The following members of the public addressed the meeting regarding the Plans List Items indicated:

Plans List Item 1 – Mr Garrens spoke in favour of the application and Mr Whiteley spoke against the application. Plans List Item 3 – Mr Thurlow spoke in favour of the application. Plans List Item 4 – Due to adverse weather conditions Mr McMullen was unable to attend the meeting, as such the Head of Development Management read out a report received from him in favour of the application. Plans List Item 5 – Mr Edmunds spoke in favour of the application. Plans List Item 7 – Mr Edmunds spoke in favour of the application. Plans List Item 9 – Mr Lewis spoke in favour of the application. Resolved: (a) That with regard to all applications listed in the report and subject to: (i) the amendments specified below; and (ii) the imposition of conditions in accordance with the relevant provisions of Sections 91-94 of the Town and Country Planning Act 1990, except in those instances where an alternative condition is contained in the Director of Planning’s recommendation or in an amendment referred to in (i) above; decisions be given in accordance with the Director of Planning’s recommendations:

NYM/2011/0692/FL – Creation of a new branch of the International Centre for Birds of Prey with aviaries, education centre, paths, staff accommodation and associated works at Duncombe Park Parkland Centre, Helmsley for Mr Charles Heap, International Centre for Birds of Prey. Loand House, Wrelton, Pickering, North Yorkshire, YO18 8HF. Decision Deferred at Officer’s request in order to address tree and ecology concerns raised. 3. NYM/ 2011/0752/FL – Permission for temporary exploratory potash borehole and associated plant, equipment including drilling rigg (max height 33 metres) and access arrangements at Derwent Head Rigg, Langdale Forest, Fylingdales Moor for York Potash Ltd, fao: Mr Richard Hunt, 2 Langley House, Wykeham Business Park, Wykeham, Nr Scarborough, North Yorkshire, YO13 9PQ. Decision Helen Swiers and Tim Lawn declared a personal and prejudicial interest in this item as landowners with mineral rights and Helen Swiers as member of the York Potash Forum, and left the room. No actual drilling associated with the development hereby permitted shall take place until a detailed Drilling Method Statement has been submitted to and approved in writing by the Local Planning Authority. Decision Helen Swiers and Tim Lawn declared a personal and prejudicial interest in this item as landowners with mineral rights and Helen Swiers as member of the York Potash Forum, and left the room. Herbert Tindall chaired this application in Tim Lawn’s absence. Approved as recommended with the Director of Planning to clear the receipt of satisfactory details which address grassland issues and with an amendment to condition 1 and three additional conditions as set out on the Members Update Sheet: 1. NYM/2011/0552/FL – Construction of 1 no. single storey dwelling with amenity space together with creation of amenity space for existing 2 no. flats at Land at Brook Lane, Thornton le Dale for Mr W Balderson, Salakee, Church Lane, Thornton le Dale, Pickering, North Yorkshire, YO18 7QL. Decision Approved as recommended. 11. NYM/2011/0779/FL – Construction of a two storey extension to include integral double garage on ground floor together with erection of a stable block with tack room (revised scheme to NYM/2011/0489/FL) at Sutherland Cottage (The Dower House), Cropton for Mr Clive Ainley, 5 Harlestone Road, Swindon, Wiltshire, SN3 4ED. Decision Refused as recommended.

Planning Minute/4 12. NYM/2011/0446/FL – Conversion of and alterations to outbuildings to form 1 no. local occupancy dwelling together with annexe accommodation and 1 no. holiday letting cottage at Beacon Farm, Beacon Road, Ampleforth for Mr Robert Humpleby, 12 Lowfield, Southlands, Helmsley, North Yorkshire, YO62 6DH. Decision Approved contrary to Officer recommendation as Members considered that the material considerations of the case were sufficient to justify an exception to policy i.e. there was no conflict between the amenity space of the two buildings and the proposal was not part of a farm diversification scheme. The approval of the conversion to 1 no. local occupancy dwelling which is not tied to the main house through a Section 106 Agreement would therefore not harm or undermine Core Policy J or Development Policy 8. As such in this case and in the absence of any other planning constraints and lack of harm to the amenities of the locality, the proposal was considered to contribute to the aims of the Authority’s local needs housing strategy. 13. NYM/2011/0669/FL – Erection of an agricultural livestock building at Ramsdale Farm, Robin Hoods Bay for Mr Bill Ward, Dunsley Hall, Dunsley, Whitby, YO21 3TL. Decision Deferred at the request of the applicant’s agent in order to enable them to provide additional information to address Officer’s concerns.
