the SA’s name or picture in a manner inconsistent with the requirements of this section (NCAA Bylaw 12.5.1.4) E. If the SA has received a prize from the commercial sponsor in conjunction with participation in a promo- tional contest and the advertisement involves the announcement of receipt of the prize, the receipt of the prize must be consistent with the provisions of Bylaw 12.5.2.3.3.

NCAA Bylaw 12.5.2.3.3 Promotional Contests: Receipt of a prize for winning an institutional or noninstitutional promotional activity (e.g., making a half-court basketball shot, being involved in a money scramble) by a PSA or enrolled SA (or a member of his/her family) does not affect his/her eligibility, provided the prize is won through a random drawing in which all members of the general public or student body are eligible to participate.

UL’s Institutional Policy on Promotional Contests • No student-athletes will be allowed to receive prizes given by UPC during contests at home events. If a stu- dent-athlete is randomly selected (the spotlight selects them at the men’s basketball game and they have 10 seconds to go on the court), the student-athlete may participate in the contest, but will be unable to accept the prize. (There is too great a risk of having this interpreted as an extra benefit).

Educational Products Related to Sports-Skill Instruction • It is permissible for a SA’s name or picture to appear in books, articles and other publications, films, videos, and other types of electronic reproduction related to sports-skill demonstration, analysis, or instruction, provided: A. Such print and electronic media productions are for educational purposes. B. There is no indication the SA is endorsing a commercial product or service. C. The SA does not receive, under any circumstances, any remuneration for such participation; however, the SA may receive actual and necessary expenses related to his or her participation. D. The SA has signed a release statement ensuring that their name or image is used in a manner consistent with the requirements of this section and has filed a copy of the statement with the member institution.

Camps and Clinics • An institution or privately owned camp may use a SA’s name, picture, & institutional affiliate only in the camp counselor section in its camp brochure to identify the SA as a staff member. • The SA’s name or picture may not be used in any other way to promote the camp.

Promotion by Third Party of Highlight Film, Videotape or Media Guide • Any party other than the institution or a SA may sell and distribute an institutional highlight film or videotape or an institutional or conference media guide that contains the names and pictures of enrolled SAs only if: A. The institution specifically designates any agency that is authorized to receive orders for the film, videotape or media guide; B. Sales and distribution activities have the written approval of the institution’s athletic director; C. The distribution company or a retail store is precluded from using the name or picture of an enrolled SA in any poster or other advertisement to promote the sale or distribution of the film or media guide; D. There is no indication in the wording of the advertisement that the squad members or institution endorse the product of the advertiser.

Use of a SA’s Name or Picture without Knowledge or Permission • If a SA’s name or picture appears on commercial items or is used to promote a commercial product without the student-athlete’s knowledge or permission, the SA is required to take steps to stop such an activity in order to retain his or her eligibility.

Specifically Restricted Activities • Name the Player Contest: A SA may not permit use of his or her name or picture in a “name the player” contest conducted by a commercial business for the purpose of promoting that business. • Athletics Equipment Advertisement: A SA’s name or picture may not be used by an athletics equipment company or manufacturer to publicize the fact that the institution’s team uses its equipment.

Media Activities — During the Playing Season: • A SA may appear on radio & television programs or engage in writing projects when the SA’s appearance or par- ticipation is related in any way to athletics ability or prestige, provided the SA does not receive any remuneration for the appearance or participation in the activity. • The SA shall not make any endorsement of the commercial product. • The SA may receive necessary expenses directly related to participation in this activity. • No class may be missed other than that in conjunction with away-from-home competition and conference- sponsored media days.

Media Activities — Outside the Playing Season: • A SA may participate in media activities when such appearance or participation is related to athletics ability or prestige, provided the SA is academically eligible and does not receive any remuneration for their appearance. • The SA may not make any endorsement for a commercial product. • The SA may receive legitimate and normal expenses directly related to such participation, provided the source of the expenses is the entity sponsoring the event. 6 Compliance Corner continued on page 7

Use of Logos on Equipment , Uniforms, & Apparel • A SA may use athletics equipment or wear athletics apparel that bears the trademark or logo of an athletics equipment or apparel manufacturer or distributor in athletics competition and pre- and postgame activities, provided the following are met:

A. Athletics equipment shall bear only the manufacturer’s normal label or trademark, as it is used on all such items for sale to the general public. B. The SA’s institution’s official uniform and all other items of apparel shall bear only a single manufacturer’s or distributor’s normal label or trademark including any additional material surrounding the normal trademark or logo. The SA’s insti- tution’s official uniform and all other items of apparel shall not bear a design ele- ment similar to the manufacturer’s trademark/logo that is in addition to another trademark/logo that is contrary to the size restriction.

Newly Adopted Legislation: Effective Immediately

Non-Coaching Athletics Staff Members • To permit noncoaching staff with sport-specific responsibilities to participate in organ- ized activities involving only the coaching staff or administrative duties (e.g., attend meetings involving coaching activities, analyze video of the institution's or an oppo- nent's team, track statistics during practice or competition). • In basketball, to specify that a non-coaching staff member with sport-specific responsi- bilities shall not attend an off-campus athletics event involving prospective student- athletes (e.g., high school contest, sports camp) unless the staff member is an immedi- ate family member or legal guardian of one of the participants in the activity; further, to establish conditions by which a staff member who is an immediate family member or legal guardian of a participant may attend such an event, as specified.

Assistant Coach Designated as Next Head Coach -- Football • In bowl subdivision football, to specify that an institution's assistant coach who has been publicly designated by the institution to become the next head coach shall be subject to the recruiting restrictions applicable to the institution's head coach.

Non-Institutional Non-Organized Events - Basketball • To prohibit evaluations at non-institutional non-organized events (e.g., pick-up games, open gyms) during the summer evaluation period.

Recruiting Materials • To specify that an institution may produce video or audio material to show to, play for or provide to a prospec- tive student-athlete, provided such material includes only general information related to an institution or its ath- letics programs and is not created for recruiting purposes; further, to specify that a computer generated recruit- ing presentation may include general informational video/audio material that relates to an institution or its ath- letics programs and is not created for recruiting purposes (can be sent through e-mail).

Institutional Camps and Clinics • In sports other than football, to specify that an institution's camp or clinic shall be conducted on the institution's campus or within a 100-mile radius of the institution's campus. • A contract signed before September 17, 2008, for men's basketball camps may be honored; a contract signed be- fore September 16, 2009, for women's basketball camps may be honored; a contract signed before October 20, 2009, for all other sports may be honored.

Non-Institutional Camps/Clinics • In football, to specify that an institution's coach or non-coaching staff member with responsibilities specific to football may be employed in a non-institutional, privately owned camp or clinic at any location during the two periods of 15 consecutive days in the months of June and July as declared by the institution. • No mileage restriction any longer

Recruiting Services • To establish additional criteria that must be satisfied in order for an institution to subscribe to a recruiting or scouting service involving prospective student-athletes, as specified. • Specifics to follow later

Recruiting Calendar - Football • In football, to revise the recruiting calendar to eliminate the quiet periods in January, as specified.

Reasonable Refreshments for Relatives • To specify that an institution may provide the family (e.g., parents or legal guardians, relatives) of a student-athlete with reasonable refreshments (e.g., soft drink, snacks) in conjunction with educational meetings or cele- bratory events (e.g., senior night) and on an occasional basis for other rea- sons.

Countable Athletically Related Activities • To specify that countable athletically related activities shall not occur be- tween midnight and 5 a.m., except for during participation in a confer- ence championship or an NCAA championship, in any competition that begins prior to midnight and concludes after midnight, or a promotional practice activity (e.g., first practice of the season).

Summer Conditioning Period • In football, to permit an institution to designate nine consecutive weeks between the conclusion of the aca- demic year and the institution's reporting date for preseason practice as its summer conditioning period.

Employment of Individuals Associated with PSA • In men's basketball, to specify that during a two-year period before a prospective student-athlete's anticipated enrollment and a two-year period after the prospective student-athlete's actual enrollment, an institution shall not employ (or enter into a contract for future employment with) an individual associated with the prospec- tive student-athlete in any athletics department noncoaching staff position. • A contract signed before October 29, 2009 may be honored.

Update: UNO Division Status Change

The University of New Orleans will be departing the Sun Belt Conference on June 30, 2010 as part of a move to Division III. However, UNO will continue to be a member institution until June 30; therefore, any student-athlete that transfers to another Sun Belt school prior to June 30 is subject to the conference residency requirement. No appeals are possible per the Sun Belt Conference Consti- tution.

Additionally, NCAA contact rules are in place that require an institution to secure permission from the UNO Athletics Director (not coaches) prior to contacting a UNO student-athlete. A blanket release has NOT been issued for UNO student-athletes. If a coach would like to con- tact an athlete, they must obtain permission to contact that athlete through our Compliance Office.

Around the NCAA: Razorback Basketball Photo Shoot in NWA Magazine Could Be Violation of NCAA Rules By Chris Bahn

Arkansas basketball players Rotnei Clarke, Jeff Peterson and Courtney Fortson may have violated NCAA rules by appearing in a local magazine section highlighting clothing op- tions from Northwest Arkansas stores.

Clarke, Fortson and Peterson are featured in the December issue of Northwest Arkansas magazine Celebrate Arkansas , in which their photos are tied in to the promotion of local clothing retailers. Razorback coach is also featured in the magazine and Clarke appears on the cover.

Contained in the publication are the players in fashion magazine-type poses with descrip- tions on where to buy the players' "look" as part of the caption on each photo. It appears essentially to be an advertisement, although the feature is labeled as the "cover story."

NCAA bylaw 12.5.2 outlines "nonpermissible" use of a student-athlete in advertising. Rule 12.5.2.1 says that an athlete is not eligible for competition if he/she "accepts any remu- neration or permits the use of his or her name or picture to advertise, recommend or pro- mote directly the sale or use of a commercial product or service of any kind."

Celebrate Arkansas mentions that the players "let us dress them up in designer duds from local boutiques and force their hands at a little modeling, all with smiles on their faces."

No immediate clarification was available from the NCAA of how the rule pertains to this situation. A spokesman for the organization declined to comment but did send a copy of the bylaw as part of an e-mail.

How or if this would immediately affect the players' eligibility is unclear, but the bylaw states that athletes who knowingly participate in advertising are ineligible. It is unclear if players knew how the photos would be used.

Arkansas officials were not immediately available to comment. A comment is expected and the university is aware of the "magazine article," a spokesman said.

Celebrate Arkansas Publisher Mari Taylor did not return a telephone call seeking comment on the magazine spread, which featured goods from local men's stores Baumans, Walker Brothers and Soho. Jewelers Blakeman's, Underwoods and Romance Diamonds are also part of the package.

Clarke, the Razorbacks' leading scorer, takes up the entire cover, which reads: "3-point Sensation Rotnei Clarke Joins Ra- zorback Teammates And Coach Pel in Hot Full-Court Fashion." The spread appears over 10 pages and the photos were shot inside Bud Walton Arena.

Each player has full page devoted to his "Fashion Stats." Listed are the height and weight, along with shoe, shirt and pants sizes for Clarke, Peterson and Fortson. Fortson has missed all nine regular season games for the Hogs this year under indefinite suspen- sion by Pelphrey. Reasons for the suspension have not been said. Peterson is a transfer from Iowa and must sit out the season before becoming eligible to play.

Photos for the feature are credited to StudioElevation.com, a company that boasts "cutting edge advertising photos in Northwest Arkansas." Celebrate Arkansas is among the clients listed on the Studio Elevation Web site.

Some editorial copy accompanies part of the "Suited Up" feature. Each player partici- pated in a question-and-answer feature, and assistant coach Rob Evans is quoted giving his thoughts on Clarke, Fortson and Peterson.

Peterson participated in a second, fashion-related Q&A with Celebrate . It's described as an attempt to get to know "about his own personal style" and focuses on Peterson's fa- vorite place to shop, his favorite designer and "favorite look on a woman." Accompanying the Q&A is a sidebar with "Fashion Rules to Play By." "Even if your per- sonal style is a little more relaxed like Jeff's, these four items are fashion must-haves for all men." What follows are photos of watches, ties and designer jeans from the local businesses.

Players participated in the shoot before the regular season. Fortson, in fact, sent out a Twitter photo of himself preparing for the event and was dressed in the same gray pin- stripe suit and red-and-white bowtie he dons in the magazine.

Statement from the Arkansas Athletic Department

FAYETTEVILLE, Ark. – The University of Arkansas has submitted a self-report of an NCAA secondary violation involving the improper use of men’s basketball student-athletes’ im- ages in a local magazine article. Consistent with all other secondary violation reports, the University of Arkansas has forwarded the self-report to the . As the routine process for reporting secondary violations has been completed, the University of Arkansas considers the matter closed.

The secondary violation outlined in the report does not allege or include any impermissi- ble activity by any University of Arkansas coaches, student-athletes or staff members. No Razorback coach, student-athlete or other athletic department official approved or had prior knowledge of any non-editorial use of the student-athletes’ images as part of the article. No compensation was provided by the media outlet for the article or the accom- panying photos. This matter does not affect the eligibility of student-athletes.

The self-report was based on tag lines used to accompany photos of student-athletes ref- erencing local businesses that provided clothing specifically for the photos in the article. The request for interviews and photos was made through the Arkansas Media Relations department and was accommodated in a manner consistent with other such media re- quests.
