JOURNALISTS AND BLOGGERS – 10 persons

1. Nijat Nazim oglu Aliyev - the Chief Editor of www.azadxeber.org website

Arrest: May 20, 2012 Charge: Articles 167.2.2.1 (Import, sale or distribution of religious literature, religious items and other informational materials of religious nature with the aim of reproduction, sale and distribution without appropriate authorization, when committed by a group of persons on a prior arrangement or by an organized gang); 234.1 (Illegal purchase or storage without a purpose of selling of narcotics or psychotropic substances in a quantity (amount) exceeding necessary for personal consumption); 281.2 (Public appeals directed against the state, committed repeatedly or by group of persons) and 283.2.2 (Excitation of national, racial or religious hostility committed by person with use of the service position) of the Criminal Code of the Azerbaijan Republic Sentence: on December 09, 2013 the Grave Crimes Court sentenced to 10 years in prison Judge: Zeynal Agayev Place of detention: Prison No.2

Conclusion: The detention, the investigation and the trial went on with many violations of the national and international law, particularly the European Convention for the Protection of Human Rights and Fundamental Freedoms. According to trial lawyer Yalchin Imanov, the accusation was framed-up. The drugs were planted on him. He was tortured in the police station, his two teeth were knocked out. The other charges were also pointless. The video material incriminated to the accused had nothing illegal, without any sign of a call for seizure of power, no word about incitement of interreligious hatred. The contents of the video comply with the freedom of speech secured by the Constitution of Azerbaijan and the European Convention. For example, the incriminated video had an opinion that the Eurovision 2012 Song Contest held in Baku was inconsistent with the moral values of the Azerbaijani people. Besides, the video material criticized the violations of the rights of the believers, the ban against wearing a hijab in schools, the uncertainty of the Karabakh conflict.

2. Araz Faiq oglu Quliyev - the Chief Editor of www.xeber44.com website

Arrest: September 08, 2012 Charge: Articles 228.1 (Illegal purchase, transfer, selling, storage, transportation and carrying of fire-arms, accessories to it, supplies (smooth-bore hunting weapon and supplies thereof excluded) or explosives); 233 (organizing actions causing violation of public order or active participation in such actions); 283.1 (Incitement of national, racial, social or religious hatred and hostility, humiliation of national dignity, as well as restriction of citizens’ rights, or establishment of the superiority of citizens on the basis of their national, racial or religious background, committed publicly or through use of mass media), 315.2 (resistance or violence against representative of authority) and 324 (Insulting national flag or emblem of the Republic of Azerbaijan) of the Criminal Code of the Azerbaijan Republic Sentence: on April 05, 2013 the Grave Crimes Court sentenced to 8 years in prison Place of detention: Closed Prison

Conclusion: The detention, investigation and trial took place with numerous violations of the legislation of Azerbaijan and international law. During the investigation, torture and other unlawful methods were used. Punished for his criticism of the policy of the authorities in the religious sphere.

3. Rashad Agaaddin oglu Ramazanov - blogger

Arrest: May 09, 2013 Charge: Article 234.4.3 (Illegal purchase or storage with intent to sell, manufacturing, processing, transportation, transfer or selling of narcotics or psychotropic substances, when committed in large amount) of the Criminal Code of the Azerbaijan Republic Sentence: on December 10, 2013 the Baku Grave Crimes Court sentenced to 9 years in prison Judge: Alisultan Osmanov Place of detention: Prison No.2

Conclusion: The process of detention, investigation and trial was conducted with numerous violations of the law. The family of R. Ramazanov was not informed of his detention, they did not allow him to use the services of a lawyer. No forensic and narcological examination was conducted. The understanders confessed that they were not invited from the territory where the event occurred. The verdict to the blogger R. Ramazanov is a political order connected with his sharp criticism of the ruling authorities, which were published in the form of statuses in social networks, as well as the placement of video clips on this topic on his portal in Youtube. Amnesty International recognized Ramazanov as a prisoner of conscience.

4. Seymur Mashgul oglu Hazi – journalist of newspaper Azadliq

Arrest: August 29, 2014 Charge: Article 221.3 (Hooliganism, committed using items used as a weapon) of the Criminal Code of the Azerbaijan Republic Sentence: on January 29, 2015 the Court sentenced to 5 years in prison Judge: Shovkat Najafova Place of detention: Prison No.17

Conclusion: Seymur Hazi left the house on the morning of August 29, 2014, when a man named Muharram Hasanov approached him and asked why Seymur does not respond to his messages in social networks. And, without waiting for an answer, he hit Seymur. A few minutes later, police officers appeared and took Seymur Hazi to the police station. The detention, investigation and trial took place with numerous violations of the legislation of Azerbaijan and international law. During the investigation, torture and other unlawful methods were used. Punished for his criticism of the policy of the authorities in the religious sphere. At the same time, the lawyer indicated that the date of commencement of the office work, the date of the examination, as well as the testimony of the instigator M. Hasanov do not coincide, and was not found by the experts of the "message" to Seymur Hazi from M. Hasanov. On March 26, 2011, Seymur Hazi was kidnapped and taken away by masked men in the resident settlement of Jeyranbatan, beaten and warned to no longer write about Ilham Aliyev. In this case, Seymur Hazi appealed through the press to law enforcement agencies, but no investigation was carried out. Seymur Hazi continued to criticize the authorities' anti-popular policies and also criticized the broadcasts on the online television of Azerbaijan saaty, which is abroad.

5. Fikrat Faramaz oglu Ibishbeyli (Fikrat Faramaz oglu) - the Chief Editor of www.jam.az website

Arrest: June 30, 2016 Charge: Articles 182.2.1 (Extortion, committed by a group of persons on a prior arrangement), 182.2.2 (same action, when committed repeatedly) 182.2.4 (same action, when committed with the purpose of extorting property in a large amount) of the Criminal Code of the Azerbaijan Republic Sentence: on June 14, 2017 the Baku Grave Crimes Court sentenced to 7 years in prison, forbidding to engage in journalism for two years after his release

Conclusion: From the moment of his arrest, 33 days were illegally kept in the General Directorate for Combating Organized Crime of the Ministry of Internal Affairs of Azerbaijan (under the law, no more than 48 hours). According to relatives, he was tortured and, as a result of pressure, refused a lawyer and a complaint to the Court of Appeal. As the public defenders of Fikrat Faramaz oglu testify, the reason for the arrest are materials about high-ranking civil servants containing illegal public dens and casinos.

6. Elchin - the Chief Editor of www.kent.info website

Arrest: February 17, 2017 Charge: Articles 182 (Extortion) and 308 (Abusing official powers) of the Criminal Code of the Azerbaijan Republic Sentence: on September 18, 2017 the Court sentenced to 9 years in prison Judge: Rashid Huseynov

Conclusion: Elchin Ismayilli is a member of the Supreme Council of the Party of the Popular Front of Azerbaijan (PFPA), he wrote critical articles on corruption, and the arbitrariness of local authorities. In 2013, he covered the events in Ismayilli (the protests of local residents were suppressed by the police). E. Ismayilli was convicted for his professional activities. Elchin Ismayilli was prosecuted for critical publications about officials of the . Before the detention, E. Ismayilli wrote a lot about the opening of a new poultry and livestock complex in Ismayilli in 2013-2014, but this did not happen. Also, E. Ismayilli wrote about lawlessness, unresolved social problems, violation of the rights of the residents of the district. On February 15, 2017 E. Ismayilli suddenly disappeared and 2 days did not have any news about him from his relatives. And only on February 17 the family found out that he was being held in a police station and a criminal case was brought against him.

7. Mehman Rafiq oglu Huseynov - blogger, chairman of the Institute for Reporters’ Freedom and Safety (IRFS)

Arrested: March 3, 2017 at the courtroom Charge: Article 147.2 (The slander, which is connected with accusation of committing serious or especially serious crime) of the Criminal Code of the Azerbaijan Republic Sentence: On March 3, 2017 the Surakhany District Court sentenced to 2 years in prison. Baku Court of Appeal upheld this decision on 12 April 2017 (presiding judge - Vaqif Mursagulov) Judge: Jeyhun Qadimov Place of detention: Prison No. 14

Conclusion: Mehman Huseynov was sentenced to 2 years in prison on slander charge. The case against him was filed by the Head of Police Department of Nasimi District Musa Musayev. Police called blogger’s statement on tortures he was exposed to at Police Department of Nasimi District - a sander. Despite of adduction by the defence the proofs of tortures - the photos that showed the traces of violence on blogger’s body, blogger’s stained cloths, the prosecutor’s office refused to open criminal case. Blogger’s trial was accelerated. The court started at 10:30 in the morning, and with two breaks, it finished after three hours. The defence was not provided with any time for preparation. Huseynov stated, that the criminal case against him is the order by authority, he is being prosecuted for his activity as journalist. He denied charge in slander towards police and did not plead guilty. Huseynov stated that he was under watch since December 2016. “Back then they wanted to seize me, but I was able to break loose and to escape. Till January 05, I have not left my home. On January 9, I was again attacked and this happened in front of about 30-40 passers-by. Later, I found out that the operation was headed by the deputy head of the Department for Criminal Investigation of Baku City Police. The bag was put on my head. They tied my arms and legs and pushed me into the car. We drove for an hour. Eventually, they brought me to the room, whereat they began to beat me. Among those who beat me, I recognised policeman Kengerli (last name). In his time, he tortured my brother Emin Huseynov. They told me openly that I was detained for my blogger’s activity, my reportages, and my statuses at social network. Afterwards, they put again the bag on my head and took me to another location. There, they tied my hands and legs again, and someone sat on me. Others were taking pictures and videos. They told me that they were going to disseminate them in internet. There, I was beaten again, and taken to the “chief” room. There, I lost my consciousness, and ambulance was called. Doctors told that I should be taken to the hospital, but the police did not allow that”- said Huseynov. Huseynov told to about these tortures to mass media and in a result, the case under slander charge was fabricated against him. During the trial, on March 3, the lawyer Elchin Sadigov applied to the court, with request to question the witnesses - Ulvi Hasanli, Elchin Sharifov, Masuda Asker and Samir Asadli. They were the last who saw blogger at freedom on January 9, 2017. Lawyer also requested to bring to the court the complainant the chief of Police Department of Nasimi District Musa Musayev, policemen, Kengerli, and the deputy chief of the Department for Criminal Investigation of Baku City Police. Elchin Sadigov also requested to attract video and camera recordings whereat Huseynov was detained - to the court. But Jeyhun Qadimov dismissed lawyer’s application and sentenced Huseynov to 2 years in prison. Huseynov’s conviction is the punishment for his activity as a blogger. On February 27, M. Huseynov disseminated a video poll recorded on the streets of Baku on the legality of the appointment of Mehriban Aliyeva as vice president to the country. Three days later, Mehman Huseynov was convicted.

8. Afgan Sabir oglu Mukhtarli - journalist, former employee of Baku Office of Radio Liberty

Arrested: On May 29, 2017 A. Mukhtarli was kidnapped in Tbilisi and transferred from Georgia to Azerbaijan Charge: Articles 206.1 (Smuggling, is moving large amount through customs border of the Azerbaijan Republic of goods or other subjects, except for ones which provided in article); 315.2 (Resistance or application of violence concerning the representative of authority, committed with violence dangerous to life or health) and 318.1 (Illegal crossing border of the Azerbaijan Republic without established documents or outside of check point of frontier) of the Criminal Code of the Azerbaijan Republic Sentence: On January 12, 2018 the Court sentenced to 6 years in prison Place of detention: Prison No. 16

Conclusion: Afgan Mukhtarli lived for more than two years in Georgia. He left there after Baku Office of Radio Liberty was shut down. Afgan Mukhtarli was actively participating in actions against authorities of Azerbaijan, which were held in Tbilisi. He is also the author of research articles on corruption in the power structures in Azerbaijan. On May 31, 2017, during the hearing at Sabayil District Court, A. Mukhtarli told how he was kidnapped at the centre of Tbilisi on May 29, pushed inside the car, and taken from Georgia to Azerbaijan. According to his testimonies, he was kidnapped by people who spoke in Georgian language. The bag was put on his head. In such way, he was not able to see his kidnappers, but could certainly hear them. After few hours of driving, his kidnappers passed Mukhtarli in to the hands of people who spoke in Azeri language. A. Mukhtarli was severely beaten, there were signs of beatings and tortures on his face and body. 10 thousands euros were put inside his pocket. On June 6, 2017, Baku Court of Appeal chaired by Judge Ilqar Murguzov dismissed the complaint on arrest of journalist A. Mukhtarli. The criminal case against the journalist was forwarded from State Border Service to the Investigation Department for Grave Crimes of the General Prosecutor’s Office. Lawyer Osman Kazimov indicated that the review of the complaint on arrest in Baku Court of Appeal was just a formality. The defence applied with the request to attract video recordings from the camera located at Balakan region checkpoint, which would inevitably confirm the transfer of the journalist through this crossing, and not detaining him at the wrong location. However, the judge dismissed all applications. The ombudsman, civil society activists of Georgia are demanding the full investigation of the involvement of Georgian law enforcement agencies in the kidnapping of A. Mukhtarli. US and EU called for the investigation of kidnapping of A. Mukhtarli and demanded his release. The European Parliament passed a resolution on June 15, 2017 which “strong condemns the abduction of Afgan Mukhtarli in Tbilisi and his subsequent arbitrary detention in Baku” and “considers this a serious violation of human rights and condemns this grave act of breach of law”.

9. Ziya Alirza oglu Asadli - journalist of newspaper Azadliq

Arrested: September 05, 2017 Charge: Article 221.3 (Hooliganism committed with the application of a weapons or subjects used as the weapon) of the Criminal Code of the Azerbaijan Republic Sentence: On September 07, 2018 the Court sentenced to 3 years in prison

Conclusion: Employee of Azadliq newspaper disseminated video, criticising local government. See: https://www.youtube.com/watch?v=y7fRRLjPznk; https://www.youtube.com/watch?v=sqDBqC2vo3I; https://www.youtube.com/watch?v=zJLL44cMmEI According to official version of the charge, Ziya Asadli committed act of hooliganism at the local cafe. However, base on the local’s testimonies, given cafe belongs to the employee of the local police - Major Vaqif and Asadli never visited this cafe. In his testimonies, Ziya Asadli, indicated that on April 19, he was passing by the street near this cafe, and the employee of the cafe attacked him and beat him. Ziya Asadli called to Police (102) and informed police about the attack. Nevertheless, he was charged himself under the article of hooliganism. Ziya Asadli is handicap of second degree and father of two kids.

10. Ikram Rafiq oglu Rahimov - the Chief Editor of www.realliq.info website

Date of arrest: October 26, 2018 Charge: Articles 182.2.1 (Extortion, is requirement to transfer another's property or right on property or commitment of other actions which is admitted as in property nature under threat of application of violence, distribution of data, dishonoring a victim or his close relatives, as well as by threat of destruction of property belonging to them committed on preliminary arrangement by group of persons) and 182.2.2 (Extortion, is requirement to transfer another's property or right on property or commitment of other actions which is admitted as in property nature under threat of application of violence, distribution of data, dishonoring a victim or his close relatives, as well as by threat of destruction of property belonging to them committed repeatedly) of the Criminal Code of the Azerbaijan Republic Sentence: On October 27, 2018 the Sabayil District Court of Baku City chose towards him preventive him in form of arrest for the period of 2 months. On November 01, 2018 the Baku Court of Appeal dismissed the complaint on his arrest Place of detention: Detention Center of the State Security Service of Azerbaijan

Conclusion: On October 26, 2018 Ikram Rahimov was detained by employees of the State Security Service (SSS). Prior to that, he had managed to inform Turan Agency that his car was being pursued by unknown persons. At the trial I. Rahimov stated that he did not commit a crime and the decision to arrest him illegally. He said that his arrest is the order of the assistant to the President Ali Hasanov. “When I was arrested, the first questions were about Ali Hasanov, there were asked me why I wrote an open letter to Hasanov”, - the journalist said. Previously, these sites of arrested journalist Ikram Rahimov are blocked without any warning - (realliq.az, realliqinfo.org, realinfo.az, realliqinfo.com and realliqinfo.az) On November 25, 2016 the Sumgayit City Court sentenced Ikram Rahimov to a one-year imprisonment for libel. On 1 March 01, 2017 the Sumgayit Court of Appeal mitigating their sentences to 9 months of corrective labour. Deemed to have served out his sentences, Rahimov was released in the courtroom.

Writers and Poets - 1 person

11. Tofiq Khasay oglu Hasanli

Arrested: October 12, 2015 Charge: Article 234.4.3 (Illegal manufacturing, purchase, storage, transportation, transfer or selling of narcotics, psychotropic substances, committed on preliminary arrangement by group of persons or organized group in large amount) of the Criminal Code of the Azerbaijan Republic Sentence: On August 22, 2016 the Lankaran Grave Crimes Court sentenced to 6 years in prison Place of detention: Prison No.6

Conclusion: Tofiq Hasanli was criticising government official, writing satirical poems on his Youtube channel and placing them at his social networks. Hasanov wrote satirical poem called “Heydarism”, where he criticised ex president Heydar Aliyev and his son Ilham Aliyev. On January 2015, Hasanli gave interview to Radio Azadliq, in which he told about his latest publications, satirical poems about Heydar Aliyev; and about governmental pressure towards him. On October 2015, it became known via Facebook, that Tofiq Hasanli disappeared, and after 5 days, his relatives informed about his arrest. Tofiq Hasanov was arrested in the shop, where he was working; during the search, which was conducted with numerous violations of law, the “drugs” were found. According to lawyer Elchin Sadigov, Tofiq Hasanli rights were severely violated during investigation and the court hearing.

12. Aliabbas Faxraddin oglu Rustamov - lawyer

Arrested: June 28, 2014 Charge: Article 312.2 (The presentation of a bribe to official for commitment of obviously illegal actions (inaction) by him or repeated presentation of a bribe) of the Criminal Code of the Azerbaijan Republic Sentence: On November 06, 2015 the Baku Grave Crimes Court sentenced to 7 years in jail. Baku Court of Appeal upheld the sentence on August 18, 2016. Supreme Court on February 07, 2017 with its decision shortened the prison term and appointed 6 years of imprisonment Judge: Rahib Salmanov Place of detention: Prison No.10

Conclusion: Aliabbas Rustamov is a member of the lawyer collegium, director of human rights organisation Yasavul. Before his arrest, Rustamov sharply criticised government policy on his Facebook page. During presidential elections in 2013, he actively supported the candidate from opposition Jamil Hasanli - chairman of the National Council of Democratic Forces of Azerbaijan. A. Rustamov participated in the opposition rallies. After elections, he continued to participate in the meetings of NCDF. On March 17, 2014, he published in all newspapers, open letter to Ilham Aliyev, where he criticised government officials for stealing millions from the nation.

13. Ilkin Bagir oglu Rustamzade - the leader of organisation Free Youth

Arrested: May 17, 2013 Charge: Articles 28 (Preparation to a crime); 220.1 (The organization of a mass disorders accompanied with violence, breaking, arsons, destruction of property, application of fire-arms, explosives, and also rendering of armed resistance to representative of authority, or participation in such disorders); 221.2.1 (Hooliganism committed by group of persons or repeatedly) and 221.2.2 (Hooliganism committed with resistance to representative of the authority, acting as on protection of a social order or stopping infringement of a social order or with resistance to other person) of the Criminal Code of the Azerbaijan Republic Sentence: On May 6, 2014 the Baku Grave Crimes Court sentenced to 8 years in prison Judge: Javid Huseynov Place of detention: Prison No.13

Conclusion: Ilkin Rustamzade is a member of the Free Youth organization and the National Council that brings together several opposition parties and civil society organizations. He joined NIDA civic movement in prison as he was charged together with members of this movement. He was studying at the Azerbaijan State Economic University until his arrest. Rustamzade used Facebook to organize a rally under the slogan “No more soldier deaths” in central Baku on 12 January and 10 March 2013 to protest against the illegalities and arbitrariness in the Azerbaijani army, as well as death of soldiers in non-combat situations. The protests attracted a large number of participants. Rustamzade faced pressure from the authorities because of these demonstrations. The detention and investigation took place with numerous of violations of the legislation of Azerbaijan and International law. Detainees were exposed to the tortures. The lawyer of the under age accused Shahin Novruzlu stated at the court hearing, that the interrogation of his client at the preliminary investigation was held without the presence of his legitimate representatives (parents, in the absence of such - the representative of guardianship agency), which is the violation of Article 101 of the law of Criminal Procedure of the Azerbaijan Republic. On November 21, 2013, during preparatory hearing lawyer Ilkin Rustamzade stated that his client’s term of the preventive measure in form of detention ended on November 12, 2013. I. Rustamzade was not released and there is no court order on prolongation of his preventive measure. In such circumstances, there is the violation of the constitutional norm - in particular, Article 28 (Right for liberty) of the Azerbaijan Republic Constitution and articles 5 (1) (Right for liberty and security) of European Convention on human rights and fundamental freedom. Judge Javid Huseynov ignored the request to abide by Constitution. All the actions by Judge Javid Huseynov vividly testify about the ordered political nature of the trial proceedings, where the condemnatory verdicts is easily predictable.

14. Qiyas Hasan oglu Ibrahimov - member of youth organisation NIDA

Arrested: May 10, 2016 Charge: Articles 234.4.1 (Illegal manufacturing, purchase, storage, transportation, transfer or selling of narcotics, psychotropic substances, committed on preliminary arrangement by group of persons or organized group) and 234.4.3 (Illegal manufacturing, purchase, storage, transportation, transfer or selling of narcotics, psychotropic substances, committed on preliminary arrangement by group of persons or organized group in large amount) of the Criminal Code of the Azerbaijan Republic Sentence: On October 25, 2016 the Baku Grave Crimes Court sentenced to 10 years in prison Judge: Anvar Seyidov Place of detention: Prison No.2

15. Bayram Farman oglu Mammadov - member of youth organisation NIDA

Arrested: May 10, 2016 Charge: Articles 234.4.1 (Illegal manufacturing, purchase, storage, transportation, transfer or selling of narcotics, psychotropic substances, committed on preliminary arrangement by group of persons or organized group) and 234.4.3 (Illegal manufacturing, purchase, storage, transportation, transfer or selling of narcotics, psychotropic substances, committed on preliminary arrangement by group of persons or organized group in large amount) of the Criminal Code of the Azerbaijan Republic Sentence: On December 08, 2016 the Baku Grave Crimes Court sentenced to 10 years in prison Judge: Eynulla Valiyev Place of detention: Prison No.13

Conclusion: On May 12, 2016 Ministry of Internal Affairs of the Azerbaijan reported about the detention of the large scale drug dealers. In this case, two youth activists from opposition movement NIDA - Bayram Mammadov and Qiyas Ibrahimov. According to statement by the Ministry of Internal Affairs, about 3 grams of heroin was seized from Bayram Mammadov. During the search at his home at Sabunchi District, more than 1 kg of heroin was seized from there. 2.6 grams of heroin was seized from Qiyas Ibrahimov at detention, and more than 1 kg was found at his apartment. Their lawyer, Elchin Sadigov was not allowed to see young activists, who were detained at Nasimi District Police Department № 12. The detention and investigation took place with numerous violations of the legislation of Azerbaijan and international law. Detainees were exposed to tortures. According to NIDA statement, the real reason behind the detention of these young men was the graffiti they painted on the monument of the former president Heydar Aliyev. On the night of May 10, 2016 there appeared photos on Facebook, with graffiti that read “Happy Slave Day!” painted in white, on both sides of the monument in Azeri and English languages. By the morning all the writings disappeared. After detention, two young men were subjected to severe tortures at the Main Police Department of Baku City. From the testimonies of Qiyas Ibrahimov to Elchin Sadigov “The most of all, they beat me on my head and neck. I lost conscious. They handcuffed my hands to the back and poured water on me, I was told that they called two witnesses, and now they will find drugs on me, and witnesses will see it. Then they took something out from the left pocket of my jacket,. They said it was narcotics. I told that it did not belong to me, that I don’t even smoke, that they planted it, when I lost my conscious. Then they started beating me again. The pain was unbearable” - continued Ibrahimov. At the same time, Mammadov was beaten in another room. When he was screaming, they stopped his mouth and beat on his stomach. “They started beating me again. They demanded from me that I apologise in front of the monument, and lay flowers to it, and AzTV would record it. I refused. Then they demanded that I confess to drugs. I refused again. And they started beating me again. They took of my trousers and threatened to rape me with a baton. I had to admit to false drug charge. Further, they stated that they will also find drugs at our homes. And that I have to admit it. I rejected, and they threatened me with the arrest of my parents” further noted Ibrahimov. On May 12, 2016 lawyer Sadigov saw the traces of tortures and humiliations with his own eyes. But after protest, he was forcibly taken out from the police station. Bayram Mammadov and Qiyas Ibrahimov are recognised as “Prisoners of Conscience” by Amnesty International.

16. Elgiz Jamal oglu Qahramanov - member of youth organisation NIDA

Arrested: August 12, 2016 Charge: Article 234.4.3 (Illegal manufacturing, purchase, storage, transportation, transfer or selling of narcotics, psychotropic substances, committed on preliminary arrangement by group of persons or organized group in large amount) of the Criminal Code of the Azerbaijan Republic Sentence: On January 16, 2017 the Baku Grave Crimes Court sentenced to 5 years and 6 months in prison Judge: Azad Majidov

Conclusion: Elgiz Qahramanov received education in Turkey. After returning home, he leaded politically and socially active life. He participated in rallies of opposition. Youth organisation NIDA nominated him to parliament. The process of detention, search took place with numerous violations. After arrest, he was not allowed to meet with his relatives, he was not allowed to call his family. His parents learned about his arrest after several days. He met with his lawyer only on August 19, 2016 at the Detention Centre Kyurdakhani, after the court chose preventive measure towards him in form of arrest and he was transferred to prison. According to the lawyers, the real reason behind his arrest - is the status he posted on Facebook. There he satirically compared son of Ilham Aliyev with Shah Ismayil.

17. Asif Qambar oglu Yusifli - advisor of chairman of the Popular Front Party of Azerbaijan (PFPA), member of the Board of the PFPA

Arrested: December 25, 2014 Charge: Articles 178.2.4 (Swindle, is maintaining another persons property or buying another persons property by a deceit or breach of confidence committed with causing damage in the significant size) and 320.1 (Fake of certificate or other official document giving the rights or releasing from duties, with a view of its use or selling of such document, as well as manufacturing in same purposes or selling of counterfeit state awards of the Azerbaijan Republic, stamps, seals, forms) of the Criminal Code of the Azerbaijan Republic Sentence: On July 31, 2015 the Baku Grave Crimes Court sentenced to 7 years and 6 months in prison. On October 9, 2015 the Court of Appeal confirmed the verdict. Supreme Court diminished the term to 6 years in prison Judge: Ali Seyfaliyev Place of detention: Prison No.6

Conclusion: Asif Yusifli is an advisor of chairman of the Popular Front Party of Azerbaijan and the member of board this party. On the day of his arrest, A. Yusifli drove to the office of the Party in the car that belonged to the chairman of Narimanov Branch of the PFPA. On his way back, the driver went to the shop to buy some cigarettes, and when he returned, he did not find A. Yusifli in the car. Later, it became known that A. Yusifli was detained by the employees of the Main Department for organised crimes by the Ministry of Internal Affairs. A. Yusifli is handicapped and not long before his arrest, he had operation on his leg. He has two young children. One of his kids is suffering from severe diabetes. A. Yusifli was arrested without sanctions, with brutal violations of law. His guilt was not proven during the trial.

18. Ibrahim Aziz oglu Mammad - advisor to the chairman of the PFPA

Arrested: on September 30, 2015 Charge: Article 221.2.2 (Hooliganism committed with resistance to representative of the authority, acting as on protection of a social order or stopping infringement of a social order or with resistance to other person) of the Criminal Code of the Azerbaijan Republic Sentence: On March 15, 2016 the Narimanov District Court of Baku City sentenced to 3 years in prison. On May 13, 2016 the Baku Court of Appeal (presiding judge Aflatun Qasimov) kept the verdict in power. Arrested again: on September 29, 2018, on the day his term finished, new charge was brought against Ibrahim Mammad Charge: Article 315.2.1 (Preparation, storage, carrying, transportation or use of prohibited items in prison) of the Criminal Code of the Azerbaijan Republic Place of detention: Detention Center in Kyurdakhani

Conclusion: Ibrahim Mammad is an advisor of chairman of the PFPA - the leading opposition party; known for being politically active. He criticised anti-democratic policy of the authorities on his Facebook page, as well as during the opposition rallies and in press. Arrested two days after the PFPA congress. The reason behind his arrest was the statement of Mikayil Quliyev, who was removed from the party PFPA and who accused Ibrahim Mammad in hooliganism. During the trial there was inconsistency between the initial and final testimonies of M. Quliyev. On December 28, 2015, while responding to the lawyers’ questions, M. Quliyev stated that he wants to withdraw the complaint, and he wrote in public a conciliatory statement and handed it to the judge. However, Ibrahim Mammad was convicted.

19. Fuad Ali oglu Qahramanly - deputy chairman of the chairman of the PFPA

Arrested: on December 08, 2015 Charge: Articles 220.2 (Appeals to active insubordination to legal requirements of representatives of authority and to mass disorders, as well as appeals to violence above citizens); 281.2 (Public appeals directed against the state, committed repeatedly or by group of persons) and 283.2.1 (Excitation of national, racial or religious hostility committed with application of violence or with threat of its application) of the Criminal Code of the Azerbaijan Republic Sentence: On January 25, 2017 the Baku Grave Crimes Court sentenced to 10 years in prison Judge: Alovsat Abbasov

Conclusion: F. Qahramanly is known as organiser of many opposition rallies, as well as the author of the critical articles about the corrupted officials. After special operation of Ministry of Internal Affairs taken place on November 26, 2015 in Nardaran village, Fuad Qahramanly criticised the massacre by authority against the innocent peaceful believers, including T. Bagirzade via social networks. After 10 days, F. Qahramanly was summoned to the police station and arrested. The analysis of F. Qahramanly status at social networks at Facebook, is the evidence that all the changes against him are groundless. Amnesty International recognized Fuad Qahramanly as a prisoner of conscience.

20. Fuad Zafar oglu Ahmedli – the head of the Youth Committee of Khatai District Office of the PFPA

Arrested: August 18, 2016 Charge: Article 302.1 (Implementation operative - search actions by not authorized persons, as well as implementation of these actions by authorized persons, but without grounds provided by the legislation, entailed essential infringement of rights and interests of person protected by the law) and 308.1 (Abusing official powers, that is deliberate, contrary to interests of service, use by the official of service powers from self-interest or other personal interest, causing essential harm to rights and legitimate interests of citizens or organizations or protected by law interests of a society or state) of the Criminal Code of the Azerbaijan Republic Sentence: On July 16, 2017 the Baku Grave Crimes Court finished the process on the case of Fuad Ahmedli. The court re-qualified the charges under article 308.2 (Abusing official powers entailed heavy consequences) to the first paragraph of this article (Abusing official powers without aggravating circumstances), and issued a sentence of 4 years in prison Judge: Fikrat Qaribov

Conclusion: F. Ahmedli is the head of the Youth Committee of Khatai District Office of the PFPA. He constantly posted critical articles at social networks about the policy of Ilham Aliyev. In 2015, F. Ahmedli was twice arrested for participating in opposition rallies for 25 and 10 days. After the failed coup in Turkey, on July 15, 2016, Azerbaijan authorities started arresting opposition activists under the bogus charge of having connection with so-called Gulen cemaati (Gulen’s community) - followers of Fathullah Gulen. F. Ahmedli was among them. During unauthorises search at Ahmedli’s house, the brochures and statements of Fathullah Gulen, including documents allegedly confirming the membership to Gulen’s community were found. Relatives found out about his arrest only 10th day. The lawyer was only allowed to see him on the 10th day of his arrest at Detention Centre of the State Security Service (former Ministry of National Security). Then he was transferred to Detention Center in Kyurdakhani.

21. Gozel Bayramly - deputy chairman of the chairman of the PFPA and member of the National Council of Democratic Forces

Arrested: May 25, 2017 Charge: Article 206.1 (Smuggling, is moving large amount through customs border of the Azerbaijan Republic of goods or other subjects, except for ones which provided in article) of the Criminal Code of the Azerbaijan Republic Sentence: On January 23, 2018 the Qazakh District Court sentenced to 3 years in prison Judge: Agarza Samadov

Conclusion: On May 25, 2017 in the evening, G. Bayramly was detained upon her return to Azerbaijan from Georgia. According to the State Border Service of Azerbaijan undeclared amount of 12.000 USD “was found” on her. On May 26, 2017 the Baku City Sabayil District Court chose prevention measure towards G. Bayramly in form of arrest for period 3 months. Her lawyer informed that Bayramly denied the charge of smuggle attempt of undeclared 12.000 USD. Bayramly told that law enforcement officers placed money stealthily inside her bag. The defence applied to the court with the request to conduct the examination of the fingerprints on these banknotes and their packages; as well as to examine the video recordings of the camera from the check point where Bayramly was held from the evening of May 25, from 08 pm till 06 am morning of May 26, 2017. However, the application was dismissed. Gozel Bayramly is the 8th activist (including journalist Seymur Hazi) from PFPA who is being deprived of freedom.

22. Aliakram Khurshudov - chairman of Shirvan City Branch of Musavat Party

Arrested: November 22, 2017 Charge: Articles 221.2.2 (Hooliganism committed with resistance to representative of the authority, acting as on protection of a social order or stopping infringement of a social order or with resistance to other person) and 221.3 (The hooliganism committed with application of a weapon or subjects, used as the weapon) of the Criminal Code of the Azerbaijan Republic Sentence: On May 04, 2018 the Shirvan District Court sentenced to 5 years in prison. The following articles of the Criminal Code of the Azerbaijan Republic were incriminated against him in final indictment: Articles 221.3 (The hooliganism committed with application of a weapon or subjects, used as the weapon) and 315.2 (Resistance or application of violence concerning the representative of authority, committed with violence dangerous to life or health) Judge: Elchin Qurbanov

Conclusion: On November 22, 2017 A. Khurshudov was doing some repairs at private apartment. In the evening, the owner of the apartment came, and accused Khurshudov in “molesting” his family members. The argument started, after which two more men appeared and attacked Khurshudov. Then policeman arrived and accused Khurshudov in insubordination and injuring him. Afterwards, he was taken to the Police Department. On November 23, he was interrogated early in the morning, about 4 am. The lawyer noticed that this fact already indicates the “special interest” to this case. Khurshudov confirms that he had argument with the owner, but he did not injure the policeman and did not raise his hand to the owner. He also denies all allegations of harassment. It is noteworthy, that on November 21, 2017 Khurshudov wrote on Facebook about the forced mass admission of employees of the local maternity hospital to the ruling New Azerbaijan Party. This publication caused his criminal charges.

23. Orhan Bakhyshly - member of Youth Committee of the PFPA and Vice-Chairman of Khatai branch of Youth Committee of PFPA

Arrested: May 07, 2018 Charges: Article 234.4.3 (Illegal manufacturing, purchase, storage, transportation, transfer or selling of narcotics, psychotropic substances, committed on preliminary arrangement by group of persons or organized group in large amount) of the Criminal Code of the Azerbaijan Republic Sentence: On September 18, 2018 the Baku Grave Crimes Court sentenced to 6 years in prison. Judge: Mahmud Agalarov

Conclusion: Orhan Bakhyshly is a member of Youth Committee of the PFPA and deputy chairman of the Khatai branch of PFPA Youth Committee. Chairman of Khatai department Fuad Ahmedli is currently political prisoner. Fuad Ahmedli was arrested on December 25, 2015. On June 16, 2017, Baku City Court on Grave crimes sentenced him to 4 years in prison). Orhan Bakhyshly leaded active political and social life. He often criticised policy of authorities during different events, and at social networks. He was also responsible for organising various PFPA events. On the eve of March 31, 2018 rally, organised by National Council of Democratic Forces of Azerbaijan, several members of PFPA were brought to administrative responsibilities: Abdullah Mahmudov to 30 days (on March 26, 2018), Ayaz Qasimov to 15 days (on March 29, 2018), Orhan Bakhyshly to 30 days (on March 27, 2018). All the detainees were accused of committing the offence under Article 535.1. (insubordination to legal demands of police) of the Criminal Code of the Azerbaijan Republic on administrative violation. Young activists who organised the rally were arrested on the eve of the rally. On May 3 2018, on the World Press Freedom Day, during his speech at the grave of killed journalist Elmar Huseynov O. Bakhyshly accused Azerbaijani authorities in his murder. Already on May 7, he was arrested. Bakhyshly denies the charges, indicating that he does not even smoke. According to activist, drugs were planted to him by police officers.

24. Saleh Rustamov - former head of the executive authority of in 1992-1993, during the rule of Popular Front of Azerbaijan

Conclusion: Saleh Rustamov was the head of the executive authority of Gadabay District in 1992-1993, during the rule of the Popular Front of Azerbaijan. He lived in Russia for the last 20 years. He visited Azerbaijan once in a year. On May 08, while retuning home, he was detained in District. He was charged in drug trafficking. On May 10, his nephew, Vidadi Rustamov was arrested under same charge. After 2014-2015 events, independent non-governmental organisations and the representatives of civil society in Azerbaijan became deprived of any possibility to receive financial assistance from foreign donors. Azerbaijan authorities started persecuting who live abroad, and who provide support to the opposition and political prisoners in the country. Since the beginning of May 2018, the arrests of Azerbaijani activists living abroad, but aiding financially, sending donations to Azerbaijan, trying to support with medicine and products the political prisoners - began. There are tenth of people in prison who are not receiving food parcels.

Arrested: May 25, 2018 Charge: Articles 192.2.3 (Illegal business committed with extraction of income in the significant size by organized group); 193-1.3.1 and 193-1.3.2 (Legalization of money or other property obtained by crime committed in the large size) of the Criminal Code of the Azerbaijan Republic. On May 25, court chose preventive measure towards R. Nasirli in form of arrest for the period of 4 months. On May 31, 2018 the Baku Court of Appeal dismissed the complaint on his arrest. Place of detention: Detention Center in Kyurdakhani

Conclusion: On May 25, 2018 activists of the PFPA - Aqil Maharramov, Ruslan Nasirli and Babak Hasanov were arrested. They were prosecuted together with the former head of Gadabay district of Azerbaijan Republic Saleh Rustamov and his nephew Vidadi Rustamly. All were accused of “laundering dirty money”; which reflected itself as a result of transfer to Popular Front Party the donations collected from Azerbaijanis living in Russia. After 2014-2015 events, there was no possibility for independent NGO’s to provide financial aid to political prisoners. Living in political emigration Azerbaijanis started sending donations to Azerbaijan, trying to support political prisoners with the medicine and products.

29. Azad Hasanov – activist of opposition Musavat Party

Conclusion: Azad Hasanov is an activist of the opposition Musavat party since 2003. In 2010, he was a member of the election campaign Committee of the chairman of the party Musavat Arif Hajili in the presidential elections and for this reason was subjected to pressure from the authorities. In 2014, he was forced to leave his homeland and obtained political asylum in Lithuania. On October 10, he returned to Baku to visit his seriously ill father, who may die soon. The next day, on October 11 he was detained and escorted to the Baku Police Headquarters. The detainees did not introduce themselves that they were from the police. The police planted drugs on him, demanding to give a confession, threatened to torture him. He was forced to write what they dictated to him. Hasanov himself spoke about this at the meeting of the court of appeal. Azad Hasanov is known for his critical status against Ilham Aliyev in social networks. His arrest has the purpose to intimidate members of opposition living in emigration.

30. Abulfaz Sadiqbeyli - the head of the Youth organization of the Musavat Party

Conclusion: Abulfaz Sadiqbeyli, was arrested on a trumped-up charge. According to the Chairman of the Musavat Party Arif Hajili, A. Sadiqbeyli arrested in criminal case in connection with granted years ago in Nikoil Bank and already repaid the loan. "There are documents returning this loan. However, the Bank had falsified documents. Abulfaz Sadiqbeyli was questioned as a witness in this case. But when they learned that he is head of the Youth organization of the Musavat Party, investigation was directed against him," said Arif Hajili. The criminal proceeding against A. Sadiqbeyli linked to his political activities and is an integral part of the policy of persecution of the Musavat Party.

Conclusion: On January 13-18, 2007 about 30 people were arrested in Baku in the Said Dadashbeyli case. Some of the detainees were released later under the condition to witness against the rest 11 people being kept in the National Security Ministry (MNS). The law was grossly offended already at the start of the arrest of the accused: without a court ruling, without presence of the very accused and without arrest witnesses independent from the special services, the MNS officers were breaking into the apartments of the accused and were openly planting the arms and other “evidence” despite the protesting and outraged relatives. All this grossly violates Article 125 of the Criminal Code of Azerbaijan. The first days after the arrest, none of the arrested was offered an opportunity of employing counsel. During the first seven months of the investigation none of them was delivered to court to bring charges against, to issue an arrest warrant and pass a court decision on placement in custody for the period of the investigation. This also shows the gross violation of the law. The accused were for the first time delivered to court, to the first session of the Grave Crimes Court only on September 17, 2007, in other words 8 months after the arrest! All the investigation long and before the trial, from January 13 to December 11, 2007, the accused were put into solitary cells of the MNS and tortured. They were frequently beaten, deprived of sleep, water and food; psychotropic medication was used against them; the MNS threatened to use violence against their family members if they refused to confess as the investigation wanted. In March 2007 one of them, Emin Mammadov, died of brutal torture. His death was medically certified of the causes. During several months his parents and the public were not informed about his death. His family was threatened with new repressions should they turn to human rights defenders and even get the public to question the whereabouts of killed Emin Mammadov. When the lawyer inquired about his whereabouts of investigated E. Mammadov, the MNS replied that they did not know anything about this person – he was allegedly never taken to the MNS. Moreover, the name of Emin Mammadov was never mentioned during the court hearings. He disappeared completely for the court and the public. The trial was closed. Even the relatives were not allowed in! But according to Article 200 of the Code of Criminal Procedure of Azerbaijan, a court hearing can be closed and non-public when a state secret is available. But the indictment does not mention a state secret, nor does it refer to Article 200 of the Code of Criminal Procedure of Azerbaijan to ground the closed hearing. Therefore, the closed hearing of the case was illegal and added to gross violation of law. In the course of the trial, the accused flatly denied all the charges, told about the tortures and other abusive treatment they suffered. As it turned out during the trial, many of the accused of creating a underground terrorist organization in fact did not even know each other! None of the charges was proved. But the trial, however, ended in the victory of the prosecution.

Conclusion: The Islamic Party of Azerbaijan (IPA) was founded in 1991 in Baku and registered in 1992. Although the IPA’s registration was revoked in 1995 by the Supreme Court, its activity was not actually banned. Thus the party is still operating without registration. When Movsum Samadov was elected as the Party Chairman in 2007, the party applied to the Ministry of Justice for registration. The Ministry did not register the party. At the IPA General Assembly held on January 02, 2011, Samadov made a speech strongly criticizing President Aliyev for the social situation in the country. In his speech, Samadov referred to articles from the Washington Post and the New York Times about villas in Dubai reportedly owned by the president and his son, adding that the wealth of the Azerbaijani people and state had been stolen; there were no jobs for Azerbaijani youth despite the country’s great wealth; injustice and bribery ruled in the country; the money spent on the Flower Festival to celebrate the birthday of former President Heydar Aliyev was essentially stolen from the people; and idolatry was promoted in the country by idolizing Heydar Aliyev. Samadov’s speech went viral on social media networks, particularly on YouTube, leading to broad discussions. Five days after this speech was made, on January 07, 2011, Samadov and many of his fellows were arrested and charged in preparation of a terrorist act and a coup. However, in court Movsum Samadov and other arrested believers categorically rejected all charges and stated that law enforcement officials planted them weapons during the arrest, then tortured during the investigation. During the trial the prosecution had failed to prove the fact of preparation of terrorist act and a coup. But the court nevertheless agreed with the arguments of the prosecution and sentenced to large period of imprisonment.

Conclusion: Abgul Suleymanov is well known in Azerbaijan as a religious activist and influential religious figure. Abgul Suleymanov, who was teaching the Koran and Islamic religion since 2001 on a mobile basis, helped to establish the “National Moral Values” Public Union in 2005. On 12 August 2011, the Ministry of National Security (MNS) and the Prosecutor General’s Office released a joint statement saying Suleymanov and journalist Ramin Jahangir oglu Bayramov and IPA member Arif Gulsuvar oglu Ganiyev who were arrested together with him were suspected of assisting a foreign state and its delegates in conducting enmity against Azerbaijan, as well as inciting mass disorders and violation of public safety, and encouraging people for disobedience. The statement went on to say that Suleymanov, with financial support from the Baku-based Cultural Center of the Islamic Republic of Iran, created and led a radical religious group called “Jafari” without official state registration. All three were sentenced to pre-trial detention. Although they were subject to a joint investigation, their trials were conducted separately, in conflict with the statement released on 12 August. The district courts sentenced Ramin Bayramov and Arif Ganiyev to 1.5 years in jail (Ramin Bayramov was recognized by Amnesty International as a prisoner of conscience; both men have since been released). But Suleymanov’s case was heard by the Baku Court of Grave Crimes. The trial started in August 2012. The last decision about Suleymanov’s pre-trial detention was issued by the Sabayil District Court on 6 April 2012. The decision stated that his pre-trial detention was extended to 11 May 2012. This clearly showed that Suleymanov was detained in prison for three months (from May to August 2012) illegally, that is, without a court decision. During the investigation and at the trial Abgul Suleymanov stated about the falsification of the charges against him and indicated that weapons and drugs were planted by police officers. Abgul Suleymanov is a victim of political repressions against popular religious figures.

First they were accused of hooliganism (Article 221.2 of the Criminal Code of the Azerbaijan). Subsequently new articles were added: 233 (Organization of actions promoting infringement of a social order or active participation in such actions); 283.1 (The actions directed on excitation of national, racial or religious hostility, humiliation of national advantage, as well as actions directed on restriction of citizens rights, or establishment of the superiority of citizens on the basis of their national or racial belonging, creeds committed publicly or with use of mass media); 315.2 (Resistance or application of violence concerning the representative of authority, committed with violence dangerous to life or health) and 324 (Violation of the National Flag or State Emblem of the Azerbaijan Republic) of the Criminal Code of the Azerbaijan Republic. In addition, some were accused with drug possession. On April 05, 2013 the Lankaran Court of Grave Crimes found all of them guilty and sentenced to various terms of imprisonment. Conclusion: Together with the Chief Editor of the religious website azadxeber.org Nijat Aliyev (in the list at No. 1) on May, 2012 were arrested also 8 people. All of them were accused with creation of organized criminal group, religious incitement and appeals to seizure of power. In reality many of them before his arrest did not even know each other. During the trial, defendants stated that they were tortured during the investigation. They are a victim of political repressions of the protests on the Internet and social networks with regard to the holding of the Eurovision in Baku. Currently, two out of ten people have served their sentence.

55. Elshan Mustafaoglu – scholar and theologian

Conclusion: Doctor (Ph.D.) Elshan Mustafaoglu worked in 2006-2007 on Public TV and led the most popular program about religion "Friday conversations". Also in 2007, on ANS TV he led a program "About God and Religion". At the trial E. Mustafaoglu categorically rejected all the charges and said about systematic tortures during the investigation. The defendant’s lawyer Afgan Mammadov stated that there are no materials demonstrating validity of the accusations.

ARRESTED ON NARDARAN CASE, INCLUDING MEMBERS OF THE MUSLIM UNITY MOVEMENT - 62 PEOPLE

Explanation about Nardaran case and Muslim Unity Movement

There are arrested at different times and in different places and are the victims of political repressions of regime that brooks no dissent and criticism. There are all residents of Nardaran village which is located 40 km from Baku, has low standards of living and acute unemployment problem. One of the most respected by Shiites mosques, founded in the 8th century, is located in Nardaran. Nardaran differs from other Baku villages with its religiosity. In 2000, 2002, and 2006, the residents of Nardaran held peaceful protests with socio- economic demands. In June 2002, police carried out military operation in the village, as a result of which 28 people were injured, one died. 23 people were sentenced to various terms of imprisonment on falsified charges; in espionage in favour of Iran, in attempt of violent change of power, and etc. However, as a result of the active work of human rights defenders, none of them remained in the custody after 2005. On November 26, 2015, there was another police operation in Nardaran. Armed with automatic weapons, the police entered the village and opened heavy fire. As a result, 6 people were killed, including two police officers. Dozens of citizens were arrested. The Ministry of Internal Affairs and General Prosecutor’s Office issued the joint statement, in which they explained the use of firearms against the villagers as an operation necessary to neutralise a criminal armed group that functioned under a religious cover, which planned mass riots, terrorist acts and destabilisation of the socio-political situation in the republic. On July 19, 2016 the trial of 18 defendants in the Nardaran case was held in the Baku Grave Crimes Court. During the trial all the accused testified that both the policemen and four residents of Nardaran were killed by the police officers. On the trial defendants informed that the police beaten them to death in a car in which they were transported to the Main Directorate for Combating Organized Crime (MDCOC) of the Ministry of Internal Affairs. The accused told about brutal tortures to which they were subjected in the MDCOC. All appeals of lawyers to the Prosecutor's Office to the need of investigation of the facts of tortures and crimes of law enforcement officers were ignored. Taleh Bagirov testified that he was beaten and tortured more than 30 days so he testified against leader of the opposition Popular Front Party of Azerbaijan Ali Kerimli and chairman of the National Council of Democratic Forces Jamil Hasanli. During the trial in the Baku Grave Crimes Court, the accused refused the primary testimony given during the investigation, indicating that they had testified under torture. The majority of those arrested had no lawyers, all witnesses against them were police, and many of believers were convicted without trial. But when conducting trials, there were no evidence against the accused presented at these trials. We divided 62 political prisoners in so-called Nardaran case into four groups.

Conclusion: M. Akhundzada studied at religious educational school (madrasa), on social networks wrote critical articles about the policy of the authorities of Azerbaijan. He was arrested after the “Nardaran events", when come back home from Iran. M. Akhundzada is a son of Ruhulla Akhundzada (in our list No. 43), who was arrested in 2011 for political reasons. The arrest of members of families of political prisoners who continue to speak critically against policy of authority is common practice in Azerbaijan

Date of arrest: February 22, 2017 Charge: Articles 168-1.3 (Repeated action of violation of the procedure for religious propaganda and religious ceremonies, including by conducting of Islamic rites by a citizen of Republic of Azerbaijan who has received their religious education abroad) of the Criminal Code of the Azerbaijan Republic Sentence: On July 03, 2017 the Masally District Court sentenced to 3 years in prison

Conclusion: The theologian was arrested on the complaint of the Chairman of the Executive Committee of Masally City. The investigation took place more than a month, but without results. The article incriminated to the theologian does not involve arrest and detention for the period of investigation. There is a complete violation of all the rights of the arrested person. The prosecution said that S. Babayev broke the law – he had no right to hold religious ceremonies at the mosque because he was a graduate of a foreign religious university. Allegedly he repeatedly made warning, but he ignored them. In response, the lawyer pointed out that Sardar Babayev graduated from a foreign Islamic University in 2000, while legislative restrictions on conducting of religious ceremonies of graduates of foreign universities was introduced in 2015, and the law could not retroactive effect. In addition, all heads of the Board of Muslims of Caucasus also educated abroad. In fact, S. Babayev was arrested for his independent position and had raise in his sermons social problems.

Conclusion: On November 26, 2015 the joint operation of the Ministry of Internal Affairs, the Prosecutor General's Office and State Security Service was carried out exactly in the house of Abulfaz Bunyadov, where the Chairman of the Muslim Unity Movement Tale Bagirzade was praying (namaz) together with other believers. As a result of the police shooting A. Bunyadov was wounded. This injury has caused him full paralysis, and A. Bunyadov became bedridden. However, despite his paralysis, A. Bunyadov was sent to Baku Pre-trial Detention Centre No. 1 on a stretcher. Then the measure of restraint in the form of detention was changed to police supervision. A. Bunyadov was sent home. On August 17, 2017 the Baku Grave Crimes Court started the process of A. Bunyadov. The trial was repeatedly postponed, because A. Bunyadov was confined to the bed and was not able to appear in court. Six months later, on February 20, 2018, he was brought to the court on a stretcher. Prior to the trial, the health condition of A. Bunyadov sharply deteriorated. Ambulance was called to the court. However, the judge Afgan Hajiyev said that doctors do not have any objection of A. Bunyadov presence at the court, lying on a stretcher. From the courtroom A. Bunyadov was taken to Gobustan prison on a stretcher…

114. Ahsan Nuruzada - activists of the Muslim Unity Movement

Conclusion: Ahsan Nuruzada actively participated in the protection of the rights of arrested members of the Muslim Unity Movement, assisted in covering of the trial in media and social networks. In 2016, twice was detained administratively. On October 06, 2017, A. Nuruzada was again detained in the courtyard of his house by persons in civilian clothes. Three days the lawyer appealed to the police and the courts, trying to establish his location. But only on the evening of October 09, 2017 in the Pre-trial Detention Center No. 1 of Kyurdakhani confirmed that A. Nuruzada transferred to the detention centre.

Conclusion: On May 6, 2011 Elshan Abbasov participated in the rally of believers in front of the Ministry of Education demanding the lifting of the ban on wearing hijab (hijab is a Muslim woman's headdress) in schools. For participation in this rally was arrested and sentenced to 2 years in prison on charges of public disturbance. After the arrest of the activists of the Muslim Unity participated in trials, rallies in support of the movement. As result, was arrested without the sanction of the prosecutor and without participation of witnesses.

Conclusion: Shamkhal Eyvazov is a theologian, studied in Iran in the Qum City, actively participated in publishing site www.sizinyol.com . For this, his family for a long time is controlled by the police. On April 16, 2018, Shamkhal Eyvazov together with his brother Migdad Eyvazov passed a customs inspection at the border with Iran and were detained and taken to the Main Directorate for Combating Organized Crime of the Ministry of Internal Affairs of Azerbaijan, where illegally detained more than 4 days. Only then they announced a ban on leaving the country. The arrest of Eyvazov Shamkhal is a continuation of repressions against peaceful believers.

Conclusion: Until his arrest, Seyidov was the Deputy Chief of the Yasamal branch of Texnikabank. He was arrested by the Ministry of National Security that is unacceptable, because under these articles conducts the investigation the Prosecutor's office or the Ministry of Internal Affairs. Initially, he was charged with fraud. But later a more serious charge was brought. No investigative measures were taken in the first 9 months after his arrest. His pre-trial detention was extended without any grounds, although extension of pre-trial detention for these crimes can take place in exceptional cases. Conclusion: Murad Adilov is a brother of Natiq Adilov – Azerbaijan Popular Front Party press secretary and one of the presenters of Azerbaijan Saaty (Azerbaijan hour) TV. Natiq Adilov has left Azerbaijan for France because of political persecution. Murad Adilov is one of the persons arrested in the course of the campaign against Azerbaijan Saaty. Specifically, close relatives of Ganimat Zahid, the head of this program, have also been arrested and received severe punishments under the same charges that were brought against Murad Adilov. Since 2014 in Azerbaijan began to arrest relatives of journalists living outside Azerbaijan and cooperating with this TV. Adilov Murad was arrested in . He reported that was subjected to torture and inhumane treatment at the police station at the time of arrest in Sabirabad region and later in the police station in Baku where he was held. His reports and official appeals have not been properly investigated. Although the bruises observed on his body were recorded during his transfer to Baku Pre-trial Detention Facility, this fact was not investigated either. The court proceedings show that the investigation was biased; the evidence used only included the testimonies of police officers and search witnesses. Only one room of the large house owned by Adilov’s family was searched before it was claimed that drugs were found in that specific room. If the operation was indeed aimed at finding drugs, it must have covered the whole apartment. M.Adilov is married. He has 3 underage children the eldest one being 7 years old. Conclusion: Ali Insanov was one of the founders of the ruling New Azerbaijan Party (YAP). He served as the Minister of Health from 1993 to the time of his arrest. At the meetings of the YAP Management Board ahead of the parliamentary elections of November 2005, Insanov voiced severely critical opinions saying that there were criminals in the government, and that the incorrect policies being pursued needed to be changed, otherwise the government would be deceiving the people. Insanov was arrested 16 days before the 2005 parliamentary elections and initially was charged with plotting a coup (state media also published information of this kind), although he was later convicted of economic crimes. Insanov applied to the European Court of Human Rights (ECtHR) with regard to violation of his rights envisaged in Article 3 (prohibition of torture) and Article 6 (right to a fair trial) of the European Convention of Human Rights and Fundamental Freedoms. On 14 March 2013, the ECtHR found evidence of violation of both rights. The Court ruled that the former minister’s right for defense and other procedural rules were violated and that there was a need for additional investigation. The Court ordered the Azerbaijani government to pay a fine of 10,000 EUR. On 15 November 2013, the Supreme Court, based on the ECtHR judgment, sent the case to the Baku Court of Appeal for reconsideration. During the next trial session, Insanov was put in a glass cage, and the judge did not allow him to talk (the judge turned off his microphone while he was voicing critical opinions). On 25 February 2014, the Court of Appeals upheld the 11-year prison sentence. PACE Resolution № 1545 of 2007 called for a fair trial of Ali Insanov. A report released by former PACE co-rapporteurs for Azerbaijan Andres Herkel and Evguenia Jivkova in March 2008, and a PACE resolution of 24 July 2008, also include points of concern related to Insanov’s case. Thus, the Azerbaijani authorities have not complied with the decision of ECtHR concerning Ali Insanov. In October 2016, 8 days before the end of his sentence, Insanov was transferred from the prison colony to the Detention Center №1 of Kyurdakhani and charged with new offences. On October 11, 2016, the Qaradaq District Court of Baku City by the request of the district Prosecutor's office ordered a decision on the detention of Insanov for three months on charges of possession and distribution of drugs and resisting authorities. The Baku Court of Appeal dismissed the complaint of ex-Minister of Health Ali Insanov to arrest for three months on new charges. Not even an Insanov was brought to trial. Ali Insanov, detained in prison already 11 years, called the charges falsifications in order not to let him out of prison. The fact that 73-year-old Insanov was not released even after 11 years of imprisonment and sentenced to 7 years, clearly confirms the political order.

Conclusion: Vaqif Ibrahimov is the non-party ordinary civil servant, who publicly criticized the administration of Ismayilli, where he lived. V. Ibrahimov passed his articles criticizing the local authorities to the journalist Elchin Ismayilli. He also given an interview to journalists on January 23, 2013 about the unlawful expulsion from homes of 35 poor families to build on this part hotel "Chirag" by the local administration. Almost a month after the interview, he was arrested. Socio- economic protests in the provinces of Azerbaijan are gaining momentum: in the Guba District in March 2012, in the Ismayilli District in January 2013. Vasif Ibrahimov was charged of organizing of social protests in January 2013. Public criticism of local authorities even severely punished.

Conclusion: Rufat Safarov is the son of Eldar Sabiroglu, one of the founders of ruling New Azerbaijan Party who was a former press service head of the Defence Ministry and a former MP as well. Rufat Safarov worked as an investigator at the Prosecutor’s Office. In a protest to gross violations of law, injustice and infringement of human rights, he resigned from his position in December 2015 and sent a relevant letter to the General Prosecutor’s Office. He publicized the letter via press as well. Safarov stated on social networks that he moved to the opposition and would fight against injustice from now on. Safarov cited the unfair pressures on his father as one of the reasons leading to his resignation as well. Specifically, pressures against Safarov’s father started as he strongly criticized Ramiz Mehdiyev, head of the Presidential Administration. Immediately after this statement opened a criminal case against him. During the trial, the testimony of "witnesses" of the prosecution contradicted their previous testimony given during the investigation. All protests of the lawyer were rejected.

Conclusion: Since 2015, Azerbaijan is experiencing an economic crisis: increased prices for basic foodstuffs and on utilities. Refugees and internally displaced persons from the territories occupied by Armenia were the most difficult situation. As a result, the number of socio-economic protests by citizens had increased. On December 22, 2016 in Bilasuvar district internally displaced persons organized a peaceful action due to the lack of gas in the winter and blackouts. The protesters demanded an answer to their repeated complaints from local governments. The action was dispersed by the police. In doing so, participants of the peaceful demonstration were injured. Five people were arrested on the order of the head of the Executive power of Bilasuvar district and criminal cases were initiated against them.

Conclusion: Due to the difficult economic situation in the regions, unemployment, low pensions and a sharp rise of the food prices, residents of Siyazan City came to the peaceful protest demanding better living conditions. The local authority used force and dispersed the protesters. Conclusion: In 1993-1997 the ruling regime of Azerbaijan condemned a large group of veterans of Karabakh conflict – soldiers and police officers for political reasons to death under the Criminal Code approved by the law of the Azerbaijan SSR on December 08, 1960. All convicts were tortured, some died in prison before the trial. On 10 February 1998, the Parliament of the Republic adopted the law On amending the Criminal Code, the Criminal Procedure Code, and the Correction-Labor Code, to abolish the death penalty in Azerbaijan. Article 4 of this law stated that the punishment of persons sentenced to the death penalty prior to the law taking force, shall be replaced with a sentence of life imprisonment. In fact, death penalty was replaced with a type of punishment that was not enshrined in any legislation at the time. The new Criminal Code of Azerbaijan Republic, which provides for the punishment of life imprisonment, entered into force in 2000. The old Criminal Code, which was in force until 2000, did not provide for life imprisonment, but for the death penalty and a maximum term of 15 years of imprisonment. Therefore, all persons sentenced to the death penalty before 2000 should have to replace the penalty to 15 years of imprisonment or to judge again. It is not legally lawful for them to replaced the death penalty for life imprisonment without trial and a court verdict on the basis of a decision of Parliament. When Azerbaijan joined to the Council of Europe in 2001, the Institute for Peace and Democracy (Director Leyla Yunus) presented a list of 716 political prisoners to the CoE experts. This list included also mentioned above 14 people. All of them were found for political motives.
